On the ratification of the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the mutual Establishment of Trade missions

To ratify Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the mutual establishment of trade missions, signed in Moscow on October 22, 1992.

Agreement between the Government of the Republic of Kazakhstan and By the Government of the Russian Federation on the mutual establishment of Trade Representative Offices

The Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as the "Contracting Parties",
striving to ensure economic relations between the countries based on the principles accepted in world practice,
based on the need to create effective national systems of foreign economic regulation,
in order to better coordinate foreign economic relations between the Contracting Parties,
have agreed on the following:
Article 1
The Contracting Parties shall establish Trade Representative Offices in the capitals of the Republic of Kazakhstan and the Russian Federation and provide them with office and residential premises on the basis of reciprocity.
Article 2
The Contracting Parties agreed that the Trade Missions will perform the following main functions:
a) to promote the development and expansion of trade and economic relations between the Republic of Kazakhstan and the Russian Federation;
b) represent the interests of their States in the host country in all matters related to trade and other types of economic cooperation between the two countries;
c) inform the state authorities of their country about the economic conditions in the country of location and its legislation in the field of foreign economic activity, as well as provide such information about their country to the interested authorities of the country of location;
d) to assist individuals and legal entities of their countries in carrying out transactions in the field of trade, economic, scientific and technical cooperation with legal entities and individuals of the host country.
Article 3
Trade missions act on behalf of the Government of their country.
The Trade Representative and his deputies, as well as the administrative and technical staff of the Trade Mission, enjoy the same privileges and immunities that are recognized under international law for the relevant categories of diplomatic and administrative and technical staff of foreign diplomatic missions.
The office and residential premises of a Trade Mission, its property and archives enjoy the immunities and privileges recognized under international law for the office and residential premises, property and archives of diplomatic missions.
A trade representative office is not subject to the rules on the trade register.
Article 4
The establishment of Trade representative offices in no way affects the rights of individuals and legal entities of the Republic of Kazakhstan and the Russian Federation to maintain direct relations with each other, in particular, for the purpose of concluding and executing contracts related to the implementation of trade, economic, scientific and technical cooperation.
Trade representative offices are not liable for the obligations of individuals and legal entities, and individuals and legal entities are not liable for the obligations of Trade representative offices.
Article 5
The opening of branches of Trade Representative offices in other cities of the country of residence may follow by agreement between the Contracting Parties.
The legal status of these offices will be determined by mutual agreement between the two Contracting Parties.
Article 6
This Agreement shall enter into force on the date of its signing. Done in Moscow on October 21, 1992, in two originals, each in the Russian and Kazakh languages, both texts being equally authentic.
