To ratify the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the procedure for crossing the Kazakh-Russian State Border by residents of the border territories of the Republic of Kazakhstan and the Russian Federation, signed in Uralsk on October 3, 2006.

AGREEMENT between the Government of the Republic of Kazakhstan and The Government of the Russian Federation on the procedure for crossing the Kazakh-Russian state border by residents of the border territories of the Republic of Kazakhstan and the Russian Federation

The Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as the Parties,

considering the historically established good neighborly relations,

Recognizing the need to preserve and develop economic, cultural and other traditional ties between the population of the border territories of the Republic of Kazakhstan and the Russian Federation,

Considering the provisions of article 7 of the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on Cooperation between the Border Regions of the Republic of Kazakhstan and the Russian Federation dated January 26, 1995,

have agreed on the following:

Article 1

The terms used in this Agreement mean the following:

"border territories" - administrative-territorial units of the Republic of Kazakhstan and the Russian Federation directly adjacent to the Kazakh-Russian state border, specified in Appendix No. 1 to this Agreement.;

"residents of border territories" - citizens of the Republic of Kazakhstan and the Russian Federation permanently residing in border territories;

"border" is the Kazakh-Russian state border established by the Agreement between the Republic of Kazakhstan and the Russian Federation on the Kazakh-Russian State Border dated January 18, 2005.;

"border crossing points" - places on the Kazakh-Russian state border, which are established for its crossing by residents of border territories under the terms of this Agreement and which can be specially equipped;

"border representatives of the States of the Parties" are officials appointed in accordance with the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the activities of Border Representatives dated January 9, 2004.

Article 2

Residents of the border territories of the State of one Party entering the border territories of the State of the other Party for up to 3 days, as well as those leaving back, may cross the border at the border crossing points specified in Annex 2 to this Agreement, and are required to comply with the legislation of the state of temporary residence, as well as the terms of this Agreement.

Termination of border crossing at the specified locations (completion of communication across the border) is carried out by agreement of the Parties.

Article 3

The organization of the regime for the passage of residents of border territories at border crossing points is entrusted to the border agencies of the States of the Parties.

Article 4

In case of epidemics, epizootics, natural disasters or other unforeseen circumstances and emergency situations, the border representatives of the States of the Parties may temporarily suspend border crossing by residents of the border territories.

Border representatives of the States of the Parties shall notify each other about this no later than 24 hours before the introduction and lifting of time restrictions.

Article 5

Residents of the border territories, unless otherwise provided for by agreements of the border representatives of the States of the Parties, cross the border at any time of the day on foot, on bicycles or horse-drawn vehicles.

Residents of the border territories of the State of one Party entering the border territories of the State of the other Party, as well as those leaving at the same border crossing point, may, without registration, move their cars, motorcycles and mopeds across the border for the period specified in Article 2 of this Agreement.

Residents of border territories may move goods across the border intended for personal, family, household and other needs not related to business activities in an amount not exceeding the norms of import (export) of goods provided for by the legislation of the state of each of the Parties without payment of customs duties and taxes.

If residents of the border territories intend to import (export) goods that are intended for production or other commercial activities, or the import (export) of which is prohibited or requires permits from the relevant authorities of the States of the Parties, their passage through the border crossing points is not allowed. Such residents are required to cross the border at checkpoints stipulated by the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on checkpoints across the Kazakh-Russian State Border dated December 23, 1998.

Border representatives of the States of the Parties, together with the administrations of the border territories, as necessary, exchange lists of goods, the import (export) of which is prohibited or requires permits from the relevant authorities of the States of the Parties, in order to inform residents of the border territories in advance.

Article 6

Residents of border territories cross the border at the border crossing points established by this Agreement on the basis of the documents specified in Appendix No. 3 to this Agreement.

Article 7

If, during the stay of a resident of the border territory of the State of one Party in the territory of the State of the other Party, the documents specified in Appendix No. 3 to this Agreement have been lost or damaged, such resident is obliged to immediately notify the internal affairs authorities of the host State.

In this case, the internal affairs authorities of the receiving State, after identification, issue to the specified resident a certificate of loss of documents, which is the basis for returning to the territory of the State of residence through checkpoints established at the border.

Article 8

Residents of the border territories crossing the border under the terms of this Agreement are obliged to comply with the legislation of the Host State.

Border representatives of the States of the Parties shall take measures to organize the reception (transfer) of residents of the border territories detained for committing administrative offenses in the border territories of the States of the Parties or violating the rules of border crossing. At the same time, the collection and registration of evidence of offenses is carried out in accordance with the legislation of the State of the Party in whose territory the offense was committed.

In case of violations by residents of the border territories of the requirements of the customs legislation of the States of the Parties regarding the movement of goods across the border, the border authorities of the States of the Parties shall immediately inform the customs authorities of the State of the Party in whose territory the offense was committed of such facts. In this case, the person who committed the offense is liable in accordance with the legislation of the State of the Party in whose territory the offense was committed.

Article 9

Disagreements arising during the implementation of this Agreement shall be discussed and resolved at meetings of the border representatives of the States of the Parties.

Unresolved disagreements are referred to the Parties for further consideration through diplomatic channels.

Article 10

By mutual agreement of the Parties, amendments may be made to this Agreement, which are formalized in separate protocols.

Article 11

This Agreement shall be applied temporarily from the date of signing and shall enter into force from the date of receipt of the last written notification on the completion by the Parties of the internal procedures necessary for its entry into force.

This Agreement is concluded for a period of 5 years and will be renewed each time for a subsequent 5-year period, unless either Party notifies the other Party in writing at least 6 months before the expiration of the next period of its intention to terminate this Agreement.

Done in Uralsk on October 3, 2006, in two copies, each in the Kazakh and Russian languages, both texts being equally authentic.

LIST OF DOCUMENTS valid for crossing the Kazakh-Russian state border by citizens of the Republic of Kazakhstan and the Russian Federation residing in the border territories

For citizens of the Republic of Kazakhstan

1. An identity card of a citizen of the Republic of Kazakhstan and a document confirming his registration at his permanent place of residence in a locality of the border territory, issued by the authorized state body of the Republic of Kazakhstan.

2. A passport of a citizen of the Republic of Kazakhstan and a document confirming his registration at his permanent place of residence in a locality of the border territory, issued by an authorized state body of the Republic of Kazakhstan.

3. Birth certificate (for children under 16 years old). When minors are traveling unaccompanied by their legal representatives, the presence of a notarized consent of these representatives for the departure of minors is mandatory.

For citizens of the Russian Federation

1. Passport of a citizen of the Russian Federation (if there is a note on registration of residence in a locality of the border area).

2. A passport of a citizen of the Russian Federation certifying the identity of a citizen of the Russian Federation outside the Russian Federation, and an extract from the house book certified by the registration authorities of citizens of the Russian Federation certifying his residence in a locality of the border territory.

3. Birth certificate (for children under 14 years of age) indicating the citizenship of the Russian Federation. When minors are traveling unaccompanied by their legal representatives, the presence of a notarized consent of these representatives for the departure of minors is mandatory.
