     To ratify the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the procedure for visiting the Baikonur complex, signed in Astana on May 21, 2009.

  AGREEMENT between the Government of the Republic of Kazakhstan and the Government of Of the Russian Federation on the procedure for visiting the Baikonur Complex

     The Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as the Parties, guided by The Agreement between the Republic of Kazakhstan and the Russian Federation on the basic principles and conditions of use of the Baikonur Cosmodrome dated March 28, 1994, the Agreement between the Republic of Kazakhstan and the Russian Federation on the Status of the city of Baikonur, the procedure for the formation and status of its executive authorities dated December 23, 1995, The Agreement between the Republic of Kazakhstan and the Russian Federation on the development of cooperation on the effective use of the Baikonur complex dated January 9, 2004, the Lease Agreement of the Baikonur complex between the Government of the Republic of Kazakhstan and the Government of the Russian Federation dated December 10, 1994, recognizing the need to improve the procedure for visiting the Baikonur complex, agreed as follows:

  Article 1

     The subject of this Agreement is to determine the procedure for visiting the Baikonur complex by citizens of the Republic of Kazakhstan and citizens of the Russian Federation - cosmodrome personnel, residents of the city of Baikonur, officials, media representatives, delegations, tourists, persons arriving in the city on private business, as well as foreign citizens and stateless persons.

  Article 2

     The terms "Baikonur complex", "Baikonur city", "residents of the city of Baikonur", "administration of the city of Baikonur", "cosmodrome personnel" used in this Agreement have the meanings defined by The Lease Agreement for the Baikonur complex between the Government of the Republic of Kazakhstan and the Government of the Russian Federation dated December 10, 1994 and the Agreement between the Republic of Kazakhstan and the Russian Federation on the Status of the City of Baikonur, the Procedure for the Formation and Status of its executive authorities dated December 23, 1995.       Other concepts used in this Agreement have the following meanings:       "facilities under the jurisdiction of authorized bodies of the Russian Side" - facilities of the Baikonur complex leased by the Russian Federation; "facilities under the jurisdiction of the Kazakh Side" - facilities located on the territory of the Baikonur complex and not leased by the Russian Federation;       "officials" - persons who permanently, temporarily or by special authority perform the functions of a representative of a public authority or perform organizational and administrative, administrative and economic functions in public authorities, local self-government bodies and state institutions of the states of the Parties.;       "delegation" - a group of persons consisting of representatives of government authorities, organizations, enterprises and institutions visiting the Baikonur complex in coordination with the authorized bodies of the Parties to participate in official events, meetings, negotiations, etc.; "foreign citizens" - persons who are not citizens of the Republic of Kazakhstan or citizens of the Russian Federation;       "stateless persons" are individuals who are not citizens of the Republic of Kazakhstan or citizens of the Russian Federation and do not have proof of citizenship (citizenship) of a third state.;       "representatives of mass media" - persons engaged in editing, creating, collecting or preparing messages and materials for the editorial office of a registered mass media, related to the editorial office by labor or other contractual relations, or engaged in such activities on behalf of the editorial board and accredited in the Republic of Kazakhstan or the Russian Federation; "tourists" - persons who organized visits to the Baikonur complex for familiarization and educational purposes on time and along the route agreed with the authorized bodies of the Parties;       "persons arriving in the city on private business" - persons arriving in the city of Baikonur at the invitation of residents of the city to sell agricultural products and industrial goods, provide services, as well as for other purposes unrelated to the functioning of the Baikonur complex.

  Article 3

     The authorized bodies for the implementation of this Agreement are:       On the Kazakh Side - the National Space Agency of the Republic of Kazakhstan; on the Russian Side - the Federal Space Agency and the administration of the city of Baikonur.

  Article 4

     The decision on admission to the facilities of the Baikonur complex of cosmodrome personnel, residents of the city of Baikonur, officials, delegations, representatives of the media, tourists, and persons arriving in the city on private business - citizens of the Republic of Kazakhstan and citizens of the Russian Federation - is made by the relevant authorized bodies of the Parties responsible for the relevant facilities.

  Article 5

     The decision on the admission of foreign citizens, as well as stateless persons, including representatives of the media and tourists, to the facilities of the Baikonur complex, which are under the jurisdiction of the authorized bodies of the Russian Side, is made by the relevant authorized bodies of the Russian Side with notification of the authorized body of the Kazakh Side.       The decision on the admission of foreign citizens, as well as stateless persons, including tourists, to the facilities of the Baikonur complex, which are under the jurisdiction of the Kazakh Side, is made by the authorized body of the Kazakh Side with notification to the authorized bodies of the Russian Side, and foreign citizens, as well as stateless persons who are representatives of the media - by agreement. with the Federal Space Agency.

  Article 6

     Applications for access to the facilities of the Baikonur complex under the jurisdiction of the Federal Space Agency are submitted by interested organizations and enterprises to the Federal Space Agency.       Applications for admission to the facilities of the Baikonur complex, which are under the jurisdiction of the Kazakh side, are submitted by interested organizations and enterprises to the authorized body of the Kazakh Side.       Applications for admission to the territory of the city of Baikonur of persons working in organizations of the city, arriving in the city on official and private business, are submitted to the administration of the city of Baikonur by interested persons and organizations of the Republic of Kazakhstan and the Russian Federation located in the city of Baikonur.       Applications containing information about the arriving persons (surname, first name, patronymic, nationality, identity document, place of work, position), dates and purposes of the visit, a list of visited facilities, data on vehicles and imported photo, video and other equipment, are submitted in the following time limits:       to ensure the admission of citizens of the Republic of Kazakhstan and citizens of the Russian Federation - at least 10 days before the date of the visit, while the deadline for reviewing applications is no more than 5 days.;       to ensure the admission of foreign citizens, as well as stateless persons, at least 55 days before the date of the visit, while the deadline for reviewing applications is no more than 45 days.

  Article 7

     Information about the permission or refusal of admission to the Baikonur complex for citizens of the Republic of Kazakhstan and citizens of the Russian Federation is communicated to applicants by the relevant authorized bodies at least 5 days before the planned date of visiting the Baikonur complex, and for foreign citizens and stateless persons - at least 10 days in advance. At the same time, the applicant is not notified of the reasons for the refusal of admission to the facilities of the Baikonur complex.       Registration and issuance of passes to the facilities of the Baikonur complex is carried out by the pass bureaus of the authorized bodies of the Russian Side on the basis of decisions on admission to the facilities of the Baikonur complex adopted by the relevant authorized bodies of the Parties in accordance with the procedure established by the provisions of this Agreement.

  Article 8

     Disputes and disagreements arising between the Parties in the interpretation and application of the provisions of this Agreement shall be resolved through consultations and negotiations between the authorized bodies of the Parties.       Controversial issues on which the authorized bodies of the Parties have not taken an agreed decision are submitted for consideration by the Sub-Commission on the Baikonur complex of the Intergovernmental Commission on Cooperation between the Republic of Kazakhstan and the Russian Federation.

  Article 9

     This Agreement may be amended and supplemented by mutual agreement of the Parties, which are formalized in separate protocols.

  Article 10

     This Agreement shall enter into force on the date of receipt of the last written notification that the Parties have completed the internal procedures necessary for its entry into force, and is valid until the end of the lease term of the Baikonur complex.       This Agreement remains in force until the expiration of 6 months from the date of receipt by one Party of a written notification by the other Party of the latter's intention to terminate it.

Done in Astana on May 21, 2009, in two copies, each in the Kazakh and Russian languages, both texts being equally authentic. In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will refer to the text in Russian.
