On the ratification of the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the Settlement of Mutual financial Issues and Settlement Terms in the field of military education and the use of testing grounds

     To ratify Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the settlement of mutual financial issues and settlement terms in the field of military education and the use of test sites, concluded in Moscow on November 25, 2005.

  AGREEMENT between the Government of the Republic of Kazakhstan and the Government of Of the Russian Federation on the settlement of mutual financial issues and settlement conditions in the field of military education and the use of testing grounds

     The Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as the Parties, guided by The Agreement between the Republic of Kazakhstan and the Russian Federation on military Cooperation dated March 28, 1994, recognizing the need to settle mutual financial obligations in accordance with international treaties to which the Parties are simultaneously parties in the field of military and military-technical cooperation, agreed as follows:

  Article 1

     The Parties acknowledge the existence of mutual financial obligations, including: from the Russian Side - rent arrears for the use of test sites located on the territory of the Republic of Kazakhstan from 1999 to 2004 in accordance with the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the lease of the Sary-Shagan test site dated October 18, 1996, taking into account the costs of the Russian Side related to the maintenance of infrastructure and life support of the city of Priozersk, in accordance with the Agreement between the Republic of Kazakhstan and the Russian Federation on the terms of Use and Lease of the Sary-Shagan test site and Life Support for the city of Priozersk dated January 20, 1995, the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the Lease of the Emba test site dated October 18, 1996, the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the lease of facilities and combat fields of the 929 State Flight Test Center of the Russian Federation, located on the territory of the Republic of Kazakhstan, dated October 18, 1996, by the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the lease of facilities and combat fields of the 4th State Central Training Ground of the Russian Federation located on the territory of the Republic of Kazakhstan, dated October 18, 1996, taking into account the withdrawal from lease of part of the leased property and land plots in accordance with Article 4 of these data contracts;       on the Kazakh Side, there is a debt on the training of Kazakhstani military personnel in the Russian Federation from 1996 to 2004 on the basis of contracts and agreements between the Ministry of Defense of the Republic of Kazakhstan and the Ministry of Defense of the Russian Federation in accordance with the Agreement on the Development of Cooperation in the field of military personnel Training dated March 6, 1998, the rates of reimbursement for training established in the contracts and the reconciliation act mutual settlements for the training and maintenance of military personnel of the Republic of Kazakhstan in universities of the Ministry of Defense of the Russian Federation dated March 30, 2005.

  Article 2

     The Parties shall make one-time repayment of mutual financial obligations listed in Article 1 of this Agreement in the amount of USD 135.73 million.       The Kazakh Side makes no further claims to the Russian Side related to the use of the Sary-Shagan, Emba test sites, facilities and combat fields of the 929 State Flight Test Center of the Russian Federation and 4 State Central Test Sites of the Russian Federation located on the territory of the Republic of Kazakhstan from 1999 to 2004.       The Russian Side does not make further claims to the Kazakh Side related to the costs of training Kazakhstani military personnel in the Russian Federation from 1996 to 2004 in accordance with the reconciliation act for the training and maintenance of military personnel of the Republic of Kazakhstan in universities of the Ministry of Defense of the Russian Federation dated March 30, 2005.

  Article 3

     Since January 1, 2005, the annual rent for the Russian Side's use of testing grounds located on the territory of the Republic of Kazakhstan has been paid in US dollars. Since January 1, 2005, the Kazakh Side has been paying for the training of Kazakhstani military personnel in military educational institutions of the Ministry of Defense of the Russian Federation in US dollars.       The Parties will make appropriate amendments and additions to the test site lease agreements specified in Article 1 of this Agreement.

  Article 4

     This Agreement shall enter into force on the date of receipt, through diplomatic channels, of the last written notification that the Parties have completed the internal procedures necessary for its entry into force.

     Done in Moscow on November 25, 2005, in two copies, each in the Kazakh and Russian languages, both texts being equally authentic.
