On the ratification of the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the transfer of educational institutions of the city of Baikonur

     To ratify Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the transfer of educational institutions of the city of Baikonur, signed in Moscow on December 23, 2014.

  AGREEMENT between the Government of the Republic of Kazakhstan and the Government of Of the Russian Federation on the transfer of educational institutions of the city of Baikonur

     The Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as the Parties, guided by The Lease Agreement for the Baikonur complex between the Government of the Republic of Kazakhstan and the Government of the Russian Federation dated December 10, 1994 (hereinafter referred to as the Lease Agreement), and The Agreement between the Republic of Kazakhstan and the Russian Federation on the status of the city of Baikonur, the procedure for the formation and status of its executive authorities dated December 23, 1995, recognizing the territory of the city of Baikonur - the administrative-territorial unit of the Republic of Kazakhstan and the need for cooperation in ensuring the constitutional rights of citizens of the states of the Parties, regardless of the language of instruction, to choose curricula, programs and textbooks recommended both in the Republic of Kazakhstan and in the Russian Federation, striving to create favorable conditions for children and the functioning of educational organizations in the city of Baikonur, the list of which is set out in in the Annex to this Agreement, have agreed as follows:

  Article 1

     The Russian Side transfers educational organizations of the city of Baikonur (hereinafter referred to as educational organizations) under the jurisdiction of the Russian Federation, and the Kazakh Side accepts educational organizations under the jurisdiction of the Republic of Kazakhstan, the list of which is set out in the annex to this Agreement, which is an integral part of it.

  Article 2

     Acceptance and transfer of educational organizations is carried out in accordance with their technical and operational documentation on their actual condition and includes the transfer by the Russian Side to the Kazakh Side of ownership of the property of educational organizations acquired at the expense of the Russian Federation, registered with the Property and Land Relations Departments of the Russian Federation of the city of Baikonur and under the operational management of educational organizations.

  Article 3

     To carry out the acceptance and transfer, the Parties create a joint commission consisting of their representatives and representatives of authorized bodies. The parties appoint the co-chairs of the joint commission, determine its composition and working procedure.       Based on the results of the admission and transfer of educational organizations, the joint commission draws up acceptance and transfer certificates, which provide, among other things, for the withdrawal of educational organizations from the Lease Agreement.       Acceptance and transfer certificates are signed by all members of the joint commission for transfer to the Kazakh-Russian Intergovernmental Commission on the Baikonur complex for approval.

  Article 4

     Financing of educational organizations, including payment for utilities, will be carried out by transferring transfers from the republican budget to the budget of the Kyzylorda region in accordance with the procedure established by the Government of the Republic of Kazakhstan.

  Article 5

     City public events related to the organization of cognitive activity and the implementation of additional educational programs for students will continue to be solved jointly with the participation of all educational organizations of the city of Baikonur, regardless of their jurisdiction.       The head of the Baikonur City Administration ensures coordination of cooperation between educational organizations during city public events.

  Article 6

     Disputes and disagreements arising from the interpretation and/or implementation of the provisions of this Agreement shall be resolved by the Parties through consultations and negotiations.

  Article 7

     The Parties may make amendments and additions to this Agreement through separate protocols.

  Article 8

     This Agreement shall begin to be applied temporarily after 30 days from the date of signing and shall enter into force from the date of receipt of the last written notification on the completion by the Parties of the internal procedures necessary for the entry into force of this Agreement.       Termination of this Agreement will not affect the validity or duration of the activities implemented under this Agreement until their completion, unless the Parties decide otherwise.       Done in Moscow on December 23, 2014, in two copies, each in the Kazakh and Russian languages, all texts being equally authentic.       In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will refer to the text in Russian.
