On the ratification of the Agreement on Common Transit Conditions through the Territories of the Member States of the Customs Union

The Government of the Republic of Belarus, the Government of the Republic of Kazakhstan, the Government of the Kyrgyz Republic and the Government of the Russian Federation, hereinafter referred to as the Parties,
Having regard to the Fundamentals of the Customs Legislation of the Member States of the Commonwealth of Independent States of February 10, 1995,
Reaffirming its commitment to the principles of freedom of transit,
Recognizing the need to simplify international transportation by all modes of transport by harmonizing and unifying customs procedures without prejudice to the national interests of each of the States Parties to this Agreement,
Considering that the improvement of transportation conditions is one of the essential factors for the development of cooperation,
Reaffirming the principles enshrined in the 1995 Agreements on the Customs Union,
have agreed on the following.
Article 1
This Agreement uses terms defined in accordance with the Fundamentals of the Customs Laws of the member States of the Commonwealth of Independent States dated February 10, 1995.
Article 2
Goods transported in transit through the territories of the States Parties to this Agreement must:
- to remain unchanged, except for changes due to natural wear or loss under normal conditions of transportation and storage;
- not to be used for any purpose other than transit;
- be delivered to the customs authority of destination within the time limits established by the customs authority of departure, based on the capabilities of the vehicle, the planned route and other conditions of transportation, but not exceeding the deadline determined at the rate of two thousand kilometers per month.
Article 3
Goods, as well as vehicles transporting the goods specified in this article (hereinafter referred to as transit goods) during transportation:
from third States to the territory of any of the States Parties to this Agreement through the territory of at least one other State Party to this Agreement;
from the territory of any of the States Parties to this Agreement to third countries through the territory of at least one other State Party to this Agreement;
from one State Party to this Agreement to another State Party to this Agreement through the territory of at least one other State Party to this Agreement;
in the States of transit that are parties to this Agreement, they are exempt from paying customs duties, taxes and fees for customs clearance, as well as from applying economic policy measures to goods.
Article 4
The customs authorities of the Parties have the right to apply measures to ensure compliance with national legislation to transit goods transported between States not participating in this Agreement through the territory of at least one of the States Parties to this Agreement.
Article 5
The goods specified in Appendix 1 to this Agreement are prohibited from transit through the territory of either Party.
The goods specified in Annex 2 to this Agreement are allowed to transit through the territory of any of the States Parties to this Agreement, subject to the availability of transit permits issued by the authorized authorities of all those States Parties to this Agreement through which the transportation route passes.
The customs authorities of the Parties have the right to apply measures to ensure compliance with national customs legislation during the transit of goods through the territory of their states.
Article 6
The facilities and services necessary to ensure transit are provided to carriers in transit States on terms no worse than those under which the same facilities and services are provided to their own exporters, importers or carriers.
Article 7
The crossing of the borders of the member States of the Customs Union by goods in transit and vehicles transporting them is allowed in places determined by the customs authorities of these states in coordination with the competent authorities of the States Parties to this Agreement in the field of transport.
The Parties will instruct the customs authorities, within three months from the date of signing this Agreement, to exchange lists of established places where goods in transit and vehicles transporting them cross the borders of the member States of the Customs Union.
Transit of goods through the territory of any of the States Parties to this Agreement may be carried out along any routes and directions, unless otherwise established by the national legislation of that State.
Article 8
Transshipment of transit goods to other means of transport, including with the splitting of shipments, is carried out in places determined in each case by the customs authorities of the States Parties to this Agreement.
The customs authorities of the States Parties to this Agreement shall mutually recognize the means of identification of goods in transit, as well as the documents necessary for the control of goods in transit and vehicles. The Parties will instruct the customs authorities of their states to exchange samples of identification tools, as well as documents necessary for the control of transit goods and vehicles, within three months.
Article 9
In cases of transit interruption due to the occurrence of force majeure circumstances, the procedure established by the norms of the national legislation of the State Party to this Agreement in which the transit interruption occurred shall be applied.
Article 10
The Parties will instruct their central customs authorities to prepare and accept the following four-party documents within three months after signing this Agreement:
Regulation on the procedure for customs clearance of goods transported under Customs control through the territories of the Member States of the Customs Union;
Regulations on Customs carriers of the Customs Union;
Regulations on customs escort in the territory of the member States of the Customs Union.
The coordination of the work provided for in this article is entrusted to the Integration Committee.
Article 11
The Parties may, by mutual agreement, make additions and amendments to this Agreement, which will be formalized in the form of protocols and annexes that are an integral part of this Agreement.
Article 12
Disputes and disagreements in the interpretation and application of this Agreement will be resolved through negotiations and consultations between the Parties, with consideration, if necessary, by the Integration Committee, and if an agreed solution is not reached, by the Council of Heads of Government at the Interstate Council. The decision of the Council of Heads of Government will be final and binding on all Parties.
Article 13
This Agreement is open for accession by any State that has acceded to the Customs Union agreements, recognizes the provisions of this Agreement in force at the time of accession, and expresses its readiness to comply with them in full.
Article 14
This Agreement shall be temporarily applied from the date of signature and shall enter into force from the date of deposit of the last notification to the depositary on the completion by the Parties of all necessary domestic procedures.
The Integration Committee is the depositary of this Agreement.
Article 15
Either Party has the right to withdraw from this Agreement by sending a written notification of its intention to the depositary at least twelve months prior to withdrawal, having previously settled its obligations assumed in accordance with this Agreement.
Done in Moscow on January 22, 1998, in one original copy in the Russian language.
The original copy is kept in the Integration Committee, which will send a certified copy to each State Party to this Agreement.

The concept of "residues" includes: waste in the form of sludge, residue, slag, dross, scraps, scale, dust, powder, sludge and cake, unless one or another material is explicitly included in other entries.
