On the ratification of the Agreement on the Establishment of the Civil Protection Mechanism of the Organization of Turkic States

Agreements on the Establishment of the Civil Protection Mechanism of the Organization of Turkic States
The Government of the Republic of Azerbaijan, the Government of the Republic of Kazakhstan, the Cabinet of Ministers of the Kyrgyz Republic, the Government of the Republic of Turkey and the Government of the Republic of Uzbekistan (collectively referred to as the "Parties" and separately as the "Party"),
Taking into account the Declaration of the Eighth Summit of the Organization of Turkic States (hereinafter - OTS), adopted in Istanbul on November 12, 2021, and the Decision of the Council of Heads of State of the OTS, adopted in Ankara on March 16, 2023, on the establishment of a Civil Protection Mechanism for OTS,
Noting the crucial importance of international cooperation in disaster and emergency situations,
Taking into account the desire of the Parties to quickly provide emergency support and coordination tasks in the event of disasters that may occur on the territory of the Member States and observer States of the Group, as well as other States, and to support response, life and property rescue, medical care, emergency communications, monitoring and analysis, and shelter provision, provision of humanitarian assistance during natural disasters and emergencies, as well as prevention and preparedness, transfer of knowledge and experience in disaster response,
Emphasizing the expanding cooperation and strengthening of solidarity between the Turkic States and their peoples on the basis of their historical ties, common language, culture and traditions,
We have agreed on the following:
Article 1
Purpose, functions and scope of the Civil Protection Mechanism
1. The Parties hereby establish the Civil Protection Mechanism of the Organization of Turkic States (hereinafter referred to as MGZOTG) in the form of an international organization with legal personality.
2. The purpose of the IHL is to establish a joint mechanism for responding to natural disasters and emergencies that may occur on the territory of the Member States and observer States, as well as other States.
Support is provided at the request of the affected State during a disaster or emergency.
In each case of a disaster or emergency, involvement in the MGZOTG support activities is carried out on a voluntary basis.
The decision to provide assistance to other States is made in each case on the basis of consensus.
3. The main functions of MGZOTG:
- response, life and property rescue, medical care, emergency communications, monitoring and analysis, shelter provision, humanitarian assistance during disasters and emergencies, as well as prevention and preparedness, exchange of knowledge and experience in disaster response;
- development of uniform standards of professional training and organization of theoretical and practical in-service training programs in order to enhance the professional competence of personnel at all levels working in the field of emergency management;
- organization of trainings, exercises and administrative and technical visits to develop joint methods of responding to regional disasters and emergencies.
4. Within the framework of the MGZOTG, the Parties notify each other and the TG Secretariat of all activities related to this Agreement.
Article 2
Competent authorities
1. The competent authorities of the States responsible for the implementation of this Agreement are:

2. Each Party appoints a coordinator for communication and interaction with the MGCOTG and, upon submission of a written notification confirming the passage of internal procedures necessary for the entry into force of this Agreement, notifies the depositary of its coordinator with his contact details, and the depositary informs all Parties and the MGCOTG Secretariat about this.
3. In the event of any changes concerning the competent authority or coordinator, the Party concerned shall immediately notify the depositary through diplomatic channels, which shall inform all Parties and the IHL Secretariat accordingly.
Article 3
Administrative structure
1. To fulfill the goals and objectives of this Agreement, the following MGZOTG administrative unit is being created:
- Council of Ministers Responsible for Disaster and Emergency Management;
- The MGZOTG secretariat.
2. The procedure and principles of functioning of the MGZOTG Secretariat are determined by the rules to be adopted by the Council of Ministers.
Article 4
The Council of Ministers
1. The Council of Ministers, which is the highest governing body of the MGZOTG, consists of the Ministers of the Parties responsible for disaster management.
2. The Council of Ministers carries out its activities through regular ministerial meetings, which are held at least once a year.
3. The Minister of the Party presiding in the TG heads the Council of Ministers.
4. The Ministers make decisions on the functioning and management of the MGZOTG on the basis of consensus.
5. The Council of Ministers should:
- manage, monitor and make decisions on the functioning and management of the MGZOTG;
- approve annual administrative and financial reports on the work of the mechanism;
- to consult on the mandatory contributions of the Parties;
- Adopt the main documents within the framework of the MGZOTG, including the document on the joint emergency response strategy and the joint emergency response plan prepared by the MGZOTG Secretariat;
- to consider and make decisions on any other issue related to the fulfillment of the objectives and functions of the MGZOTG.
Article 5
The Secretariat of the Civil Protection Mechanism
1. The MGZOTG secretariat, being a permanent executive body, facilitates the implementation of the goals and objectives, as well as implements and coordinates the work and activities of MGZOTG.
2. The MGCOT secretariat is headed by the Secretary General, who is appointed by the Council of Ministers on a rotating basis in accordance with the alphabetical order of the official names of the Parties in English.
3. The term of office of the Secretary-General is three years. The term can be extended for a maximum of two years.
4. The headquarters of the MGZOTG Secretariat will be located in Istanbul (Republic of Turkey). The Republic of Turkey will provide premises and support the establishment of the MGCOTG Secretariat.
The Party on whose territory the headquarters of the MGZOTG Secretariat is located shall conclude an Agreement with the MGZOTG Secretariat on the conditions of the Secretariat's stay, which shall specify the relevant provisions, conditions, staff status, privileges and benefits.
Article 6
Financing
1. MGZOTG has its own budget, which consists of annual mandatory payments made by the Parties. Voluntary contributions to the MGZOTG budget are possible.
2. The parties conclude a separate international agreement on the formation and execution of the MGZOTG budget.
3. Until the entry into force of the international agreement on the formation and execution of the MGZOTG budget, the annual symbolic mandatory payment for each Party is 50,000 US dollars.
4. Expenses exceeding the total amount of annual mandatory payments shall be covered by the Republic of Turkey for two years starting from the date of entry into force of this Agreement.
Article 7
Dispute resolution
All disagreements arising in connection with the interpretation or execution of this Agreement will be resolved through negotiations and consultations between the Parties.
Article 8
Final provisions
1. This Agreement shall enter into force on the thirtieth day after the receipt by the depositary through diplomatic channels of the last written notification from the Parties confirming the completion of the internal procedures necessary for its entry into force.
2. After the entry into force of this Agreement, it becomes open for accession by the Member States and observer States of the United Nations. Other States may accede to this Agreement with the consent of all Parties. This Agreement shall enter into force for the acceding State on the thirtieth day after the receipt by the depositary through diplomatic channels of a written notification confirming the completion of the internal procedures necessary for its entry into force.
3. The Government of the Republic of Turkey is the depositary of this Agreement.
4. This Agreement may be amended and supplemented at any time by mutual written consent of the Parties. Amendments and additions are drawn up in the form of separate protocols, which are an integral part of this Agreement and enter into force in accordance with the procedure provided for in paragraph 1 of this Article.
5. Any Party may withdraw from this Agreement at any time by sending a corresponding written notification to the depositary. This Agreement shall terminate for such Party on the first day of the month following the date of receipt of the notification by the depositary.
Done in Bishkek on November 6, 2024, in a single copy in the Azerbaijani, Kazakh, Kyrgyz, Turkish, Uzbek and English languages, all texts being equally authentic. In case of divergence of interpretation, the English text is used. The original copy of this Agreement shall be kept by the depositary, who shall send a certified copy to each Party.
