  agreement ABOUT THE ESTABLISHMENT OF THE TURKIC ACADEMY

     The Governments of the Republic of Azerbaijan, the Republic of Kazakhstan, the Kyrgyz Republic and the Republic of Turkey, hereinafter referred to as the "Parties", referring to the terms Nakhichevan Agreement on the Establishment of the Cooperation Council of Turkic-speaking States dated October 3, 2009; - taking into account the Declaration of the 10th Summit of the Heads of Turkic-speaking States, signed on September 16, 2010 in Istanbul, recognizing the need to establish a Turkic Academy;       - recognizing the importance of the historical and spiritual role of the Turkic culture, which unites and guides the Turkic people in their common efforts; - taking into account the contribution of the Turkic peoples to the historical and cultural heritage of mankind and to the development of world civilization; - determined to develop cooperation in the field of education and science to strengthen friendly relations between Turkic-speaking states and peoples; - Striving to promote the integration of the Turkic peoples through the promotion of academic research and education; agreed as follows:  

  Article 1

     The Parties hereby establish the Turkic Academy in the form of an international organization under the auspices of the Cooperation Council of Turkic-speaking States (hereinafter referred to as the "Turkic Council").  

  Article 2

     The goals and objectives of the Turkic Academy are:       - coordination and promotion of research in the field of Turkology aimed at preserving, developing and popularizing diachronic studies of Turkic languages, literature and culture; - promotion of the development of Turkology and international cooperation in the field of scientific research on Turkology; - implementation of comprehensive training in general Turkic history and ethnography;       - conducting research on the cultural and spiritual heritage of the Turkic peoples, their contribution to the development of world civilization, as well as informing the world community about their achievements; - promoting and encouraging initiatives of scientific communities, cultural and educational circles, relevant government agencies of the Parties, as well as other Turkic-speaking states; - striving to create a common literary language for all Turkic peoples using the full potential of the Turkic languages, including common ancient texts and oral sources;       - development of a consolidated alphabet applicable to all Turkic languages; - conducting research in order to prepare general textbooks/methodological material for use by educational institutions of the States of the Parties; - training specialists in Turkology under the PhD doctoral program for researchers recruited to work at the Turkic Academy.  

  Article 3

     The location of the Turkic Academy is the city of Astana, Republic of Kazakhstan. The Government of the Republic of Kazakhstan will provide an appropriate building for the Turkic Academy.  

  Article 4

     The Academy functions as an international organization, which is governed by a Scientific Council, which includes one representative from each Side, as well as the President and Vice-Presidents of the Turkic Academy. The Scientific Council is chaired by the members of the Scientific Council on an annual rotating (alternating) basis in accordance with the alphabetical order according to the official names of the States of the Parties in English.       The Scientific Council makes decisions by a majority vote.       The functions of the executive body of the Turkic Academy are performed by the President, who is appointed by the Council of Heads of State of the Cooperation Council of Turkic-speaking States (hereinafter referred to as the "CCG") on the proposal of the Scientific Council. Vice Presidents are appointed by the State of each Party, with the exception of the State of the President's nationality.       The President is appointed from among the citizens of the State of the Parties for a four-year period on a renewable basis. The first President is appointed from among the citizens of the Republic of Kazakhstan, subsequent Presidents are appointed in accordance with the alphabetical order according to the official names of the Parties in English: Azerbaijan, Kyrgyzstan, Turkey.       In cases requiring immediate measures or illness leading to disability, the President may be removed and/or dismissed from his post by a decision of the SGG on the proposal of the Scientific Council.       The Vice-Presidents are appointed by the Scientific Council from among the citizens of the States of the Parties for a four-year period on a renewable basis.       In cases requiring immediate measures or illness leading to disability, Vice-Presidents may be suspended and/or dismissed from their posts by a decision of the Scientific Council.       The directions of scientific research are determined by the Scientific Council. The involvement of researchers is carried out by the Turkic Academy, taking into account their scientific achievements. Researchers are engaged for a certain period on a contractual basis according to the objectives and objectives of the research.       The staff of the Turkic Academy is appointed by the President.  

  Article 5

     The President of the Academy prepares a report on the activities of the Academy and submits it through the Secretary General of the Turkic Council for consideration by the SGG.  

  Article 6

     The Parties authorize the Academy, represented by the President, to conclude with the Government of the Republic of Kazakhstan an Agreement on the conditions and procedure for the placement of the Turkic Academy in the territory of the Republic of Kazakhstan, the draft of which must first be approved by the Council of Ministers of Foreign Affairs of the Turkic Council (hereinafter referred to as the "CFM").       To achieve its goals, the Academy uses international legal capacity, including:       - to conclude international agreements; - to acquire and dispose of property; - to be a plaintiff and a defendant in court;       - open accounts and make transactions of monetary assets.  

  Article 7

     The President and Vice-Presidents of the Turkic Academy and their family members who are not citizens of the Republic of Kazakhstan or permanent residents of the Republic of Kazakhstan enjoy the priorities and immunities granted to diplomatic agents in the Republic of Kazakhstan in accordance with articles 29-36 of the Vienna Convention on Diplomatic Relations of April 18, 1961 to the extent provided for in the above articles.       The scope of privileges and immunities of foreign full-time employees of the Turkic Academy will be determined in the Agreement on the conditions and procedure for the placement of the Turkic Academy in the territory of the Republic of Kazakhstan.       Full-time employees of the Academy are exempt from payroll tax and remuneration paid by the Turkic Academy.  

  Article 8

     The Turkic Academy develops a draft budget and sends it with calculations and justifications for each item for consideration by the Parties in the first half of the year preceding the new fiscal year. After the approval of the draft budget by the Parties, it is approved by the Council of Ministers of Foreign Affairs.       The mandatory contributions of the Parties are determined by the Council of Ministers of Foreign Affairs, taking into account the solvency of the Parties, the existing amount of contributions to the United Nations and their existing contributions to similar regional organizations. At the same time, the mandatory contributions of the host Party should not be lower than the mandatory contributions of other Parties.       The amount of mandatory contributions is defined in a separate protocol signed by the Council of Ministers of Foreign Affairs. The amount of voluntary contributions to the Academy is unlimited.  

  Article 9

     An independent audit of the financial and economic activities of the Turkic Academy is conducted at least once a year by an authorized body of the Ministry of Foreign Affairs. The President of the Turkic Academy submits to the authorized body all the documents necessary for conducting an independent audit.       The audit report compiled based on the results of an independent audit is sent by the President of the Turkic Academy to all Parties.  

  Article 10

     By the decision of the Council of Foreign Ministers, third parties and international organizations may receive observer status.  

  Article 11

     The working languages of the Turkic Academy are the state/official languages of the Parties and English.  

  Article 12

     Any differences that may arise in the interpretation and application of the provisions of this Agreement shall be resolved by the Parties through consultations and negotiations.  

  Article 13

     Amendments and additions to this Agreement shall be drawn up in the form of separate protocols, which are an integral part of this Agreement and enter into force in accordance with the procedure established in Article 14 of this Agreement.  

  Article 14

     This Agreement shall be concluded for an indefinite period and shall enter into force on the thirtieth day after the receipt through diplomatic channels of the third written notification by the depositary on the completion of the internal procedures necessary for its entry into force.       This Agreement shall enter into force for other States that have acceded to it on the thirtieth day after the receipt by the depositary of the relevant instrument of ratification.       From the date of its entry into force, this Agreement is open for accession by other Turkic-speaking States. The Agreement enters into force for these States on the thirtieth day after the receipt of the instrument of accession by the depositary.  

  Article 15

If one of the Parties decides to withdraw from this Agreement, it shall cease to be valid only for that Party upon the expiration of six months from the date of receipt by the depositary through diplomatic channels of the written notification of the Party.       The Party withdrawing from this Agreement waives its rights to the Academy's property, including intellectual property rights, artifacts or other gifts donated to the Turkic Museum, as well as books and other similar electronic materials donated to the Turkic Library.  

  Article 16

     The Republic of Kazakhstan is the depositary of this Agreement.       Done in Bishkek on August 23, 2012, in one original copy in the Azerbaijani, Kazakh, Kyrgyz, Turkish and English languages, which are equally authentic.       In case of disagreement in the interpretation of the provisions of this Agreement, the Parties shall refer to the English text.       The original copy of this Agreement shall be kept by the depositary, who shall send a certified copy to each signatory Party.
