On the ratification of the Agreement on the General Principles of the Establishment of Interstate Scientific and Industrial Associations in the Collective Security Treaty Organization for the production of military products

To ratify the Agreement on General Principles for the Establishment of Interstate Scientific and Industrial Associations in the Collective Security Treaty Organization for the Production of military Products, signed in Moscow on December 10, 2010.

AGREEMENT on General Principles for the Establishment of Interstate Scientific and Industrial Associations in the Collective Security Treaty Organization for the production of military products (Entered into force on May 28, 2012 - Bulletin of International Treaties 2012, No. 4, art. 61)
The member States of the Collective Security Treaty Organization (hereinafter referred to as the CSTO), hereinafter referred to as the Parties,
Guided by the desire to improve the military-technical and military-economic cooperation of the Member States of the Organization,
Recognizing the need to create conditions for joint support for the development and integration of defense industry enterprises in the Organization's Member States,
have agreed on the following:
Article 1
For the purposes of this Agreement, the following terms mean:
"military products" (hereinafter referred to as PVN) - weapons, military equipment, documentation, works, services, results of intellectual activity, including exclusive rights to them (intellectual property), and information in the military-technical field, as well as any other products related to national legislation, regulatory legal acts of the Parties to the PVN;
"interstate scientific and production associations (joint ventures) for the production of military products" (hereinafter referred to as Associations) are enterprises (organizations) of the Organization's member states that have combined their scientific, technical, industrial, intellectual and investment potentials for the development, production, repair, modernization and disposal of military equipment.
Article 2
Associations are established on the basis of bilateral or multilateral agreements between the Parties concerned.
Article 3
The issues of economic activity of the created Associations are determined by the constituent documents in accordance with the national legislation of the Party of registration of the Association.
Article 4
The Association carries out foreign trade activities with the Parties in relation to the products it produces.
The right to carry out foreign trade activities is granted in accordance with the national legislation of the Party where the Association is registered as a legal entity.
Article 5
Air defense supplies to the Organization's member States are carried out on the basis of the Agreement on the Basic Principles of Military-Technical Cooperation between the States Parties to the Collective Security Treaty of May 15, 1992, signed on June 20, 2000.
On issues of unconditional compliance with the provisions of the aforementioned Agreement and control over the targeted use of air defense systems supplied by the Association to the Organization's member States, the Association cooperates with the authorized bodies of the Parties on issues of military-technical cooperation.
Article 6
The Association supplies PVN to third parties in accordance with the national legislation of the Party where it is registered as a legal entity.
Article 7
Goods transported by enterprises of the Association of PVN, as well as goods for the production of PVN originating from the customs territory of one Party and imported into the customs territory of the other Party, intended for this Party, are exempt from import customs duties.
The basis for such an exemption is the list of air defense products and goods for the production of air defense agreed by the authorized bodies for military-technical cooperation of the Parties or the conclusion of this body of the Importing Party that imported air defense products and/or goods intended for the production of air defense are imported in accordance with this Agreement.
Article 8
The activities of enterprises included in the Association are subject to taxation in accordance with the national legislation of the Party where they are registered as a legal entity.
Article 9
The creation of Associations does not prevent the preservation and development of cooperative relations between enterprises that have joined the Association with enterprises of States that are not parties to this Agreement, which are carried out on the terms of relevant international treaties.
Article 10
Joining an Association does not exclude the right of enterprises to engage in foreign trade activities in accordance with national legislation, unless otherwise stipulated in the constituent documents of the Association.
Article 11
The protection of information obtained in the course of the Association's activities and constituting a state secret (state secrets) is carried out in accordance with the Agreement on Mutual Security of Classified Information within the framework of the Collective Security Treaty Organization dated June 18, 2004 and the national legislation of the Parties.
Article 12
The Parties shall ensure the protection of the results of intellectual activity used and obtained in the course of the activities of Associations, in accordance with the Agreement on Mutual Protection of Intellectual Property Rights Obtained and Used in the Course of Military-economic Cooperation within the framework of the Collective Security Treaty Organization of October 6, 2007 and international treaties to which the Parties are parties, and national by the legislation of the Parties.
Article 13
Disputes and disagreements regarding the interpretation and application of the provisions of this Agreement are resolved through consultations and negotiations between the Parties concerned.
Article 14
By agreement of the Parties, amendments and additions may be made to this Agreement, which are an integral part of it, which are formalized by the relevant protocol and enter into force in accordance with the procedure provided for in Article 15 of this Agreement.
Article 15
This Agreement shall enter into force on the date of deposit of the fourth written notification to the depositary on the completion by the signatories of the internal procedures necessary for its entry into force.
For the Parties who have completed the necessary internal procedures later, this Agreement shall enter into force on the date of delivery of the relevant documents to the depositary.
Article 16
This Agreement is valid for the duration of the Collective Security Treaty of May 15, 1992, unless the Parties agree otherwise.
Each Party may withdraw from this Agreement by sending a written notification to the depositary no later than six months before the withdrawal date, having settled the financial and other obligations that have arisen during the validity of this Agreement.
Done in Moscow on December 10, 2010, in one original copy in the Russian language. The original copy is kept at the Secretariat of the Collective Security Treaty Organization, which will send a certified copy to each Signatory to this Agreement.
