FRAMEWORK AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF KAZAKHSTAN AND THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF CHINA ON GRANTING A PREFERENTIAL LOAN BY THE PEOPLE'S REPUBLIC OF CHINA
The Government of the Republic of Kazakhstan and the Government of the People's Republic of China (hereinafter referred to as the "Parties"),
in order to further develop friendly relations and technical and economic cooperation between the two countries,
have agreed on the following:
Article 1
The Government of the People's Republic of China hereby agrees that the Export-Import Bank of China (hereinafter referred to as the lender) will provide a concessional loan (hereinafter referred to as the loan) totaling no more than 2.062 billion rubles. Chinese yuan (two billion sixty-two million Chinese yuan) The Government of the Republic of Kazakhstan, represented by the Ministry of Finance of the Republic of Kazakhstan (hereinafter referred to as the borrower), to implement the project "Modernization and technical retrofitting of checkpoints located on the Kazakh section of the customs border of the Eurasian Economic Union" (hereinafter referred to as the project).
The cost of subsidizing interest on the loan is paid by the Government of the People's Republic of China directly to the lender.
Article 2
The main conditions for granting a Loan are:
1) the term of the Loan, including the term of use, grace period and repayment period, does not exceed 20 (twenty) years, while the grace period does not exceed 5 (five) years;
2) the interest rate on the loan is 2 (two) percent per annum.
Article 3
The project has been agreed upon by the Parties, evaluated and approved by the Lender.
In case of re-crediting of this loan, the project must be evaluated and approved by the lender and the re-crediting authority authorized by the Government of the Republic of Kazakhstan.
Article 4
The Loan agreement on the use of the loan (hereinafter referred to as the loan agreement) will be concluded between the lender and the borrower after the entry into force of this Framework Agreement.
If necessary, by mutual agreement of the Parties, amendments and additions may be made to this Framework Agreement, drawn up in legal forms acceptable to both Parties, which are integral parts of this Framework Agreement and enter into force in accordance with the terms of entry into force of this Framework Agreement.
Article 5
The Parties shall promptly check the progress of the Loan Agreement, as well as conduct consultations and negotiations on relevant issues and disputes that may arise during the implementation of this Framework Agreement.
Article 6
This Framework Agreement shall enter into force on the date of receipt, through diplomatic channels, of the last written notification that the Parties have completed the internal procedures necessary for the entry into force of this Framework Agreement.
This Framework Agreement shall automatically terminate if, within three (3) years, The loan agreement will not be concluded between the lender and the borrower for several years from the date of its entry into force.
Done in Beijing on June 7, 2018, in two copies in Kazakh, Chinese and English. In case of discrepancies between the texts, the English text will prevail.
