THE FRAMEWORK AGREEMENT ON COMPREHENSIVE ECONOMIC COOPERATION BETWEEN THE EURASIAN ECONOMIC UNION AND ITS MEMBER STATES, ON THE ONE HAND, AND THE REPUBLIC OF SINGAPORE, ON THE OTHER HAND

THE PREAMBLE

      The Republic of Armenia (hereinafter referred to as "Armenia"), the Republic of Belarus (hereinafter referred to as "Belarus"), the Republic of Kazakhstan (hereinafter referred to as "Kazakhstan"), the Kyrgyz Republic (hereinafter referred to as "Kyrgyzstan"), the Russian Federation (hereinafter referred to as "Russia") (collectively referred to as the "EAEU Member States") and the Eurasian Economic Union (hereinafter referred to as the "EAEU"),

      on the one hand, and

      The Republic of Singapore (hereinafter referred to as "Singapore"),

      on the other hand,

      RECOGNIZING the importance of strengthening long-term relations, strong friendship and traditional multifaceted cooperation between the Parties;

      RECALLING the mutual desire of the Parties for a comprehensive economic partnership covering trade in goods, trade in services, investment and trade-related areas;

      DESIRING to create a favorable environment and conditions for the development of mutual trade relations and the promotion of economic cooperation between the Parties in areas of mutual interest;

      DESIRING to eliminate trade and investment barriers between the Parties, reduce business costs and increase economic efficiency;

      REAFFIRMING the importance of existing initiatives for economic cooperation between the Parties, as well as agreeing to further develop the existing economic partnership in areas of mutual interest;

      WE have AGREED on the following:

chapter 1

GENERAL PROVISIONS

Article 1.1

Goals

     The purpose of this Framework Agreement is to create the basis for comprehensive economic cooperation between the EAEU and the EAEU Member States, on the one hand, and Singapore, on the other hand, through:

     (a) strengthening and expanding economic and trade relations between the EAEU and its EAEU member States, on the one hand, and Singapore, on the other hand, as well as investment cooperation between the EAEU Member States and Singapore; and

     (b) liberalizing and facilitating trade in goods between the EAEU and the EAEU Member States, on the one hand, and Singapore, on the other hand, and services between the EAEU member States and Singapore, as well as creating a transparent, liberal and stimulating investment regime between the EAEU member States and Singapore.

Article 1.2

Definitions

     For the purposes of this Framework Agreement, unless otherwise provided:

      "day" is a calendar day, including weekends and holidays.;

      The Eurasian Economic Commission is a permanent regulatory body of the EAEU in accordance with the EAEU Treaty of May 29, 2014 (hereinafter referred to as the "EAEU Treaty").;

      "Parties" - on the one hand, the EAEU within its competence established by the EAEU Treaty, and (or) its member States and, on the other hand, Singapore.

Article 1.3

Scope and relationship to other agreements

 

      1. The objectives set out in Article 1.1 (objectives) are achieved through the following agreements:

     (a) this Framework Agreement;

     (b) Free Trade Agreements between the Eurasian Economic Union and its member States, on the one hand, and the Republic of Singapore, on the other hand, from "__" ________20__ d; and

     (c) agreements on trade in services and investments to be concluded in the future between:

     i.Armenia and Singapore;

     ii.Belarus and Singapore;

     iii.Kazakhstan and Singapore;

     iv.Kyrgyzstan and Singapore; and

     v.Russia and Singapore.

     2. None of the agreements listed in paragraph 1 should provide for any rights or obligations for the EAEU or any of its member States if they are not parties to such an agreement.

Article 1.4

Ministerial consultations

     1. At the request of one of the Parties, the Parties shall hold consultations at the level of authorized ministers responsible for trade on the following issues:

 

      (a) termination of any of the agreements referred to in paragraph 1 of Article 1.3 (Scope and relationship to other agreements);

     (b) the accession of a new Member State to the EAEU in accordance with the EAEU Treaty;

     (c) the withdrawal of an EAEU Member State from the EAEU in accordance with the EAEU Treaty; or

     (d) any other matter by mutual agreement of the Parties.

     2. The request for consultations referred to in paragraph 1 shall be sent by the requesting Party to the other Party in writing through diplomatic channels. Such consultations shall be conducted within 30 days of receipt of the request by the other Party in the territory of the requesting Party, unless otherwise agreed by the Parties.

 

      3. During the consultations referred to in paragraph 1, the Parties shall, inter alia, examine, taking into account any relevant factors, whether the objectives of this Framework Agreement have been achieved and whether there is a need to amend this Framework Agreement and other agreements referred to in paragraph 1 of Article 1.3 (Scope and relationship to other agreements).

CHAPTER 2

FINAL PROVISIONS

Article 2.1

Making changes

 

      The Parties may agree in writing to amend this Framework Agreement. Such amendment shall enter into force in accordance with the procedure provided for in Article 2.2 (Entry into force).

Article 2.2

Entry into force

     This Framework Agreement shall enter into force on the first day of the second month following the date on which the Parties exchange written notifications on the completion by the Parties of their respective internal legal procedures necessary for the entry into force of this Framework Agreement. Such notifications are exchanged between the Eurasian Economic Commission and Singapore.

Article 2.3

Joining

     1. The accession of a new EAEU Member State to this Framework Agreement is the subject of negotiations between the EAEU, its member States, including this new Member State, and Singapore. Such accession is carried out by concluding an additional protocol to this Framework Agreement.

     2. The Eurasian Economic Commission shall immediately notify Singapore of the receipt by any third country of the candidate status for joining the EAEU, of the results of negotiations with the candidate country for joining the EAEU and the entry into force of any decision on joining the EAEU.

     3. During the negotiations between the EAEU and the candidate country applying to join the EAEU, the Eurasian Economic Commission strives to:

     (a) to provide, upon Singapore's request and to the extent possible, any information relevant to any matters within the scope of this Framework Agreement; and

     (b) take into account any concerns expressed.
