To ratify the Protocol on Amendments to the Treaty on the Eurasian Economic Union dated May 29, 2014 regarding the provision of financial assistance in the implementation by the member States of the Eurasian Economic Union of joint cooperation projects in industries, concluded in Moscow on May 25, 2023.

PROTOCOL on Amendments to the Treaty on the Eurasian Economic Union dated May 29, 2014 regarding the provision of financial assistance in the implementation by the member States of the Eurasian Economic Union of joint cooperation projects in industries

The member States of the Eurasian Economic Union, hereinafter referred to as the Member States,

guided by article 115 of the Treaty on the Eurasian Economic Union of May 29, 2014,

have agreed on the following:

Article 1

To make the following amendments to the Treaty on the Eurasian Economic Union dated May 29, 2014:

1) the first paragraph of paragraph 1 of Article 20 shall be worded as follows:

"1. The financing of the activities of the Union's bodies, as well as the provision by the Commission of financial assistance in the implementation by the Member States of joint cooperative projects in industries in accordance with the procedure provided for in Article 92 of this Treaty, shall be carried out at the expense of the Union budget. The procedure for the formation and expenditure of the Union's budget is determined by the Regulation on the Budget of the Eurasian Economic Union.";

2) subparagraph 1 of paragraph 9 of Article 92 should be supplemented with the words ", including through the implementation of joint cooperative projects in industries in accordance with Annex No. 27 to this Agreement";

3) The Protocol on Industrial Cooperation (Annex No. 27 to the said Agreement) should be supplemented with paragraph 3 as follows:

"3. In order to support the implementation by Member States of joint cooperative projects in industries, the list of which is determined by the Intergovernmental Council, the Council of the Commission may decide to provide financial assistance to their implementation from the Union budget.

The amount of funds provided in the budget of the Union for the next financial year for financial assistance in the implementation by the Member States of joint cooperative projects in industries is determined as a percentage of the total amount of revenues to the budgets of the Member States from special, anti-dumping and countervailing duties in the financial year preceding the year of approval of the budget of the Union.

The size of the specified percentage and the form of financial assistance provided in the implementation by the Member States of joint cooperative projects in industries are determined by the Supreme Council.

The procedure for the selection and implementation by the Member States of joint cooperative projects in industries, as well as the provision of financial assistance from the Union budget, is determined in accordance with the regulations approved by the Intergovernmental Council.

The financial assistance mechanism provided for in this paragraph shall be applied for 5 years from the date of entry into force of the Protocol on Amendments to the Treaty on the Eurasian Economic Union dated May 29, 2014 regarding the provision of financial assistance in the implementation by the member States of the Eurasian Economic Union of joint cooperation projects in industries, signed on May 25, 2023.

The decision on prolongation of the financial assistance mechanism is made by the Supreme Council.

In the event of termination of this mechanism, the Member States and the Commission are obliged to ensure the full fulfillment of financial obligations arising on the basis of decisions of the Council of the Commission on financial assistance to the implementation of joint cooperative projects in industries during the entire period of implementation of such projects.

This obligation remains in force despite the termination of the mechanism, until its full implementation.".

Article 2

This Protocol shall enter into force on the date of receipt by the depositary, through diplomatic channels, of the last written notification that the Member States have completed the internal procedures necessary for its entry into force.

Done in Moscow on May 25, 2023, in one original copy in the Russian language.

The original copy of this Protocol shall be kept in the Eurasian Economic Commission, which, as the depositary of this Protocol, will send a certified copy to each Member State.
