PROTOCOL ON THE MARKING OF ROADS TO THE EUROPEAN AGREEMENT SUPPLEMENTING THE CONVENTION ON ROAD SIGNS AND SIGNALS, OPENED FOR SIGNATURE IN VIENNA ON NOVEMBER 8, 1968, DONE IN GENEVA ON MARCH 1, 1973
PROTOCOL ON THE MARKING OF ROADS TO THE EUROPEAN AGREEMENT SUPPLEMENTING THE CONVENTION ON ROAD SIGNS AND SIGNALS, OPENED FOR SIGNATURE IN VIENNA ON NOVEMBER 8, 1968.
THE CONTRACTING PARTIES TO THE CONVENTION ON ROAD SIGNS AND SIGNALS, OPENED FOR SIGNATURE IN VIENNA ON NOVEMBER 8, 1968, AND THE EUROPEAN AGREEMENT SUPPLEMENTING THIS CONVENTION, OPENED FOR SIGNATURE IN GENEVA ON MAY 1, 1971, IN AN EFFORT to achieve greater unification in Europe of rules concerning road markings, HAVE AGREED as follows:
Article 1
The Contracting Parties to the Convention on Road Signs and Signals, opened for Signature in Vienna on November 8, 1968, and the European Agreement supplementing this Convention, opened for signature in Geneva on May 1, 1971, shall take appropriate measures to ensure that the road marking system in force in their territories complies with the provisions of the annex to this Protocol.
Article 2
1. This Protocol shall be open until March 1, 1974, for signature by States which have signed or acceded to the Convention on Road Signs and Signals, opened for signature in Vienna on November 8, 1968, and the European Agreement supplementing this Convention, opened for signature in Geneva on May 1, 1971, and which are either members of the European Commission. of the United Nations Economic Commission for Europe, or have been admitted to participate in the work of the Commission with consultative status in accordance with paragraph 8 of the terms of reference of the Commission. 2. This Protocol is subject to ratification after a State has ratified or acceded to the Convention on Road Signs and Signals, opened for signature in Vienna on November 8, 1968, and the European Agreement supplementing this Convention, opened for signature in Geneva on May 1, 1971. The instruments of ratification shall be deposited with the Secretary-General of the United Nations. 3. This Protocol remains open for accession by any of the States referred to in paragraph 1 of this Article that is a Party to the Convention on Road Signs and Signals, opened for signature in Vienna on November 8, 1968, and the European Agreement supplementing this Convention, opened for signature in Geneva on May 1, 1971. The instruments of accession shall be deposited with the Secretary-General.
Article 3
1. Each State may, at the time of signature or ratification of this Protocol or upon accession thereto, or at any time thereafter, declare by notification addressed to the Secretary-General that the Protocol becomes applicable to all or part of the Territories for whose foreign relations it is responsible. The Protocol shall begin to apply in the territory or territories indicated in the notification upon the expiration of thirty days from the date of receipt by the Secretary-General of the said notification or upon the entry into force of the Protocol in respect of the State that made the notification, if that date is later. 2. Any State that has made a declaration in accordance with paragraph 1 of this article may at any time thereafter declare by notification addressed to the Secretary-General that the Protocol will cease to apply in the territory indicated in the notification and the Protocol will cease to apply in the territory indicated one year after the date of receipt by the Secretary-General of this notification.
Article 4
1. This Protocol shall enter into force twelve months after the date of deposit of the tenth instrument of ratification or accession. 2. For each State that ratifies or accedes to this Protocol after the deposit of the tenth instrument of ratification or accession, the Protocol shall enter into force twelve months after the date of deposit by that State of its instrument of ratification or accession. 3. If the date of entry into force following paragraphs 1 and 2 of this article precedes the date following the application of article 39 of the Convention on Road Signs and Signals, opened for signature in Vienna on November 8, 1968, the Protocol shall enter into force on that last date in accordance with paragraph 1 of this article.
Article 5
From the moment of entry into force of this Protocol, it repeals and replaces, in relations between the Contracting Parties, the provisions concerning the Protocol on Road Signs and Signals contained in the European Agreement signed in Geneva on September 16, 1950, in addition to the 1949 Convention on Road Traffic and the 1949 Protocol on Road Signs and Signals, the Designation Agreement the European Agreement on Road Markings, signed in Geneva on December 16, 1955, and the European Agreement on Road Markings, signed in Geneva on December 13, 1957.
Article 6
1. Twelve months after the entry into force of this Protocol, each Contracting Party may propose one or more amendments to the Protocol. The text of any proposed amendment, together with an explanatory memorandum, shall be sent to the Secretary-General, who shall transmit it to all Contracting Parties. The Contracting Parties have the opportunity to notify him, within twelve months from the date of transmission of this text, of: (a) whether they accept the amendment.; (b) Whether they reject the amendment or (c) whether they wish a conference to be convened to consider the amendment. The Secretary-General shall also transmit the text of the proposed amendment to the other States referred to in article 2 of this Protocol. 2. (a) Any proposed amendment circulated in accordance with paragraph 1 of this article shall be deemed accepted if, within the twelve-month period referred to above, less than one third of the Contracting Parties inform the Secretary-General that they reject the amendment or wish to convene a conference to consider the amendment. The Secretary-General shall notify all Contracting Parties of each acceptance or rejection of a proposed amendment and of any request to convene a conference. If, within the prescribed twelve-month period, such rejections and requests are received from less than one third of all Contracting Parties, the Secretary-General shall inform all Contracting Parties that the amendment shall enter into force six months after the expiration of the twelve-month period specified in paragraph 1 of this Article for all Contracting Parties, with the exception of those that They rejected the amendment within the prescribed period or requested to convene a conference to discuss it. (b) Any Contracting Party that has rejected a proposed amendment or requested a conference to consider it within the above-mentioned period of twelve months may, at any time after the expiration of this period, notify the Secretary-General of its acceptance of the amendment, and the Secretary-General shall send this notification to all other Contracting Parties. The amendment shall enter into force in respect of the Contracting Party that has sent such notification of acceptance six months after the date of its receipt by the Secretary General. 3. If the proposed amendment has not been accepted in accordance with paragraph 2 of this article and if, within the twelve-month period provided for in paragraph 1 of this Article, less than half of the total number of Contracting Parties inform the Secretary-General that they reject the proposed amendment, and if at least one third of all Contracting Parties, but not less than five, inform him that they accept it or wish to convene a conference to discuss this amendment., The Secretary-General shall convene a conference to consider the proposed amendment or any other proposal that may be submitted to him in accordance with paragraph 4 of this article. 4. If a conference is convened in accordance with paragraph 3 of this article, the Secretary-General shall invite to it all the Contracting Parties and other States referred to in Article 2 of this Protocol. The Secretary-General shall request all States invited to the conference to submit to him, at least six months before the opening of the conference, any proposals that they may wish to consider at the conference in addition to the proposed amendment, and shall notify all those invited to the conference of these proposals at least three months before the opening of the conference. states. 5. (a) Any amendment to this Protocol shall be deemed accepted if it is adopted by a two-thirds majority of the States represented at the conference, provided that this majority includes at least two thirds of the Contracting Parties represented at the conference. The Secretary-General shall notify all Contracting Parties of the acceptance of the amendment, and it shall enter into force twelve months after the date of such notification in respect of all Contracting Parties, with the exception of those who have informed the Secretary-General of their rejection of the amendment within that period. (b) Any Contracting Party that has rejected an amendment within the above-mentioned twelve-month period may at any time notify the Secretary-General of its acceptance of the amendment, and the Secretary-General shall notify all other Contracting Parties accordingly. The amendment shall enter into force in respect of the Contracting Party that notified its acceptance six months after receipt of the notification by the Secretary General or after the expiration of the above-mentioned twelve-month period, if this period expires later. 6. If the proposed amendment is not considered accepted in accordance with paragraph 2 of this article and if the conditions for convening a conference prescribed in paragraph 3 of this article are not fulfilled, the proposed amendment shall be considered rejected. 7. Regardless of the amendment procedure provided for in paragraphs 1-6 of this Article, the annex to this Protocol may be amended by agreement between the competent authorities of all Contracting Parties. If the competent authority of one of the Contracting Parties declares that, according to national legislation, its consent depends on obtaining a special permit or on the approval of a legislative body, the consent of the competent authority of the said Contracting Party to amend the annex will be considered given only when that competent authority informs the Secretary General that the required authority or authorization has been received. An agreement between the competent authorities may provide that, during the transitional period, the old provisions of the annex remain in force in whole or in part at the same time as the new ones. The Secretary-General will set a date for the entry into force of the new regulations. 8. Each State, upon signing or ratifying this Protocol or acceding to it, shall inform the Secretary-General of the name and address of the competent authority authorized to give the consent provided for in paragraph 7 of this article.
Article 7
Each Contracting Party may denounce this Protocol by written notification addressed to the Secretary General. The denunciation shall take effect one year after the date of receipt by the Secretary-General of this notification. Each Contracting Party that ceases to be a Party to the Convention on Road Signs and Signals, opened for signature in Vienna on November 8, 1968, and the European Agreement supplementing this Convention, opened for signature in Geneva on May 1, 1971, shall cease to be a Party to this Protocol on the same day.
Article 8
This Protocol shall cease to be in force if the number of Contracting Parties for any period of twelve consecutive months is less than five, as well as from the moment when the Convention on Road Signs and Signals, opened for Signature in Vienna on November 8, 1968, or the European Agreement supplementing this Convention, opened for signature in Geneva, ceases to be in force. May 1, 1971.
Article 9
1. Any dispute between two or more Contracting Parties concerning the interpretation or application of this Protocol, which the disputing Parties are unable to resolve by negotiation or other means of settlement, shall be submitted to arbitration upon the application of one of the Contracting Parties between which the dispute arose; it shall be referred to one or more arbitrators elected by mutual agreement of the disputing Parties. If, within three months from the date of the referral of the case to arbitration, the disputing Parties do not reach an agreement on the choice of an arbitrator or arbitrators, either of these Parties may request the Secretary-General of the United Nations to appoint a single arbitrator to whom the dispute is referred for resolution. 2. The decision of the arbitrator or arbitrators appointed in accordance with paragraph 1 of this article shall be binding on the disputing Contracting Parties.
Article 10
Nothing in this Protocol shall be interpreted as preventing any of the Contracting Parties from taking measures consistent with the Charter of the United Nations and limited by the situation that it considers necessary to ensure its external and internal security.
Article 11
1. Each State may, at the time of signing this Protocol or when depositing its instrument of ratification or accession, declare that it does not consider itself bound by article 9 of this Protocol. The other Contracting Parties are not bound by Article 9 with respect to any Contracting Party that has made such a declaration. 2. Reservations to this Protocol, other than the reservation provided for in paragraph 1 of this article, are permitted provided they are submitted in writing and, if they are made before the deposit of the instrument of ratification or accession, provided they are confirmed in the instrument of ratification or accession. 3. Each State, when depositing its instrument of ratification or accession to this Protocol, shall notify the Secretary-General in writing of the extent to which reservations it has made to the Convention on Road Signs and Signals, opened for signature in Vienna on 8 November 1968, or to the European Agreement supplementing this Convention, opened for signature in Geneva on May 1, 1971, shall apply to this Protocol. Those reservations that are not notified at the time of the deposit of the instrument of ratification or accession to this Protocol will be deemed not to apply to this Protocol. 4. The Secretary-General shall communicate reservations and notifications made pursuant to this article to all States referred to in article 2 of this Protocol. 5. Any State that has made a declaration, reservation or notification in accordance with this article may at any time withdraw them by notification addressed to the Secretary-General. 6. Any reservation made in accordance with paragraph 2 or notified in accordance with paragraph 3 of this article, (a) modifies for the Contracting Party that has made or notified the above-mentioned reservation, within the framework of this reservation, the provisions of the Protocol to which it relates; (b) modifies to the same extent these provisions for other Contracting Parties in their respective relations with the Contracting Party that has made or notified the reservation.
Article 12
In addition to the declarations, notifications and notifications provided for in Articles 6 and 11 of this Protocol, the Secretary-General shall inform the Contracting Parties and other States referred to in Article 2 of: (a) signatures, ratifications and accessions in accordance with Article 2; (b) notifications and declarations in accordance with Article 3; (c) dates entry into force of this Protocol in accordance with Article 4; d) the date of entry into force of amendments to this Agreement in accordance with paragraphs 2, 5 and 7 of Article 6; (e) Denunciations in accordance with article 7; (f) The termination of this Protocol in accordance with article 8.
Article 13
After 1 March 1974, the original of this Protocol shall be deposited with the Secretary-General of the United Nations, who shall transmit duly certified copies to all States referred to in article 2 of this Protocol. Application
1. For the purposes of applying the provisions of this annex, "Convention" means the Convention on Road Signs and Signals, opened for signature in Vienna on 8 November 1968. 2. This annex contains only the additions and amendments made to the relevant provisions of the Convention. 3. To article 26 of the Convention, Paragraph 2, an additional paragraph should be inserted immediately after subparagraph (b) of this paragraph. This paragraph should read: "Double discontinuous lines may be used to indicate a lane or lanes in which the direction of traffic may alternately change in accordance with paragraph 11 of Article 23 of the Convention." Paragraph 4 Additional part of the sentence - insert at the end of this paragraph This part of the sentence should read: "... or which indicate the prohibition or restriction of stopping or parking." 4. To article 27 of the Convention, paragraph 1, Two parallel solid lines will not be used to mark a stop line. Point 3 Two discontinuous lines drawn side by side will not be used to indicate a line that vehicles should not normally cross when they are required to give way in accordance with sign B, 1 "Intersection with the main Road.".
Paragraph 5 This paragraph should read: "To mark crossings for cyclists, discontinuous lines consisting of squares or parallelograms should be used." 5. Additional paragraphs to article 28 of the Convention should be included immediately after paragraph 3 of this article. These paragraphs should read: "A solid line on the curb of the sidewalk or at the edge of the carriageway means that along the entire length of this line on the side of the carriageway where it is marked, stopping and parking are prohibited or subject to restrictions specified by other means. To Article 29 of the Convention, Paragraph 2, this paragraph should read: "The marking of the road must be white. The term "white" includes silver and light gray shades. However: - markings indicating places where parking is allowed or restricted may be blue; - zigzag lines indicating places where parking is prohibited must be yellow.; - a solid or broken line drawn on the curb of the sidewalk or at the edge of the carriageway to indicate the prohibition or restriction of stopping or parking should be yellow."Additional paragraphs - insert these paragraphs immediately after paragraph 2 of this article. These paragraphs should read: "If a yellow line is used to indicate the prohibition or restriction of stopping or parking, and if a white line already exists indicating the edge of the carriageway, the yellow line should be applied next to the white line on its outside. If it becomes necessary to temporarily cancel for a short period the traffic rules indicated by permanent markings, and if, as a result, the permanent markings are replaced by other markings, then all temporary road markings must differ in color from the color usually used to mark traffic or to prohibit or restrict stopping or parking. It is preferable to use film or plastic to make the temporary marking of roads more visible." 7. Annex 8 to the Convention (Road markings) - Chapter II (Longitudinal markings) (Diagram A1) A. Dimensions Paragraph 2 This paragraph should read: "It is recommended that the width of the continuous and discontinuous lines in the longitudinal marking be at least 0.1 m (4 inches) and that the width of the discontinuous line used to separate the through lane from the acceleration lane, deceleration lane or combination of acceleration lane and deceleration lane be at least twice wider than the usual broken line." Paragraph 5 This paragraph should read: "(a) An intermittent line used to separate the direction of traffic flows in accordance with the provisions of paragraph 2 (a) (1) of article 26 of the Convention, It must consist of lines at least 1 m (3 ft 4 in) long. It is recommended that the length of the gaps should generally exceed two to four times the length of the lines and that the length of the gaps should not exceed 12 m (40 ft). (b) It is recommended that the length of the lines of the broken line used for the warning in accordance with paragraph 2 (a) (11) of article 26 of the Convention be two to four times the length of the gaps." Paragraph 6 This paragraph should read: "It is recommended that the length of the solid line be at least 20 m (65 ft)." V. Paragraph 8, first sentence This sentence should read: "It is recommended that on two-way roads with two lanes, the centerline of the carriageway is indicated by longitudinal markings (Diagram A2)." Paragraph 9 This paragraph should read: "On two-way roads with three lanes, the lanes should, as a rule, be indicated with broken lines (Diagram A-3). One or two solid lines or one broken line drawn next to a solid line should be used only in special cases. A double solid line can be used when approaching road breaks, intersections, and railroad crossings, as well as in places where visibility is limited." Paragraph 10 This paragraph should read: "On two-way roads with more than three lanes, it is recommended to use one solid line to separate both directions of traffic. However, when approaching railway crossings and in other special cases, two solid lines may be used. Traffic lanes are indicated by broken lines (Diagram A-4). If a single solid line is used, it should be wider than the lines dividing the lanes used on the same road section." Paragraph 11 This paragraph should read: "If an additional paragraph inserted after paragraph (b) of paragraph 2 of Article 26 of the Convention is applied, each edge of the lane or lanes of traffic on which the direction of traffic may alternately change may be indicated by a double intermittent warning line used in accordance with paragraph (a). 11) Paragraph 2 of Article 26 of the Convention (diagrams A-5 and A-6)." Designation of special cases Paragraph 14 The words "diagram 4" and "diagrams 5 and 6" should be replaced by the words "Diagram A-33". Paragraph 15 This paragraph should read: "Visibility distance" means the distance at which an object of a certain height placed on the carriageway can be seen by an observer located on the carriageway, whose eye is located at the same height or below 1/. To avoid this, the markings in diagram A-13 (c) may be used. Diagram A-14 provides an example of marking changes in the lateral slope of the road. The markup does not change regardless of whether AB and CD overlap each other or not. When combining a turn in a road with a significant slope, the same principles can be adopted. If there are turns on flat terrain, two lanes can be set aside for vehicles moving along the outside of the bend, as this movement provides better visibility during overtaking.
A-14 provides an example of marking changes in the transverse slope of the road. The markup does not change regardless of whether AB and CD overlap each other or not. When combining a turn in a road with a significant slope, the same principles can be adopted. If there are turns on flat terrain, two lanes can be set aside for vehicles moving along the outside of the bend, as this movement provides better visibility during overtaking. Diagram A-19 provides an example of such a markup, which does not change regardless of whether AB and CD overlap each other or not." Paragraphs 19-21 of the provisions of these paragraphs will not apply. Paragraph 22, first sentence This sentence should read: "In diagrams A-20 and A-21, which give an example of markings when changing the width of the carriageway, as well as in diagram A-22, which indicates an obstacle or the beginning of a central reserve zone requiring a deviation of the solid line(s), this slope The line or lines should be preferably 1/50 or less on roads with high speed, 1/20 or less on roads where the speed does not exceed 60 km (37 miles) per hour." The recommended length of the lines and gaps is 0.5 m (1 ft 8 in) (Diagrams A-28 and A-29). The guide lines shown in Diagram A-29 (a) can be supplemented with arrows. The arrows shown in diagram A-29 (b) can be supplemented with guide lines." 8. To Annex 8 to the Convention (Marking of roads) - Chapter III (Transverse marking) B. It is recommended that the bases of these triangles be at least 0.4 m (16 inches), but not more than 0.6 m (24 inches), and their height is not less than 0.6 m (24 inches), but not more than 0.7 m (28 inches) (diagram A-34 (b))." Paragraph 35 This paragraph should read: "The markings specified in paragraph 34 may be supplemented by a triangle, which is applied to the carriageway and an example of which is given in diagrams A-34 and A-35." D Pedestrian crossings Paragraph 37 This paragraph should read: "It is recommended that the distance between the lanes that mark the pedestrian crossing be at least equal to and not more than twice the width of these lanes; and that the total width of one lane and the gap between the lanes be 0.8 m (2 ft 8 in) to 1.4 m (4 Ft 8 in). The recommended minimum width for pedestrian crossings should be 2.5 m (8 ft) on roads where the speed limit is 60 km/h (37 mph) or less (Figure A-36). On other roads, the minimum width of pedestrian crosswalks is 4 m (13 ft). For safety reasons, it is recommended to equip crosswalks on such roads with traffic lights." E. Crossings for cyclists Paragraph 38 This paragraph should read: "It is preferable to mark crossings for cyclists with double discontinuous lines consisting primarily of squares (0.40-0.60) x (0.40-0.60) m [(16-24) x (16-24) inches] separated by spaces equal to the side of the square. The crossing width should preferably be at least 1.8 m (6 ft) for a bike lane with traffic in one direction and at least 3 m (9 ft 9 in) for a bike lane with traffic in both directions. At crossings that are not at right angles, squares can be replaced by parallelograms, the sides of which are respectively parallel to the axis of the road and the axis of the bike path (Diagram 1-37). The use of tiles or buttons is not recommended. Diagram A-38 shows an example of an intersection where the bike path is part of the main road." 9. Annex 8 to the Convention (Road markings) - Chapter IV (Other types of markings) A. Pointing arrows Paragraph 39 This paragraph should read: "On roads with a sufficient number of lanes to allow vehicles to change lanes when approaching an intersection, the lanes to be used may be indicated using pointing arrows applied to the surface of the carriageway (Diagrams A-39 - A-41). Pointing arrows can also be used on one-way roads to confirm the direction of travel. It is recommended that these pointing arrows be at least 2 m (6 ft 7 in) long. The designation of the pointing arrows can be supplemented with inscriptions on the carriageway." B. Parallel oblique lines Paragraph 40 This paragraph should read: "It is recommended that parallel oblique lines have a slope indicating a deviation of movement away from the marking. Chevron markings, tilted in a similar way to deflect traffic away from a dangerous point, can be used in places where traffic branches and merges (Diagram A-42). Diagram A-42 (a) shows an example of a zone where vehicles are prohibited from entering from a solid line and which they can enter from an intermittent line only if they are careful. Diagram A-21 shows an example of marking areas where vehicles are completely prohibited from entering."C. Inscriptions Paragraph 42 This paragraph should read: "It is recommended that the letters and numbers be significantly elongated in the direction of travel, due to the very small angle of view from which the inscriptions are visible to drivers. In cases where the approach speed does not exceed 60 km (37 miles) per hour, the minimum length of letters and numbers should preferably be 1.6 m (5 ft 4 in) (Diagrams A-43 - A-48). In cases where the speed of approach exceeds 60 km/h, the minimum length of letters and numbers should preferably be 2.5 m (8 ft). Diagrams A-49 - A-54 provide examples of letters and numbers 4 m long."Paragraph 43 of this paragraph does not apply. E. Marking on the carriageway and adjacent structures i) Markings indicating the places where parking of vehicles is restricted Paragraph 45 This paragraph should read: "Diagrams A-55 and A-56 provide examples of markings indicating the prohibition of parking." ii) Designations on objects representing an obstacle Paragraph 46 This paragraph should read: "Diagram A-57 provides an example of markings on an object representing an obstacle. It is recommended to use black and white or yellow alternating stripes to apply this marking."
