PROTOCOL on the status of the Customs Statistics Center Commission of the Customs Union (Bulletin of International Treaties of the Republic of Kazakhstan, 2010, No. 5, Article 38) (Entered into force on July 1, 2010)

The Government of the Republic of Belarus, the Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as the Parties,

in order to implement the Agreement on the Maintenance of Customs Statistics on Foreign and Mutual Trade in Goods of the Customs Union dated January 25, 2008,

have agreed on the following:

Article 1

The Center for Customs Statistics of the Customs Union Commission (hereinafter referred to as the Center) is established for the purpose of maintaining statistics of foreign trade and statistics of mutual trade of the States of the Parties, coordinating statistical activities of authorized bodies of the Parties, facilitating information exchange and developing general recommendations in this area.

The Center is a structural unit of the Secretariat of the Customs Union Commission (hereinafter referred to as the Secretariat) and performs its functions as a Department of the Secretariat.

In its activities, the Center is guided by the Agreement on the Customs Union Commission of October 6, 2007, the Agreement on the Secretariat of the Customs Union Commission of December 12, 2008, other international documents adopted within the framework of the Customs Union, as well as this Protocol.

The Center carries out its activities in close cooperation with the authorized bodies of the States of the Parties.

Article 2

The main functions of the Center are:

ensuring full and reliable accounting of statistical data of the States of the Parties on foreign and mutual trade in goods;

formation of a system of indicators of foreign trade statistics and statistics of mutual trade of the states of the Parties;

publication, publication and transmission to the state bodies of the states of the Parties of statistical and informational materials on foreign and mutual trade of the Customs Union in accordance with the program of statistical work of the Center, approved by the Commission;

submission of data on foreign trade statistics and statistics on mutual trade of the Customs Union at the request of the state bodies of the Parties;

preparation of information and analytical materials on foreign and mutual trade, dynamics and trends of economic cooperation within the member States of the Customs Union and in trade with third countries;

development of a unified methodology for maintaining customs statistics of foreign trade and statistics of mutual trade, ensuring comparability of data and based on international rules and standards;

formation of a single information and statistical space within the Customs Union;

interaction with the authorized bodies of the Parties on the organization of personnel training, seminars and other events related to the development of foreign trade statistics and statistics of mutual trade;

implementation of international statistical cooperation, participation in the work of international statistical organizations;

promoting the introduction of advanced information technologies in the statistics of foreign and mutual trade;

maintaining unified classifiers used in the formation of foreign trade statistics and statistics of mutual trade.

Article 3

The Center has the right to perform the functions assigned to it.:

to receive, free of charge, from the authorized bodies of the States of the Parties statistical information necessary to create a common database of foreign and mutual trade statistics of the States of the Parties.;

create your own databases;

to give opinions on behalf of the Commission of the Customs Union within its competence on draft regulations and other legal acts of the Customs Union.;

submit proposals to the Customs Union Commission on the exchange of statistical information with countries outside the Customs Union.;

submit proposals to the Customs Union Commission on the establishment of working groups and meetings on issues related to its jurisdiction.;

submit proposals on statistical accounting issues to the Customs Union Commission for consideration;

submit proposals to the Customs Union Commission for consideration on improving the unified methodology for conducting foreign trade statistics and statistics on mutual trade;

to make decisions on other issues referred to its competence by the Customs Union Commission.

Article 4

Disputes between the Parties related to the interpretation and/or application of the provisions of this Protocol are resolved primarily through consultations and negotiations.

If the dispute is not resolved by the parties to the dispute through consultations and negotiations within six months from the date of the official written request for their holding sent by one of the parties to the dispute to the other party to the dispute, then, in the absence of any other agreement between the parties to the dispute regarding the method of its resolution, either party to the dispute may refer this dispute for consideration to the Court of the Eurasian Economic Community. the economic community.

Article 5

By agreement of the Parties, amendments may be made to this Protocol, which are formalized in separate protocols.

Article 6

The procedure for entry into force, accession to and withdrawal from this Protocol is determined by the Protocol on the Procedure for Entry into Force of International Treaties aimed at Forming the Legal Framework of the Customs Union, withdrawal from and Accession to them dated October 6, 2007.

Done in St. Petersburg on December 11, 2009, in one original copy in the Russian language.

The original copy of this Agreement shall be kept at the Customs Union Commission, which, as the depositary of this Agreement, will send a certified copy to each Party.
