On the ratification of the Second Protocol on Amendments to the Agreement on the Legal Status of the Collective Security Treaty Organization of October 7, 2002

To ratify the Second Protocol on Amendments to the Agreement on the Legal Status of the Collective Security Treaty Organization dated October 7, 2002, signed in Astana on November 8, 2018.

The SECOND PROTOCOL on Amendments to the Agreement on the Legal Status of the Collective Security Treaty Organization of October 7, 2002

The member States of the Collective Security Treaty Organization, hereinafter referred to as the Parties,
Striving to increase the effectiveness of the Collective Security Treaty Organization,
Realizing the importance of providing the necessary conditions for the activities of the permanent working bodies of the Organization,
Having regard to the Vienna Convention on Diplomatic Relations of April 18, 1961,
Based on the Charter of the Collective Security Treaty Organization of October 7, 2002,
in accordance with article 49 of the Agreement on the Legal Status of the Collective Security Treaty Organization dated October 7, 2002 (hereinafter referred to as the Agreement)
We have agreed on the following:
1. Make the following changes to the Agreement:
1.1. In Article 1:
a) paragraphs seven and eight should be worded as follows, respectively:
"representatives of the Member States" — representatives of the Member States of the Organization, including heads and members of delegations participating in events held within the Organization, with the exception of Permanent and Plenipotentiary Representatives of the Member States to the Organization.;
"Permanent and Plenipotentiary Representative to the Organization" (hereinafter referred to as the Permanent Representative) is a representative appointed by a Member State of the Organization in accordance with its national legislation, endowed by the sending State with the necessary powers to work on issues of the Organization and to serve on the Permanent Council established in accordance with Chapter IV of the Charter of the Organization;";
b) add the eighteenth paragraph as follows:
"Deputy Secretary General - the deputy highest administrative official of the Organization, an official from among persons approved in accordance with the established procedure in accordance with the quotas assigned to each Member State for positions in the Secretariat, the list of which is determined by the Council;";
c) paragraphs eighteen through twenty-one are considered paragraphs nineteen through twenty-two, respectively;
d) replace the words "Envoy" with the words "Permanent Representative" in the appropriate numbers and cases;
1.2. To formulate Article 11 as follows:
"Article 11
The Secretary General, the Deputy Secretaries General, and members of their families residing with them, if they are not nationals of the receiving State, shall enjoy privileges and immunities to the extent provided for in the Vienna Convention on Diplomatic Relations of April 18, 1961 for a diplomatic agent and members of his family.";
1.3. After the words "employees of the Organization", add the words "(with the exception of those specified in Article 11 of this Agreement)" to Article 21.;
1.4. In articles 23, 24, 27-33, the words "Envoy" should be replaced by the words "Permanent Representative" in the appropriate numbers and cases.
2. Disputes related to the application or interpretation of this Protocol shall be resolved through consultations and negotiations between the Parties concerned.
3. This Protocol shall enter into force in accordance with the procedure provided for in Article 46 of the Agreement. Each Party may declare the provisional application of this Protocol by notifying the depositary in writing.
Done in Astana on November 8, 2018, in one original copy in Russian. The original copy is kept at the Secretariat of the Collective Security Treaty Organization, which will send a certified copy to each signatory State of this Protocol.
