STRATEGIC PARTNERSHIP AGREEMENT BETWEEN THE REPUBLIC OF KAZAKHSTAN AND THE TURKISH REPUBLIC (Entered into force on October 9, 2011 - Bulletin of International Treaties of the Republic of Kazakhstan 2011, No. 5, Article 76)
The Republic of Kazakhstan and the Republic of Turkey, hereinafter referred to as the Parties, reaffirming their commitment to the purposes and principles of the Charter of the United Nations, other generally recognized principles and norms of international law related to the maintenance of peace, security and the development of friendly relations, Reaffirming its commitment The Treaty of Friendship and Cooperation between the Republic of Kazakhstan and the Republic of Turkey dated October 17, 1994, and considering it as an unshakable legal basis for the current and subsequent development and deepening of comprehensive ties and interaction between the two States and their peoples, sharing global values and ideals on a bilateral, regional and global scale, expressing confidence that cooperation on addressing the challenges of the 21st century, as well as countering emerging threats, will make it possible to contribute to the cause of peace, stability and prosperity in the region and throughout the world, bearing in mind that the Eurasian space, on which the two states are located, plays a key role in terms of the future of all mankind, including ensuring global peace, stability and prosperity, the development of human rights, democracy and fundamental freedoms, economic development and ensuring the security of energy resources and their supply corridors, the further development of dialogue and tolerance between civilizations, as well as the availability of opportunities for comprehensive cooperation in the region, Expressing confidence that the development of cooperation between the Turkic-speaking states, which play the role of a kind of bridge between Europe and Asia, linked by common roots, language, culture and history, will serve for the benefit of the fraternal states and the entire region, as well as supporting the work carried out in this direction, considering it necessary to deepen economic cooperation between the two states by creating favorable conditions to expand trade and investment, emphasizing, That cooperation between the two states in the energy sector is of strategic importance for ensuring energy security, in order to carry out joint and coordinated activities in all areas of mutual interest, primarily in the political, economic, defense, cultural, scientific, technical, educational, environmental, information and healthcare fields, and the need to bring existing relations to the the level of comprehensive strategic partnership within the framework of a common vision, agreed on the following:
Article 1
The parties build their relations on the basis of equality, mutual trust, strategic partnership and comprehensive cooperation.
Article 2
The parties, identifying the political, economic, defense, cultural, scientific and educational spheres as priority areas of cooperation, develop consultative mechanisms on all issues of interaction, including through the organization of regular visits. The parties are developing a bilateral political dialogue with the aim of establishing in-depth cooperation on topical international issues and defining a range of common interests.
Article 3
The parties are deepening existing cooperation on a bilateral, regional and international basis in order to strengthen peace, stability and security in the Eurasian region and around the world, as well as the prosperity of the peoples of the region, and jointly support the peaceful settlement of conflicts. In case of risks of an external threat to the territorial integrity of the Parties, consultations are held at the request of one of the Parties. The parties contribute to strengthening the peacekeeping role of the United Nations and the Organization for Security and Co-operation in Europe (OSCE), and also make joint efforts to improve the effectiveness of mechanisms for resolving regional conflicts.
Article 4
The parties are expanding cooperation and contacts within the framework of international organizations to which they are also members. In order to further strengthen the role of the OSCE and the Conference on Interaction and Confidence-building Measures in Asia in maintaining security, stability and cooperation in the Eurasian space, the parties promote the organization of regular meetings and the development of common positions.
Article 5
The parties assist each other in joining international and regional organizations, provide mutual support in nominating candidates for these organizations, and consult in order to contribute to the activities of these organizations and determine joint positions on issues on the agenda.
Article 6
The parties are cooperating on the further integration of the Turkic-speaking states. The parties provide all necessary support for the successful functioning of the Cooperation Council of Turkic-speaking States, as well as improving the effectiveness of the Parliamentary Assembly of Turkic-speaking States and TURKSOY.
Article 7
In order to develop interfaith and intercultural understanding, respect and tolerance, the Parties provide all possible support to existing initiatives, primarily those within the framework of the Alliance of Civilizations and the Congress of Leaders of World and Traditional Religions, and also take joint measures to achieve concrete results in regional and international organizations.
Article 8
The parties are strengthening bilateral cooperation in the field of improving legislation and the implementation of international human rights treaties.
Article 9
The Parties cooperate on a bilateral, regional and international basis on the non-proliferation of weapons of mass destruction, combating terrorism, smuggling, drug trafficking and arms trafficking, transnational organized crime, including illegal migration and human trafficking, which pose a serious threat to peace and international security.
Article 10
The Parties shall make efforts to expand and deepen mutual trade and economic cooperation and, in accordance with their national laws and the terms of international treaties to which they are parties, create the necessary favorable conditions for this. The Parties encourage the regular holding of trade, economic and financial forums in the Republic of Kazakhstan and the Republic of Turkey.
Article 11
The parties are working together to create new transport corridors between Europe and Asia passing through their territories, which are a prerequisite for the development of international trade, and also strengthen cooperation in the field of international road transport.
Article 12
The parties cooperate in the defense and military-technical fields.
Article 13
The parties are expanding economic cooperation in the field of energy. The parties carry out joint cooperation in the issues of diversifying the energy corridors to which they are participants and increasing mutual investments in the energy sector. The Parties encourage the transfer of technologies in the field of energy conservation, environmentally friendly fuels and renewable energy sources.
Article 14
The Parties are developing cooperation in the banking, financial and tax spheres through the conclusion of relevant agreements, exchange of experience and information between the relevant authorities of the Parties.
Article 15
The parties cooperate in the transport, telecommunications and information fields, as well as in the field of civil aviation.
Article 16
The parties are developing cooperation in the fields of science and technology, healthcare, education and culture, ecology, tourism and sports. To this end, the Parties are strengthening their joint work to establish cooperation at all levels, including between the relevant authorities of the Parties.
Article 17
The parties are expanding joint work at the bilateral and regional levels in order to create interstate scientific institutions in the fields of economics, information technology, innovation, and education, including the Turkic Academy, whose activities will be aimed at researching the history and culture of the Turkic-speaking states, preserving the common historical heritage and familiarizing the world community with the cultural heritage of the Turks.
Article 18
The Parties are developing action plans for the development of cooperation in the areas mentioned in the above articles, which will be determined by mutual agreement of the Parties.
Article 19
The financing of activities carried out under this Agreement is carried out in accordance with the national legislation of the Parties.
Article 20
Disputes and disagreements that may arise in the interpretation of the provisions of this Agreement shall be resolved by the Parties through negotiations and consultations.
Article 21
The Parties may make amendments and additions to this Agreement, which are formalized in separate protocols and enter into force in accordance with Article 22 of this Agreement.
Article 22
This Agreement shall enter into force two months after the date of receipt, through diplomatic channels, of the last of the written notifications from the Parties on the completion of the internal procedures necessary for its entry into force.
This Agreement is concluded for an indefinite period.
Done in Ankara on October 22, 2009, in two copies each in the Kazakh, Turkish and English languages, all texts being equally authentic. In case of disagreement in the interpretation of the provisions of this agreement, the Parties shall refer to the English text.
