      To ratify the Supplementary Agreement to the Agreement between the Republic of Kazakhstan and the Holy See on Mutual Relations dated September 24, 1998, signed in Nur-Sultan on September 14, 2022.

Supplementary Agreement to the Agreement between the Republic of Kazakhstan and the Holy See on Mutual Relations dated September 24, 1998  

      The Republic of Kazakhstan and the Holy See, hereinafter referred to as the Parties,  

      Having regard to article 14 of the Agreement between the Republic of Kazakhstan and the Holy See on Mutual Relations of September 24, 1998, hereinafter referred to as the "1998 Agreement",  

     Striving for the full implementation of article 2 of the aforementioned 1998 Agreement,

     have agreed on the following:

     1. For the purposes of this Supplementary Agreement:

      a) "members of the Catholic Church from abroad" means every archbishop, bishop, apostolic administrator, priest, member of the Institute of Consecrated Life or the Society of Apostolic Life, duly authorized layman without Kazakh citizenship, cooperating in the pastoral, cultural and charitable activities of any of the subjects of the Catholic Church registered in The Republic of Kazakhstan in accordance with articles 3 and 4 of the 1998 Agreement;

      b) "subjects of the Catholic Church" means all legal entities registered in the Republic of Kazakhstan in accordance with articles 3 and 4 of the 1998 Agreement, including, but not limited to: Archdioceses, Dioceses, Prelatures, Exarchates, Apostolic Administrations, Prefectures, Special Missions, parishes, monastic communities (monasteries), institutes monastic life, societies of apostolic life, associations, seminaries, colleges, schools and other religious, educational, socio-cultural institutions;

      (c) "Competent authorities of the Catholic Church" means the archbishops, bishops, apostolic administrators, prelates, exarchs and other equivalent clergy who head the entities of the Catholic Church in the territory of the Republic of Kazakhstan.  

      2. The competent state bodies of the Republic of Kazakhstan, in accordance with the legislation of the Republic of Kazakhstan, issue permanent residence permits to members of the Catholic Church from abroad who are appointed to serve for a long time in any of the subjects of the Catholic Church.  

      3. In order to obtain a permanent residence permit for members of the Catholic Church from abroad who are appointed to serve for a long time in any of the subjects of the Catholic Church, it is necessary to comply with the requirements of the legislation of the Republic of Kazakhstan, with the exception of confirmation of solvency and place of residence, which will be replaced by written obligations of the competent authority of the Catholic Church.  

     4. The competent authorities of the Catholic Church in the Republic of Kazakhstan shall notify the competent state authorities of the Republic of Kazakhstan of the termination of the ministry of a member of the Catholic Church from abroad in the Republic of Kazakhstan within ten calendar days. Such notification will be the basis for revocation of the permanent residence permit in the Republic of Kazakhstan.

      5. This Supplementary Agreement is concluded for a period of five years, after which it is automatically extended for similar periods, unless one of the Parties sends a written notification to the other Party through diplomatic channels of its intention to terminate it. In this case, this Supplementary Agreement shall terminate six months after the date of receipt of the relevant notification, which will not affect the completion of the relevant procedures, unless otherwise decided by mutual agreement of the Parties.  

     6. In exceptional cases, in order to ensure national security, public order or public health, the Republic of Kazakhstan has the right to temporarily, partially or completely suspend the operation of this Supplementary Agreement by sending a written notification to the Holy See through diplomatic channels. In this case, the validity of this Supplementary Agreement is suspended upon the expiration of 30 (thirty) calendar days from the date of receipt of such notification.

     The suspension of this Supplementary Agreement in accordance with the first paragraph of this paragraph does not affect the rights of members of the Catholic Church from abroad who have been appointed to serve for a long time and are in the territory of the Republic of Kazakhstan at the time of suspension.

     7. Amendments and additions may be made to this Supplementary Agreement by mutual agreement of the Parties.

     8. This Supplementary Agreement shall enter into force on the date of receipt, through diplomatic channels, of the last written notification that the Parties have completed the internal procedures necessary for its entry into force.

     Done in the city of Nur-Sultan on September 14, 2022, in two copies, each in the Kazakh, Russian and English languages, all texts being equally authentic.

      In case of disagreement in the interpretation of the provisions of this Supplementary Agreement, the Parties will be guided by the English text.
