The Government of the Republic of Kazakhstan DECIDES:
1. To approve the attached draft Agreement on the Service that enables the search for information about industrial property objects protected in the member states of the Eurasian Economic Union.
2. Authorize Deputy Prime Minister – Minister of National Economy of the Republic of Kazakhstan Serik Makashevich Zhumangarin to sign, on behalf of the Government of the Republic of Kazakhstan, an Agreement on a service that enables the search for information about industrial property objects protected in the member states of the Eurasian Economic Union, allowing for amendments and additions that are not of a fundamental nature.
3. This resolution shall enter into force on the date of its signing.

Agreement on a service that enables the search for information about industrial property objects protected in the member states of the Eurasian Economic Union
The member states of the Eurasian Economic Union, hereinafter referred to as the member states,
based on the provisions of the Treaty on the Eurasian Economic Union dated May 29, 2014,
taking into account the importance of strengthening mutually beneficial and equitable cooperation in the field of intellectual property,
in order to ensure universal access to information about industrial property objects protected in the member states,
have agreed as follows:
Article 1
1. This Agreement governs the relations arising from the creation and operation of a service that enables the search for information about industrial property objects protected in the member states (hereinafter referred to as the search service).
The industrial property objects protected in the member states, the search for information about which is carried out using a search service, include trademarks, service marks, geographical indications, and appellations of origin.
2. For the purposes of this Agreement, the following terms are used to mean the following:
“information exchange” – the transfer and receipt of information about objects of industrial property protected in the member states (including publicly available personal data), except for information that, in accordance with the legislation of the member states, is classified as information of limited distribution, carried out between the authorized bodies and the Eurasian Economic Commission;
“publicly available personal data” – the surname, first name and patronymic (if any) of an individual, the country code and the mailing address, which have become available (disseminated) in accordance with the legislation of the member states.
“authorized body” – a state authority or an organization of a member state authorized, in accordance with the legislation of the member state, to carry out information exchange.
Other terms used in this Agreement shall have the meanings defined by the Treaty on the Eurasian Economic Union dated May 29, 2014, and by international treaties within the framework of the Eurasian Economic Union (hereinafter referred to as the Union).
Article 2
1. The creation and operation of the search service shall be carried out by the Eurasian Economic Commission (hereinafter referred to as the Commission).
The search service is hosted by the Commission on the Union’s information portal.
2. To ensure the operation of the search service, information exchange is carried out on a regular basis through the use of the Union’s integrated information system.
3. As part of the information exchange, the Commission ensures the creation of a common information resource containing data on industrial property objects protected in the member states.
4. Information about industrial property objects protected in the member states is searched by submitting a request to the search service (hereinafter referred to as a search query).
5. Upon receiving a search query, the search service processes it and generates a search results page on the Union’s information portal (hereinafter referred to as the search output).
6. The search service is publicly available. Searching for and providing information about industrial property objects protected in the member states using the search service is carried out free of charge.
Article 3
1. When transmitting information in encoded form as part of the information exchange, reference books and classifiers are used that are part of the resources of the Union's unified system of normative reference information (hereinafter referred to as reference books and classifiers).
2. Technical requirements for information exchange (including, but not limited to, the procedure for transmitting and receiving messages (search queries), the composition of the reference books used, and the classification
