The production of the Zhitikarinsky district Court of the Kostanay region is a civil case on the claim of N.Z.H. to IP ".." represented by Director B.D.T. for damages under a contract for the provision of paid services. During the consideration of the above case, Sabit Davletovich Nigmetov represented my interests on the basis of a contract for the provision of legal assistance on a reimbursable basis. I paid 20,000 tenge to the representative for representing my interests at the court session. According to clause 8 of Article 108 of the CPC RK, court costs include the costs of paying for the assistance of a representative. According to art . 109 CPC RK: - the court awards to the party in whose favor the decision was made, on the other hand, all court costs incurred in the case...; - the court has the right to attribute all court costs in the case to a person who abuses procedural rights or fails to perform procedural duties, including in the case of presenting evidence in violation of the time limit set by the court and the procedure for presenting evidence established by this Code without valid reasons, if this has led to a delay in the trial, hindering the consideration of the case and the adoption of a lawful and reasonable a judicial act.

113 of the Civil Procedure Code of the Republic of Kazakhstan: At the request of the party in whose favor the decision was made, the court awards, on the other hand, the costs incurred by her to pay for the assistance of a representative (several representatives) who participated in the process and is not in an employment relationship with this party, in the amount of the costs actually incurred by the party... Based on the above, I ask the court to recover from the Sole proprietor "..." in the person of Director B.D.T. in my favor the costs of paying for the assistance of a representative in the amount of 20,000 tenge.
