The Department of the Anti–Corruption Agency of the Republic of Kazakhstan (Anti-Corruption Service) in Almaty is conducting a criminal case against B.J.N., suspected of committing a criminal offense under Articles 28, Part 4, Article 367, Part 4 of the Criminal Code of the Republic of Kazakhstan, registered in the Unified Register of Pre-Trial Investigations for No. 230000131000088.
The suspect B.J.N. pleads not guilty to the criminal offense he is charged with.
In this regard, the defense has grounds for conducting a confrontation between the suspect B.J.N. and the witness K.I.M. pointing to him in order to eliminate contradictions in their testimony.
According to part 1 of Article 24 of the Criminal Procedure Code of the Republic of Kazakhstan, the court, the prosecutor, the investigator, the inquirer are obliged to take all measures provided by law for a comprehensive, complete and objective investigation of the circumstances necessary and sufficient for the proper resolution of the case.
According to part 5 of Article 24 of the Criminal Procedure Code of the Republic of Kazakhstan, the body conducting the criminal process must verify all statements of innocence or lesser degree of guilt, as well as the availability of evidence justifying the suspect, accused, defendant or mitigating their responsibility, as well as the use of illegal investigative methods in the collection and consolidation of evidence.
According to part 1 of article 15 of the Criminal Procedure Code of the Republic of Kazakhstan, the body conducting criminal proceedings is obliged to protect the rights and freedoms of citizens participating in criminal proceedings, create conditions for their implementation, and take timely measures to meet the legitimate demands of participants in criminal proceedings.
According to part 1 of Article 99 of the Criminal Procedure Code of the Republic of Kazakhstan, participants in criminal proceedings have the right to apply to the person conducting the pre-trial investigation, the prosecutor, the judge (to the court) with petitions for procedural actions or procedural decisions to establish the circumstances relevant during the criminal process, ensuring the rights and legitimate interests of the person who filed the by petition, or by the person they represent.
In accordance with article 70 of the Criminal Procedure Code of the Republic of Kazakhstan, the defender is obliged to use all legal means and methods of defense in order to identify circumstances that refute suspicion, accusation or mitigate the responsibility of the suspect, the accused, and provide them with the necessary qualified legal assistance. The defender has the right to file petitions.
