THE PETITION
about the pardon
On July 20, 2017, the Bostandyk Court of Almaty sentenced me to 16 (years) under Article 99, part 2, paragraphs "d", "I" of the Criminal Code of the Republic of Kazakhstan years of serving a sentence in a maximum-security penal colony. On July 29, 2017, I filed an appeal with the city court against the court's decision. On August 20, 2017, this verdict was upheld by the Almaty City Court. I am serving my sentence in the maximum security penal colony LA-155/2 of the Ministry of Internal Affairs in the Almaty region of the village. Zarechensk. In July 2019, while on duty at the canteen, he accidentally slipped and fell to the floor and injured his spine. After the examination, I was diagnosed with the 1st (first) disability group. According to the VTEC certificate, the certificate is indefinite and disability is established for life.
Before my illness, I took an active part in the creative circles of the institution and received encouragement. Due to the fact that it is very difficult for me to serve my sentence for health reasons, I constantly need the supervision of highly specialized doctors, since my state of health wants the best, having served more than 10 (ten) years, I decided to appeal to the President of the Republic of Kazakhstan for pardon, according to the Constitution of the Republic of Kazakhstan in accordance with the Regulations on the Presidential Pardon Commission Of the Republic of Kazakhstan, approved by Decree of the President of the Republic of Kazakhstan dated July 5, 2006 No. 140. In accordance with paragraph 15 of the Constitution of the Republic of Kazakhstan, the President of the Republic of Kazakhstan grants pardons to citizens In accordance with paragraph 3 of the Criminal Code of the Republic of Kazakhstan, Article 78. The act of pardoning an individually determined person against whom a guilty verdict has entered into force, as well as a person serving or having served in the territory of the Republic of Kazakhstan a sentence imposed by a verdict of a foreign court, is issued by the President of the Republic of Kazakhstan. According to paragraph 4 of art. 78 of the Criminal Code of the Republic of Kazakhstan, upon pardon, a person convicted of a crime may be released from further serving his sentence, or the sentence imposed on him may be reduced or replaced with a more lenient type of punishment, or such a person may be released from an additional type of punishment. A criminal record may be lifted from a person who has served a sentence or has been released from serving it further.
Based on the above and in accordance with paragraph 15 of Article 44 of the Constitution of the Republic of Kazakhstan, paragraph 4 of Article 78 of the Criminal Code of the Republic of Kazakhstan, I ASK you, Kassym-Jomart Kemelovich: Pardon me Sidorov Grigory Sergeevich and release me from further serving my sentence.;
