Pre-trial claim

On May 12, 2022, the state registration of the Lada-21901 model vehicle, which belongs to me by right of ownership, was carried out with the issuance of a certificate in your name. Currently, I have a need to re-register the above-mentioned vehicle in my name. In this regard, I ask you to voluntarily contact the authorized body to terminate the registration of the vehicle, so that I can subsequently register it with the registration authority in my name. In accordance with paragraph 30) of the Law of the Republic of Kazakhstan "On Road Traffic", state registration of a vehicle is a procedure for allowing a vehicle to participate in road traffic, carried out by an authorized body after checking the compliance of documents with the legislation of the Republic of Kazakhstan, verifying vehicle identification numbers with the issuance of a vehicle registration certificate and the assignment of a state registration plate; 31) certificate of state registration of a vehicle is a document confirming the vehicle's admission to participate in road traffic. Thus, if you believe that after registering the vehicle, you have acquired ownership of the car, then you are deeply mistaken.

 

According to part 2 of Article 235 of the Civil Code of the Republic of Kazakhstan, Ownership of property owned by an owner may be acquired by another person on the basis of a contract of sale, barter, donation or other transaction on the alienation of this property. I know for a fact that you have no such grounds. In accordance with Article 188 of the Civil Code of the Republic of Kazakhstan, the owner has the right to own, use and dispose of his property. The right of ownership is a legally secured opportunity to exercise actual ownership of property. The right of use is a legally secured opportunity to extract useful natural properties from a property, as well as to benefit from it. The benefit can take the form of income, increment, fruits, offspring and in other forms. The right of disposal is a legally secured opportunity to determine the legal fate of property. The owner has the right, at his discretion, to perform any actions with respect to the property belonging to him, including alienating this property to other persons, transferring to them, while remaining the owner, his powers to own, use and dispose of the property, pledge the property and encumber it in other ways, dispose of it in another way. Currently, the registration of a vehicle in your name makes it difficult to fully exercise my ownership rights in relation to my Lada-21901 car, state registration plate ...AIV02. In connection with the above, please:

within 5 business days, terminate the registration of a Lada-21901 vehicle, state registration plate .....AIV02 by notifying me at the phone number 87078984142.

In case of non-fulfillment of my request, I will regard your inaction as a refusal on your part. In this case, I will have to apply to the competent authorities, including the court, to resolve this situation, with the subsequent recovery of all expenses incurred by me, including attorney's fees.
