IP "TG Group" and LLP "Farm-plus" represented by J.A.E. signed a contract for the supply of goods (one-time) for No. 6/9/21 dated 09/06/2021. According to clauses 1.1 and 1 of the Contract, the supplier undertakes to transfer to the buyer's ownership of Wally Plastik nitrile gloves in a total amount of 100,000 pairs at a price of 19 tenge per 1 unit of goods. The buyer made the payment in full in the amount of 1,900,000 tenge. The parties also concluded a similar agreement in the amount of 2,500,000 tenge. As a result, the buyer, according to the agreements, paid 4,400,000 tenge to the seller. Subsequently, the seller entered into an agreement with suppliers for the supply of personal protective equipment from China. However, the supplier did not fulfill the contract requirement and the goods were not delivered on time due to the pandemic caused by the coronavirus, that is, due to restrictions on the delivery of medical goods from the territory of the People's Republic of China.
Proposal for a dispute with the supply contract
Due to the non-fulfillment of contractual obligations by the seller of Pharm-plus LLP, the buyer appealed to the Specialized Interdistrict Economic Court of Almaty with a statement of claim for recovery of the amount owed. Also, as of today, investigative actions will be introduced against J.A.E. in the UP of the Bostandyk district of the DP of Almaty. In order to resolve the dispute and mitigate the punishment against J.A.E., the relatives of J.A.E. intend to compensate for the material damage caused under this agreement. Thus, we hereby offer you 1,000,000 tenge, and we ask you to divide the remainder into three months.
The above amount is the maximum at the moment, since relatives live on wages and have no other types of income, and therefore we ask you, in these difficult times for the Defendant, to coordinate this proposal to refund funds under the contract and resolve the situation peacefully. Also, your requirement to repay the entire debt is currently not possible. Based on the above and in accordance with paragraphs 4, Article 8 of the Civil Code of the Republic of Kazakhstan, I hope that our further cooperation with you will continue on mutually beneficial and mutually acceptable terms.
