PETITION TO THE COURT FOR THE APPOINTMENT OF A HANDWRITING EXAMINATION
In the proceedings of the Medeu District Court of Almaty, there is a civil case registered under No. 7517-18-3-1/3034 dated 15.01.2018 on the Claim __________________ to ATF Bank JSC on the recognition of the Bank Loan Agreement No.P461-2006 dated March 16 2006 is not valid.
As one of the evidence in the case, a copy of the Bank Loan Agreement was submitted by ATF Bank JSC and us for №__________________ -2006 dated March 16, 2006, with the documents attached to it, where the Court issued the definition of claims for the originals of the above-mentioned contracts, the authenticity of which is questionable. So, in particular, the signatures of the Plaintiff do not match in the document.
Based on the above and guided by art. 82 of the CPC RK,
I ASK THE COURT:
1. To consider the present application for the appointment of a handwriting examination;
2. Appoint a judicial handwriting examination in the above-mentioned case;
3. To assign the payment for the forensic handwriting examination to the Plaintiff __________________;
4. Ask the following questions for the expert's permission: - Has the signature on the Bank Loan Agreement No. P461-2006 dated March 16, 2006 and the documents attached thereto been completed by the Plaintiff or another person?
