The petition
The proceedings of the Specialized Interdistrict Investigative Court of Nur-Sultan examined the materials of the criminal case registered in the ERDR for No. 217100031000713 against Bekniyazova B., Demesin N.E. (hereinafter referred to as the defendants) on the commission of a criminal offense. On October 01, 2021, the defendants were detained in accordance with Article 128 of the CPC. By the investigator's decision of October 02, 2021, the actions of the defendants were qualified under Articles 262, 309 of the Criminal Code. This petition was supported by the prosecutor of the Almaty district of Nur-Sultan and sent to the court with the attached materials on October 04, 2021.

On 04.10.2021, by a decision of the investigating judge of the specialized interdistrict investigative court of Nur-Sultan, T. Kopbosynov, it was decided: to authorize the use of a preventive measure in the form of detention against BEKNIYAZOVA BAZARKHAN ELMURATOVA for a period of 2 (two) months, that is, from October 1, 2021, 23 hours 16 minutes to December 1, 2021, 23 hours 16 minutes. On 04.10.2021, by the decision of the investigating judge of the specialized interdistrict investigative court of Nur-Sultan, Babatov A.M. A decision has been made: The investigator's request to authorize the chosen preventive measure in the form of detention in respect of the suspect ....... Nahuan Yerlanuly - to satisfy. To authorize the chosen measure of restraint in the form of detention in relation to the suspect .......... Nahuan Yerlanuly for a period of 2 (two) months, which runs from October 01, 2021, 20 hours 40 minutes to December 01, 2021, 20 hours 40 minutes, inclusive. In order to conduct a comprehensive, complete and objective investigation of the criminal case, it is necessary to study the materials of the criminal case submitted to the court by the investigator for the authorization of a preventive measure. According to Article 99 of the Criminal Procedure Code of the Republic of Kazakhstan, participants in criminal proceedings have the right to apply to the person conducting the pre-trial investigation, the prosecutor, the judge (to the court) with petitions for procedural actions or procedural decisions to establish the circumstances relevant during the criminal process, to ensure the rights and legitimate interests of the person who filed the petition, or represented by them faces. Based on the above and in accordance with Articles 70, 99, CPC RK, I ask you:
