A criminal case is pending under the OP at the UP of the Medeu district of the DP of Almaty on the application of Aoi S.T. against Boy M.T. on the fact of fraudulent actions.
In her statement and during the confrontation with Boy M.T., AA S.T. claims that on October 16, 2025, after about 20:00 hours, she lent Boy M.T. cash in the amount of 4,100,000 tenge along Karkaraly Street in the MKR. Duman of the Medeu district of Almaty.
Ba M.T. categorically denies the testimony of Aoi S.T. in this part.
According to the information provided by the public procurement portal of the Republic of Kazakhstan, Aa STenesbekovna is registered at the following address: Kyzylkairat village, Talgar district, Almaty region, subscriber number + 7 771 412 28 90 .
According to Article 24 of the Criminal Procedure Code of the Republic of Kazakhstan, the investigator is obliged to take all measures provided by law for a comprehensive, complete and objective investigation of the circumstances necessary and sufficient for the proper resolution of the case.
According to Article 70 of the CPC of the Republic of Kazakhstan, the defender has the right to file petitions.
According to Article 99 of the CPC of the Republic of Kazakhstan, the petition is subject to consideration and resolution immediately after its application. In cases where an immediate decision on the application is not possible, it must be resolved no later than three days from the date of the application.
Based on the above, I ask:
1. Send a request to the cellular operators serving the subscriber numbers +7 747 053 21 25, + 7 708 697 22 35 ( M.T. Boy numbers), on the provision of information for the time period from 17:00 hours on October 16, 2025 to 03:00 hours on October 17, 2025, namely:
- information about the base stations (Cell ID, LAC, coordinates) through which the subscriber number was serviced;
- the time of registration in the network and connections;
- details of the connections (without disclosing the content of the negotiations);
- information about the IMEI of the device used (if available).
2. Send a request to the mobile operator servicing the subscriber number + 7 771 412 28 90 (number of Aoi S.T.), on the provision of information for the time period from 17:00 hours on October 16, 2025 to 03:00 hours on October 17, 2025, namely:
- information about the base stations (Cell ID, LAC, coordinates) through which the subscriber number was serviced;
- the time of registration in the network and connections;
- details of the connections (without disclosing the content of the negotiations);
- information about the IMEI of the device used (if available)
3. If necessary, contact the investigating judge for authorization to obtain information constituting a communication secret.
Obtaining information about the location of the subscriber number will allow:
-to establish the actual location of the M.T. Boy and S.T. Aoi on October 16, 2025;
- verify the authenticity of the victim's testimony by Aoi S.T.;
- confirm or verify the fact of a meeting between Aoi S.T. and Boy M.T. in MKR. Duman of the Medeu district of Almaty on October 16, 2025 after 20:00 hours;
- to exclude the unjustified involvement of the M.T. Boy in criminal prosecution.
This information is essential for the correct legal assessment of actions and the establishment of the truth in the case.
Based on the above, I ask you to grant the petition.
