Resolution No. 272 of the Government of the Republic of Kazakhstan dated April 14, 2026

The Government of the Republic of Kazakhstan DECIDES:

    1. To approve the attached Agreement in the form of an exchange of notes between the Government of the Republic of Kazakhstan and the Government of Japan regarding the grant provided to support the implementation of the Economic and Social Development Program, executed in Astana on January 30, 2026.

2. This resolution shall come into effect on the date of its signing.

Note of the Republic of Kazakhstan

Your Excellency,

I have the honour to confirm receipt by Your Excellency of the note, which today states the following:

“I have the honour, referring to the recent discussions held between representatives of the Government of Japan and the Government of the Republic of Kazakhstan regarding the expansion of Japanese economic cooperation in order to promote the economic and social development of the Republic of Kazakhstan, to propose the following agreement on behalf of the Government of Japan:

1. (1) In order to facilitate the implementation by the Government of the Republic of Kazakhstan (hereinafter referred to as the ‘Recipient’) The project to modernize cargo scanning equipment at the Aktau port customs checkpoint on the Trans‑Caspian International Transport Route (hereinafter referred to as the “Project”) has been approved by the Government of Japan. The Government of Japan has decided to grant the Recipient a sum of ¥ 7,190,000,000 (seven hundred and nineteen million) Japanese yen (hereinafter referred to as the “Grant”), which will be provided to the Recipient subject to compliance with the relevant laws, regulations, and budget allocations of Japan.

(2) The Grant will be provided by concluding a Grant Agreement between the Recipient or its authorized body and the Japan International Cooperation Agency (JICA) (hereinafter referred to as “G/A”).

(3) The terms and conditions for the Grant, as well as the procedure for its use, will be governed by G/A within the framework of this Agreement.

2. The grant will be available for a period that may be specified in the G/A, provided that this period falls between the date the G/A comes into force and December 31, 2030. This period may be extended by mutual agreement between the relevant authorities of the two governments.

    3. The Grant must be used by the Recipient appropriately and exclusively for the purchase of such products and/or services necessary for the implementation of the Project as may be specified in the G/A (hereinafter referred to as "Products" and "Services" respectively).

4. The recipient or its authorized body enters into contracts with Japanese citizens for the purchase of Products and (or) Services in Japanese yen (the term “Japanese citizens” in this Agreement means Japanese individuals or Japanese legal entities controlled by Japanese individuals and registered in Japan). Such contracts are reviewed by JICA to determine whether they meet the requirements for receiving a Grant.

5. The grant will be implemented by JICA in accordance with the provisions of G/A by making payments in Japanese yen to an account opened in the name of the Recipient in a bank in Japan specified by the Recipient or an authorized body thereof.

6. (1) The Recipient shall take the necessary measures:

    (a) to ensure that customs duties, internal taxes and other fiscal charges that may be levied in the Recipient's country in connection with the purchase of Products and/or Services are exempt by the authorized body without using the Grant;

    (b) pay due attention to environmental and social aspects in the implementation of the Project;

    (c) ensure that Products and/or Services are maintained and used appropriately and effectively for the implementation of the Project and are not used for military purposes;

    (d) ensure the allocation of land plots necessary for the implementation of the Project and to clear the territories;

    (e) provide facilities for electricity distribution, water supply and sanitation, as well as other related facilities necessary for the implementation of the Project;

    (f) ensure rapid unloading, customs clearance and internal transportation in the Recipient country;

    (g) provide Japanese individuals and/or third-country individuals whose services may be required in connection with the supply of Products and/or Services, with such facilities as may be necessary for them to enter and stay in the Recipient country to perform their work;

    (h) ensure the safety of persons involved in the Project in the Recipient country;

    (i) bear all expenses, except those covered by the Grant, necessary for the implementation of the Project.

    (2) Upon request, the Recipient provides the Government of Japan with the necessary information about the Project.

    (3) With regard to transportation and marine insurance of Products, the Recipient undertakes not to impose any restrictions that may hinder fair and free competition between transport and marine insurance companies.

    (4) Products and/or Services are not subject to export or re-export from the Recipient country.

    7. The governments of the two countries shall hold consultations on any issues that may arise in connection with this Agreement.

I have the honour to propose that this note and the reply note from Your Excellency, confirming the above‑mentioned agreement on behalf of the Recipient, constitute an Agreement in the form of an exchange of notes between the Government of Japan and the Government of the Republic of Kazakhstan regarding the grant provided to facilitate the implementation of the Economic and Social Development Programme, which shall enter into force on the date when the Government of Japan receives a written notification from the Government of the Republic of Kazakhstan confirming the completion of the necessary domestic procedures for the entry into force of such an Agreement.

I have the honour to confirm, on behalf of the Government of the Republic of Kazakhstan, the aforementioned understanding and to agree that Your Excellency’s note and this reply constitute an Agreement in the form of an exchange of notes between the Government of the Republic of Kazakhstan and the Government of Japan regarding the grant provided to facilitate the implementation of the Economic and Social Development Programme, which will come into force from the date the Government of Japan receives written notification from the Government of the Republic of Kazakhstan confirming the completion of the necessary domestic procedures for the entry into force of such an Agreement.
