The petition
on the issue of a writ of execution
In your proceedings, there was a civil case No. 7519-22-00-2/519 dated 05/31/2022 on the claim of the plaintiff of the Limited Liability Partnership "Hyundai Transauto" (hereinafter referred to as the plaintiff) against A.B.R. (hereinafter referred to as the defendant) for recognition of the Nissan Almera brand car, VIN KNMCHLMSAP790236 located at: Almaty, ul. B..., 70 ownerless and transfer it to the ownership of the state.
By a decision of the judicial boards for civil cases of the Almaty City Court, the defendant's appeal was satisfied with the decision of the Turksib District Court of Almaty dated May 31, 2022 to cancel and make a new decision on the case.
To dismiss the claims of Hyundai Transauto LLP against the State Revenue Department of Almaty, the Akimat of Almaty, A.B.R. regarding the recognition of the car as ownerless and its transfer to state ownership.
Collect 200,000 (two hundred thousand) tenge from Hyundai Transauto LLP in favor of A.B.R. to reimburse the costs of paying for the services of a representative.
According to art.241 of the Civil Procedure Code of the Republic of Kazakhstan, a decision in accordance with the procedure established by this Code is enforceable after its entry into force, except in cases of immediate execution. After the court decision comes into force, a writ of execution is issued.
Based on the above and guided by 47, 241 CPC RK,
I ask the Court:
Issue a writ of execution.
