        Section VI Products of chemical and related industries  

     Notes: 1.- (a) Goods (other than radioactive ores) conforming to the description in heading 28.44 or 28.45 should be included in these headings and in no other headings of the Nomenclature.         (b) Subject to the provisions of Note 1a, goods conforming to the description in heading 28.43 or 28.46 should be included in these headings and in no other headings of this section.         2.- Subject to the provisions of notes 1a and 1b, the goods related to the heading 30.04, 30.05, 30.06, 32.12, 33.03, 33.04, 33.05, 33.06, 33.07, 35.06, 37.07 or 38.08, supplied in a specific packaging or for retail sale, must be included in these headings and not in any other product items in the Product Range.         3.- Products in sets consisting of two or more separate components, some or all of which are included in this section and are intended to be mixed to produce a product belonging to Section VI or VII, should be included in the appropriate heading for that product, provided that these components: (a) with given the packaging method, they are clearly intended to be used together without prior repackaging or repackaging; (b) they are supplied together; and (c) are identified either by their nature or by the relative proportions in which they are presented as complementary components.

     Notes: 1.- Unless otherwise specified in the context, the headings of this group include: (a) individual chemical elements and individual compounds of a certain chemical composition, containing or not containing impurities; (b) the products specified in paragraph (a) above, dissolved in water;         (c) the products specified in paragraph (a) above, dissolved in other solvents, provided that dissolution is a common and necessary condition for their preservation or transportation, while preserving the properties of these products, which does not allow their use for purposes other than traditional; (d) the products specified above in points (a), (b) or (c), with the addition of a stabilizing agent (including an anti-caking agent) necessary for their preservation or transportation;         (e) the products specified in paragraphs (a), (b), (c) or (d) above, with the addition of an anti-dust agent or coloring agent to facilitate their identification or for safety reasons, while preserving the properties of these products, which does not allow their use for purposes other than traditional.

           2.- Except dithionites and sulfoxylates stabilized with organic substances (heading 28.31), carbonates and peroxocarbonates of inorganic bases (heading 28.36), cyanides, cyanide oxide and complex cyanides of inorganic bases (heading 28.37), fulminates, cyanates and thiocyanates of inorganic bases (heading 28.38), organic products included in headings 28.43-28.46, as well as carbides (heading 28.49), this group includes only the following carbon compounds: (a) carbon oxides, hydrogen cyanide, Rattlesnake, isocyanic, thiocyanic and other simple or complex cyanic acids (heading 28.11); (b) halide carbon oxides (heading 28.12); (c) carbon disulfide (heading 28.13); (d) thiocarbonates, selenocarbonates, tellurocyanates, selenocyanates, tellurocyanates, tetrathiocyanate aminochromates (rheinecates) and others complex cyanates of inorganic bases (heading 28.42);         (e) urea-cured hydrogen peroxide (heading 28.47), carbon oxysulfide, thiocarbonyl halides, cyane, cyanohalides, cyanamide and its metal derivatives (heading 28.51), other than calcium cyanamide, both in pure form and with impurities (Chapter 31).         3.- Subject to the provisions of note 1 to section VI, this chapter does not include: (a) sodium chloride or magnesium oxide, pure or with impurities, as well as other products of section V; (b) organo-inorganic compounds other than those specified above in note 2 to this chapter;         (c) products specified in Notes 2, 3, 4 or 5 to Chapter 31; (d) inorganic products used as phosphors of heading 32.06; vitreous frit and other glass in powder, granules or flakes of heading 32.07; (e) artificial graphite (heading 38.01); products used for charges in fire extinguishers or included in grenades for extinguishing fires of heading 38.13; ink stain removal formulations packaged for retail sale of heading 38.24; artificially grown crystals (other than optical elements) of alkali or alkali-earth metal halides, each weighing at least 2.5 g of heading 38.24; (f) precious or semi-precious stones (natural, artificial or reconstructed), as well as crumbs or powder of these stones (headings 71.02-71.05), or precious metals, or precious metal alloys of Group 71; (g) metals, pure or with impurities, their alloys or cermets, including sintered metal carbides (metal carbides sintered with metal), section XV; or (h) optical elements, for example, halides of alkali or alkaline-earth metals (heading 90.01). 4.- Complex acids of a certain chemical composition consisting of an acid formed by a nonmetal of subgroup II and an acid formed by a metal of subgroup IV, are included in heading 28.11. 5.- In headings 28.26-28.42 only metal or ammonium salts or peroxosols are included.         Double or complex salts are included in heading 28.42, unless otherwise specified in the context.         6.- Heading 28.44 includes only: (a) technetium (ordinal number 43), promethium (ordinal number 61), polonium (ordinal number 84) and all elements with ordinal numbers above 84; (b) natural or artificial radioactive isotopes (including isotopes of precious or base metals specified, respectively, in sections XIV and XV) in a mixture or separately; (c) compounds of these elements and isotopes, organic or inorganic, of a definite or indefinite chemical composition, in a mixture or separately;         (d) alloys, dispersions (including cermets), ceramic products and mixtures containing these elements or their isotopes, as well as inorganic and organic compounds of these elements and isotopes with a specific radioactivity of more than 0.002 Mci/g (74 Bq/g); (e) spent (irradiated) fuel elements (fuel rods) nuclear reactors; (f) radioactive residues, suitable or unusable.         In these notes and the names of headings 28.44 and 28.45, the term "isotopes" means the following: - individual nuclides, with the exception of nuclides that exist in nature in a monoisotopic state; - mixtures of isotopes of one element enriched in one or more of the isotopes mentioned above, that is, elements with artificially altered natural isotopic composition.

     7.- Heading 28.48 includes copper phosphide containing more than 15 by weight.% phosphorus.         8.- Chemical elements (for example, silicon and selenium) used in electronics are included in this group, provided that they are presented in an elongated form without further processing or in the form of cylinders or rods. If they are in the form of discs, plates or similar shapes, they are included in heading 38.18.

     Notes: 1.- This chapter does not include: (a) individual elements or compounds of a specific chemical composition, with the exception of the following: (1) artificial graphite (heading 38.01); (2) insecticides, rodenticides, fungicides, herbicides, anti-germination agents and plant growth regulators, disinfectants and similar products, packaged as described in heading 38.08; (3) formulations used as fire extinguisher charges or loaded grenades for extinguishing fires (heading 38.13);         (4) certified reference materials specified in Note 2 to this chapter; (5) goods specified in note 3a or 3b to this chapter; (b) mixtures of chemicals with foodstuffs or other substances having nutritional value that are used in the food preparation process (mainly heading 21.06(c) ash and residues (including sludge, other than sewage sludge) containing metals, arsenic or mixtures thereof and meeting the requirements of Notes 3a or 3b to Chapter 26 (heading 26.20);         (d) medicinal products (heading 30.03 or 30.04); or (e) spent catalysts used for the extraction of base metals or for the production of chemical compounds of base metals (heading 26.20), spent catalysts used primarily for the extraction of precious metals (heading 71.12), or catalysts consisting of metals or metal alloys in the form of, for example, finely ground powder or skeletal catalysts (section XIV or XV).         2.- (A) For the purposes of heading 38.22, the term "certified reference materials" means reference materials provided with a certificate indicating the properties of the certified materials, the methods used to determine these indicators, the measurement errors of each value, and suitable for analytical, calibration or reference purposes.         (B) With the exception of products of Group 28 or 29, when classifying certified reference materials, heading 38.22 takes precedence over any other heading in the Nomenclature.         3.- To item 38.24 the following products are included, which are not included in any of the other headings of the Nomenclature: (a) artificially grown crystals (except optical elements) of magnesium oxide or halides of alkaline or alkaline-earth metals with a mass of each crystal of at least 2.5 g; (b) fusel oil; bone tar oil; (c) formulations for removing ink stains, packaged in packages for retail sale; (d) formulations for correcting printed texts and other correction fluids, packaged in packages for retail sale; and (e) ceramic pyroelements, fusible (for example, Zeger cones).         4.- Throughout the Nomenclature, the term "municipal waste" means waste of the type collected from houses, hotels, restaurants, hospitals, shops, offices, etc., road and sidewalk debris, as well as waste from construction and demolition of buildings. Urban waste typically contains a variety of materials such as plastics, rubber, wood, paper, fabrics, glass, metals, food waste, broken furniture, and other damaged or discarded items. However, the term "municipal waste" does not apply to: (a) individual materials or objects isolated from waste, such as plastic, rubber, wood, paper, fabrics, glass or metals, and spent batteries, which fall into their respective product headings; (b) industrial waste; (c) unsuitable pharmaceutical products described in note 4k to chapter 30; or (d) clinical waste described in note 6a to this chapter.

     5.- For the purposes of heading 38.25, the term "sewage sludge" means sludge generated in urban wastewater treatment plants and includes pretreatment waste, flushing water and unstable sludge. Stabilized sludge, if it is suitable for use as fertilizers, is excluded (Group 31).         6.- For the purposes of heading 38.25, the term "other waste" means: (a) clinical waste, that is, contaminated waste resulting from scientific research in the field of medicine, diagnostic, therapeutic or other medical, surgical, dental or veterinary procedures, which often contain pathogens and pharmaceutical substances and require special procedures for disposal (for example, contaminated clothing, used gloves and syringes); (b) used organic solvents;         (c) waste solutions for etching metals, hydraulic fluids, brake fluids and antifreeze; and (d) other waste from chemical or related industries.         However, the term "other waste" does not apply to waste containing mainly petroleum and petroleum products obtained from bituminous rocks (heading 27.10).  

     Note to subheadings: 1.- For the purposes of subheadings 3825.41 and 3825.49, the term "spent organic solvents" means wastes containing predominantly organic solvents that are unsuitable in their present form for further use as primary products, regardless of whether they are intended for solvent regeneration or not.
