         Section VII Plastics and products made from them;   Rubber, rubber and products made from them  

     Notes: 1.- Products presented in sets consisting of two or more separate components, some or all of which are included in this section and are intended to be mixed in order to obtain a product included in Section VI or VII, must be included in the heading corresponding to this product, provided that these components(a) given their packaging method, they are clearly intended to be used together without repackaging; (b) they are supplied together; and (c) are determined by their nature or by their relations as complementary to each other.         2.- With the exception of goods of heading 39.18 or 39.19, plastics, rubber and articles made from them with printed patterns, drawings or images specially applied to them for their main purpose are included in Chapter 49.  

        Group 39 Plastics and articles made from them  

     Notes: 1.- Throughout the Nomenclature, the term "plastics" means materials of headings 39.01-39.14, which, during polymerization or at some subsequent stage, are capable of taking a given shape under the influence of external influences (usually temperature and pressure, and, if necessary, using a solvent or plasticizer) and retaining it after the external influence is eliminated. impact, such as pressing, casting, extrusion, calendering or other.         Throughout the Nomenclature, the term "plastics" also means vulcanized fiber, but does not apply to materials considered as textiles in section XI.         2.      (m) goods of section XI (textile materials and textile products); (h) products of section XII (for example, shoes, hats, umbrellas, sun umbrellas, canes, whips, whips or parts thereof); (o) costume jewelry of heading 71.17; (n) goods of section XVI (machinery and mechanical or electrical devices); (p) parts of aircraft or vehicles of Section XVII; (c) articles of Chapter 90 (for example, optical elements, eyeglass frames, drawing tools); (t) articles of Chapter 91 (for example, watch cases of all kinds);         (y) articles of Chapter 92 (for example, musical instruments or parts thereof); (f) articles of Chapter 94 (for example, furniture, lamps and lighting equipment, light signage, prefabricated building structures); (x) articles of Chapter 95 (for example, toys, games, sports equipment); or (c) articles of Chapter 96 (for example, brushes, buttons, zippers, combs, mouthpieces or tube holders or similar articles, parts for thermoses or similar articles, pens, pencils with a plug-in lead).         3.- Headings 39.01-39.11 include only the following chemical synthesis products: (a) liquid synthetic polyolefins, less than 60 vol.% of which is distilled at 300 ° C and a pressure of 1013 mbar in the case of low-pressure distillation (headings 39.01 and 39.02); (b) resins with a low degree of polymerization of the coumarone-indene type (heading 39.11); (c) other synthetic polymers containing on average at least 5 monomeric units; (d) silicones (heading 39.10);         (e) resoles (heading 39.09) and other prepolymers.         4.- The term "copolymers" means all polymers in which no monomeric unit is 95% by weight.% or more of the total polymer content.         In this chapter, unless otherwise specified in the context, copolymers (including copolycondensates, additive copolymerization products, block copolymers and grafted copolymers) and polymer mixtures are included in the same heading as polymers of a comomeric unit that predominates by weight over any other individual comomeric unit. In this note, the comomeric units forming polymers falling into the same heading should be considered together.         If no single comomeric link prevails, then copolymers or polymer mixtures, depending on the specific case, should be included in the heading, the last in ascending order of codes among the considered equivalent headings.         5.- Chemically modified polymers in which only the side chains of the main polymer chain are altered by chemical action are included in the heading corresponding to the unmodified polymer. This condition does not apply to grafted copolymers.         6.- For the purposes of headings 39.01 to 39.14, the term "primary forms" means only the following forms: (a) liquids and pastes, including dispersions (emulsions, suspensions) and solutions; (b) irregularly shaped blocks, lumps, powders (including press powders), granules, flakes and similar bulk forms.         7.- Heading 39.15 does not include waste, trimmings and scrap of homogeneous thermoplastic material recycled into the starting material (headings 39.01-39.14). 8.- In heading 39.17, the term "pipes, tubes and hoses" means hollow products or semi-finished products, or finished products commonly used for transportation, supply or distribution of gases or liquids (for example, a corrugated garden hose, perforated pipes). The term also means sausage casings and other flat-shaped pipes. However, with the exception of the latter, products having an internal cross-section of a shape other than a circle, oval, rectangle (in which the length is no more than 1.5 times the width) or a regular polygon are considered not as pipes, tubes and hoses, but as shaped profiles.         9.- For the purposes of heading 39.18, the term "plastic wall or ceiling coverings" means articles in rolls of at least 45 cm wide used for wall or ceiling decoration, consisting of plastics fixed on a substrate of any material other than paper; In this case, the plastic layer (on the front surface) is usually decorated by embossing, fluting, coloring, printing or otherwise.  

     Section VII Group 39 Notes 3  

     10.- In headings 39.20 and 39.21, the term "plates, sheets, film and strips or tapes" means only plates, sheets, film and strips or tapes (other than those included in Chapter 54), as well as blocks of regular geometric shape with or without a pattern, or with a surface treated in another way, whether or not they are cut into rectangles (including squares), but without further processing (even if they become finished products as a result of such operations).         11.- Heading 39.25 includes only the following products, which are not products included in the previous headings of subgroup II of this group: (a) tanks, tanks (including septic tanks), barrels and similar containers with a volume of more than 300 liters; (b) building elements used, for example, for floors walls or partitions, ceilings or roofs; (c) gutters and fittings thereto; (d) doors, windows and frames thereto and door sills; (e) balconies, balustrades, fences, gates and similar fences;         (f) shutters, curtains (including Venetian blinds) and similar articles and parts and accessories thereto; (g) large-sized structural elements of racks for assembly and permanent installation, for example, in shops, workshops, warehouses; (h) decorative architectural details, for example, flutes, domes, dovecotes; and (i) fittings and fittings intended for stationary installation in/or on doors, windows, stairs, walls or other parts of buildings, for example, buttons, handles, hooks, staples, towel hooks, circuit breakers and other protective boards.  

Notes to subheadings: 1.- In any heading of this chapter, polymers (including copolymers) and chemically modified polymers should be included in accordance with the following provisions: (a) if there is a subheading "other" at the same level: (1) in the subheading "polymers" the prefix "poly" (for example, polyethylene and polyamide-6,6) means that the main monomeric unit or monomeric units of the named polymer, taken together, should be 95% by weight.% or more of the total polymer content;         (2) copolymers of subheadings 3901.30, 3903.20, 3903.30 and 3904.30 should be included in the same subheadings provided that the comomeric units of the above-mentioned copolymers are 95% by weight.% or more of the total polymer content; (3) chemically modified polymers should be included in the "other" subheading if the chemically modified polymers are not included in another, more specific, subheading.;         (4) polymers not listed in paragraph 1, 2 or 3 above should be included in that subheading from among the remaining subheadings of the same level, which includes polymers of a monomeric unit prevailing by weight over all other individual monomeric units. For this purpose, the main monomeric units of polymers forming polymers falling into the same subheading should be considered together. Only those comomeric units included in the polymer that are included in subheadings of the same level should be compared.;         (b) in the absence of a "other" subheading at the same level: (1) polymers should be included in a subheading that includes polymers of the monomeric unit that predominates by weight over all other individual monomeric units. For this purpose, the main monomeric units of polymers falling into the same subheading should be considered together. Only those comomeric units included in the polymer that are included in subheadings of the same level should be compared.;         (2) Chemically modified polymers should be included in the subheading corresponding to the unmodified polymer.         Polymer mixtures should be included in the same subheading as polymers of the same monomeric units in the same proportions.         2.- For the purposes of subheading 3920.43, the term "plasticizers" means secondary plasticizers.

Notes: 1.- Unless otherwise specified in the context, the term "rubber and rubber" throughout the Nomenclature means the following products, vulcanized or non-vulcanized, solid or non-solid: natural rubber, balata, gutta-percha, guaiula, chicle and similar natural resins, synthetic rubber, factis obtained from oils, and these the same materials are in a regenerated form.         2.- This chapter does not include: (a) goods of section XI (textile materials and textile products); (b) footwear or parts thereof of Chapter 64;         (c) headgear or parts thereof (including bathing caps) of Chapter 65; (d) mechanical or electrical devices or parts thereof of section XVI (including electrical goods of all kinds), of hard rubber or ebonite; (e) articles of Chapter 90, 92, 94 or 96; or (f) articles groups 95 (except sports gloves, mittens, mittens and articles of headings 40.11-40.13).         3.- For the purposes of headings 40.01 to 40.03 and 40.05, the term "primary forms" means the following forms: (a) liquids and pastes (including sub-vulcanized or non-vulcanized latex and other dispersions and solutions); (b) irregularly shaped blocks, lumps, bales, powders, granules, crumbs and similar bulk forms.         4.- In note 1 to this chapter and in heading 40.02, the term "synthetic rubber" means: (a) unsaturated synthetic substances that are irreversibly transformed by vulcanization of sulfur into non-thermoplastic substances that do not break at a temperature of 18-29 ° C when stretched 3 times their original length, and when stretched 2 times within 5 minutes, they return to a length exceeding the original length by no more than one and a half times. In this test, it is allowed to add substances necessary for the formation of cross-links, in particular, activators or accelerators of vulcanization. The substances listed in note 5b (ii and iii) are also allowed. However, the presence of any substances not intended to form cross-links, such as diluents, plasticizers and fillers, is not allowed; (b) thioplasts (HMS); and (c) natural rubber modified by grafting or by mixing with plastics, depolymerized natural rubber, mixtures of unsaturated synthetic substances with saturated synthetic high-molecular polymers, provided that all of the above products comply with the requirements specified above in paragraph 4a of this note regarding vulcanization, elongation and dimensional restoration.         5.- (a) Headings 40.01 and 40.02 do not include rubber or mixtures of rubbers if, before or after coagulation, they have been mixed with: (i) vulcanizing agents, accelerators, retardants or activators (other than those added to prepare vulcanized rubber latex); (ii) pigments or other coloring agents, other than those used only for identification purposes;         (iii) plasticizers or fillers (other than mineral oil in the case of oil-filled rubber), reinforcing agents, organic solvents or any other substances other than those mentioned in paragraph 5b.         (b) The presence of the following substances in rubber or a mixture of rubbers will not affect their assignment to heading 40.01 or 40.02, provided that such rubber or a mixture of rubbers retains its basic properties as a raw material: (i) emulsifiers or anti-adhesives; (ii) small amounts of emulsifier decomposition products;         (iii) very small amounts of heat-sensitive agents (mainly for the production of heat-sensitive rubber latexes), cationic surfactants (usually for the production of electropositive rubber latexes), antioxidants, coagulants, agents that promote the conversion of rubber into crumbs, agents providing frost resistance, peptizers, anticoagulants, stabilizers, agents regulating viscosity, or similar special purpose additives.

     6.- For the purposes of heading 40.04, the term "waste, trimmings and scraps" means waste, trimmings and scraps generated during the manufacture or processing of rubber and articles made from it, which are completely unusable as such due to cuts, wear or other reasons.         7.- Filaments consisting entirely of vulcanized rubber with a cross-sectional dimension of more than 5 mm are included as strips or strips, rods or shaped profiles in heading 40.08.         8.
