Section XVII Land transport vehicles, aircraft, floating vehicles and transport-related devices and equipment

Notes: 1.- This section does not include products of heading 95.01, 95.03 or 95.08, as well as bobsleigh sleds, toboggans or similar products of heading 95.06. 2.- The terms "parts" and "parts and accessories" do not apply to the following products, regardless of whether they can be identified as intended for the goods in this section: (a) joints, washers, gaskets and similar products made of any material (classified according to the material from which they are made, or in heading 84.84) or other articles of vulcanized rubber, other than hard rubber (heading 40.16); (b) general purpose parts made of base metals (section XV) in accordance with note 2 to section XV or similar goods made of plastics (chapter 39); (c) products of Group 82 (tools); (d) products of heading 83.06; (e) machinery and equipment of headings 84.01-84.79 or parts thereof; articles of heading 84.81 or 84.82 or, if they are components of engines or power plants, articles of heading 84.83; (f) electrical machinery or equipment (Chapter 85); (g) articles of Group 90; (h) articles of Group 91; (i) weapons (Chapter 93); (k) lamps or lighting equipment of heading 94.05; or (l) brushes used as parts in vehicles (heading 96.03). 3.- In Chapters 86-88, the terms "parts" and "accessories" do not apply to parts or accessories that They are not used exclusively or mainly with products of these groups. Parts and accessories that can be attributed to two or more headings of these groups should be included in the heading that corresponds to the main use of these parts or accessories. 4.- In this section: (a) vehicles specially designed for movement both on roads and on rails are included in the corresponding heading of Chapter 87; (b) amphibious vehicles are included in the corresponding heading of Chapter 87; (c) aircraft specially designed in such a way that they can be used as road vehicles are included in the corresponding heading of Chapter 88. 5.- Hovercraft should be included in this section in those groups to which they correspond more closely, namely: (a) in group 86, if they are intended for movement on a guiding track (hovercraft trains); (b) in group 87, if they are intended for movement only by land or by land and by water; (c) in group 89, if they are designed to move on water, regardless of whether they can land on the shore or dock, as well as move on ice. Parts and accessories for hovercraft should be classified in the same way as parts and accessories of vehicles of the heading in which these hovercraft are included in accordance with the above notes. Track equipment and its devices for hovercraft trains should be classified as equipment and devices of the railway network, while signalling equipment, safety devices and traffic control on such systems should be classified as signalling equipment, safety devices or traffic control on railways.

Section XVII Group 86 86.01/04

Group 86 Railway locomotives or tramway motor wagons, rolling stock and parts thereof; track equipment and devices for railways or tramways and parts thereof; mechanical (including electromechanical) signaling equipment of all kinds

Notes: 1.- This chapter does not include: (a) railway or tram sleepers made of wood or concrete, or concrete track sections for hovercraft trains (heading 44.06 or 68.10); (b) ferrous metal products used for railway or tram tracks of heading 73.02; or ((c) Electrical alarm devices, safety devices or motion control devices of heading 85.30. 2.- Heading 86.07, inter alia, includes: (a) axles, wheels, wheel sets (undercarriage), metal wheel bands, rims and hubs and other wheel parts; (b) frames, subframes, trolleys and running balancing trolleys; (c) axle boxes; braking mechanisms(d) buffers for rolling stock; hooks and other coupling devices, as well as inter-car connections; (e) bodywork. 3.- Subject to the provisions of note 1, heading 86.08, inter alia, includes: (a) assembled trackbed, turning circles, dead-end stops, dimensional gates; (b) semaphores, mechanical signal discs, mechanical motion control devices at crossings, mechanisms for controlling signals and arrows, and other mechanical (including electromechanical) signaling equipment, safety or traffic control devices, regardless of whether they are equipped with electric lighting or not, for railways, tramways, roads, internal waterways, parking facilities, ports, or airfields. ------------------------------------------------------------------- Commodity! Group 87 Means of land transport, other than railway or tramway rolling stock, and parts and accessories thereof

Notes: 1.- This group does not include railway or tramway rolling stock intended for movement only on rails. 2.- In this chapter, the term "tractors" means vehicles designed primarily for towing or pushing other vehicles, devices or goods, regardless of whether they have additional devices in combination with the main purpose of the tractor, for transporting tools, seeds, fertilizers or other goods. Mechanisms and working tools designed for installation on tractors of heading 87.01 as replacement equipment belong to the corresponding headings, even if they are presented together with tractors, regardless of whether they are installed on tractors or not. 3.- Automobile chassis with cab are included in headings 87.02-87.04, and not in heading 87.06. 4.- Heading 87.12 includes all two-wheeled children's bicycles. The Republic of Kazakhstan should accede to the International Convention on the Harmonized Commodity Description and Coding System, signed in Brussels on June 14, 1983, and the Protocol amending the International Convention on the Harmonized Commodity Description and Coding System, signed in Brussels on June 24, 1986.
