On January 28, 2008, a marriage was registered between me, Seitmagambetova Indira Koblanovna and Kudaibergenov Olzhas Seitkalievich (hereinafter referred to as the defendant) at the Registry office of the Bostandyk district (act entry No. 1796 dated January 28, 2008).
There are two minor children in a joint marriage: The eldest is 9 years old, the youngest is 5 years old: Kudaibergenov Dauren Olzhasovich, born on 12.02.2009 Kudaibergenov Miras Olzhasovich, born on 29.09.2013; on December 31, 2018, my husband, Kudaibergenov Olzhas Seitkalievich, left his house at 21.15 at the address: Almaty, Bostandyk district, md. Khan-Tengri, 172, went to the store and has not returned home yet. Since December 31, 2018 (from this day on) about the fate of my husband ............, who has been absent for more than 6 (six) months) I don't know anything, and his searches through the internal affairs agencies, relatives, and acquaintances have not yielded any positive results. Husband's confession ............................. The missing persons are necessary for me to apply for state benefits for two minor children. In accordance with art . 317 of the Civil Procedure Code of the Republic of Kazakhstan, an application for recognizing a citizen as missing or declaring a citizen dead is submitted to the court in writing or in the form of an electronic document at the applicant's place of residence or at the last known place of residence of an unknown missing citizen, also in accordance with art.318 of the Civil Procedure Code of the Republic of Kazakhstan, the application must specify for what purpose the applicant needs to recognize the citizen missing or declared dead, and the circumstances confirming the citizen's unknown absence, or the circumstances of, threatening the missing person with death or giving grounds to assume his death from a certain accident. In respect of military personnel or other citizens who have gone missing in connection with military operations, the statement indicates the date of the end of hostilities.
Based on the above, guided by Article 28 of the Civil Code of the Republic of Kazakhstan and articles 317-318 of the Civil Procedure Code of the Republic of Kazakhstan,
I ask the court:
To recognize citizen Kudaibergenov Olzhas Seitkalievich, born on 08/22/1986, residing in Almaty, Bostandyk district, md. Khan-Tengri, 172, unknown to the missing.
