Statement of claim
on the recognition of the fact of fulfillment of obligations under the Agreement No.__
August 20, 20__ between ______________, in the face of ______________, ( then the Plaintiff, the Executor) and ____________________________, in the person of the head ______________, ( hereinafter referred to as the Defendant, the Customer), an Agreement was signed no. ___ for the development of the website (hereinafter referred to as the Agreement).According to Articles 1 and 2 of the Agreement, the parties agreed that the Customer commissions and the Contractor undertakes the development of the website in accordance with the terms of reference (Appendix No. 1 to this Agreement), which is an integral part of this Agreement. The cost of work under this agreement was 600,000 tenge, payment is made in tenge with 100% prepayment.Clause 3. of the Contract stipulates that the Contractor undertakes to deliver the finished website to the Customer within 25 working days from the date of approval of the design and provision of all pages of the website, and the Customer accepts them and pays.According to Appendix No. 1 of the Contract, the following works are provided below, which the plaintiff has undertaken to perform, namely:
Developing an original website design;
Development Of A Website Management System;
Photovideo gallery with the ability to create albums (Work with graphics, automatic image scaling);
HTML layout layout (for all existing browsers, adaptive layout for mobile devices);
The module for creating and editing sections and subsections of the site (Unlimited number of pages of any nesting, the ability to manage the structure of the site "in one click");
A news/article module with a list of all news/articles and a page-by-page output of each news and an archive of news, articles;

The visual editor of the website (analog MicrosoftWord);
A module for self-optimization of the site for search engines (the ability to add keywords and meta tags for each page individually, an automatically generated sitemap file for Google and Yandex search engines);
Session statistics;
Employee training in the use of CMS (Website Management System;
4 language versions of the website;
Product catalog (Categories, subcategories) with sorting filters;
User registration and authorization;
Discount accrual module (Functionality that allows you to add discounts to both an individual user and a group of users.);
Personal account with the order history;
Integration with social networks;
In clauses 3.2. and 3.3. of the Agreement, the Contractor undertakes to provide the Customer with a layout of the main or internal page of the website no later than 5 business days after receiving the first payment and a completed brief from the Customer or from the moment of receiving adjustments from the Customer to the Contractor's email address. __________; The materials necessary for filling out and designing the website are provided by the Customer to the Contractor within 5 working days from the moment of signing the contract. The Defendant received layouts of the main page of the website, however, the approval of the entire website page lasted until September 28, 20__, as evidenced by the signature and seal of the approved pages by the Plaintiff, and even after the Plaintiff approved all site layouts until October 09, 20__, the Plaintiff received changes and additions to the site layout with which the Plaintiff he worked directly.Based on paragraph 3.1. The Contractor undertook to deliver the finished website to the Customer within 25 working days from the date of approval of the design and provision of all pages of the website, and the Customer accepted them and paid for them.As of November 19, 20__, the MAXXIS website was fully ready and fully functional in accordance with the clauses of Appendix No. 1 of the Agreement., accordingly, the Defendant was notified by sending by e-mail and registered mail to the Defendant the Certificates of completed work with the recommended links and passwords to the administrative panel of the website for further use and management.At the request of the Defendant, additional work was carried out on the part of the Plaintiff that was not included in Appendix No. 1 of the Contract, namely:
Filling the website with content and information on 27 summer 14 winter tires;
Partial filling of the cities and countries module.
