Statement on establishing the fact of recognition of paternity
In the autumn of 2002, I met a citizen of K.M.S., born on 04/01/1980, then we cohabited and lived together at the address: Gitikara, microdistrict .., house .., apartment 2. We lived together as spouses, however, the marriage between us was not legally registered. On October 7, 2003, our son, K.M.M., was born, but since the marriage between us was not legally registered, the information about the child's father was recorded from my words, namely, my last name was given, and the patronymic was really after the father's name, which is confirmed by the birth certificate. On June 5, 2007, our daughter K.K.M. was born, but since the marriage between us was not legally registered, the information about the child's father was recorded from my words, namely, my last name was given, and the patronymic was really after the father's name, which is confirmed by the birth certificate. K.M.S. took care of the children, he provided them financially, was engaged in their upbringing. Subsequently, in 2011, K.M.S. and I broke up, but he continued to maintain parental relations with the children, often took them home with him, treated them like a father. On July 27, 2018, K.M.S. died.
The fact that at the time of the conception of the children and further until the death of K.M.S. we lived together can be confirmed by witnesses, namely K.M.S.'s mother, S.A.A., who lives at 106 Milyutinka St., Zhitikarinsky district, sq. 1, his brother K.A.S., who lives at address: g. Gitikara, ul., 1, my sister K.O.Yu., who lives at the address: g. Gitikara, microdistrict .., 6, sq. 34. K.M.S. he constantly took care of the children, supported them, bought them toys and all vital things, helped them financially, that is, he took part in the upbringing of children, showed care and affection, recognized them as his children, these circumstances can be confirmed by the above-mentioned witnesses. During his lifetime, K.M.S. did not have time to legally establish paternity in relation to minors K.M.M. and K.K.M. Establishing the fact of paternity is necessary for me to receive survivor's benefits. Based on the above, guided by Articles 48, 49 of the Code of the Republic of Kazakhstan "On Marriage (Matrimony) and Family" and Articles 302, paragraph 4, Part 2 of art. 305 of the Civil Procedure Code of the Republic of Kazakhstan, I ask the court to: - establish the fact of recognizing the paternity of K.M.S., born on 04/01/1980, a native of Kostanay region, who lived at the address: Kostanay region, Gitikara, microdistrict .., house 15, apartment 2, in relation to K.M.M.'s minor son, born on 10/07/2003, born in Gitikara, Kostanay region, in relation to the minor daughter of K.K.M., born on 06/05/2007, born in Gitikara, Kostanay region. - to interrogate S.A.A. as witnesses in court, address: Zhitikarinsky district, S.
