Supervision and control over the activities of collection agencies

       With the adoption of the Law on Collection Activities on May 6, 2017, collection agencies have responsibilities, responsibilities and, accordingly, State control. State control over the activities of collection agencies is carried out by the authorized body of the National Bank of the Republic of Kazakhstan (hereinafter referred to as the NBK).

Send a mandatory written order to the collection agency for the adoption of mandatory measures aimed at eliminating the identified violations and/or causes, bringing officials and responsible persons to disciplinary responsibility, as well as eliminating the conditions that contributed to their commission.;

to issue a written warning about the possibility of applying sanctions to the collection agency. In case of detection by the National Bank of the Republic of Kazakhstan within one year after the issuance of this warning. Repeated violations of the law, similar to the violation for which a written warning has been issued.;

submit a claim for the dismissal of a senior employee or other employee of a collection agency who violated the Law and interacted with the debtor.;

Also, the legislator does not exclude the use of other limited / sanctioned measures in case of violations of the law by collection agencies.
