The claim procedure for the recovery of alimony
The claim procedure provides for the application of an authorized person to the court with a statement of claim for the recovery of alimony.
The basis for filing a claim is also the failure of parents to voluntarily provide maintenance for children. A claim is filed if:
- there is a dispute about the law, which cannot be resolved on the basis of the submitted documents;
- the obligated person does not agree with the stated requirement for the recovery of alimony;
- it is necessary to resolve the issue of reducing or increasing the amount of alimony collected;
- it is necessary to collect alimony for adult disabled children;
- the issue of collecting alimony in a fixed amount of money is being resolved, which cannot be resolved through writ proceedings;
- it is necessary to reimburse additional expenses caused by exceptional circumstances,
- the claim was filed simultaneously with the claim for divorce, deprivation of parental rights;
- children live with each of the parents;
- it is necessary to invalidate the alimony payment agreement or to amend or terminate the agreement.
The recovery of alimony for minor children in court is carried out in the absence of a voluntary agreement of the parents.
