The Republican budget of the Republic of Kazakhstan for 1998
The Law of the Republic of Kazakhstan dated December 9, 1997 N 201-I
Article 1. To approve the republican budget for 1998 for revenues in the amount of 196503609 thousand tenge, official transfers received - 7455200 thousand tenge, expenditures - 281334379 thousand tenge, net lending - 33231936 thousand tenge, with the maximum size of the republican budget deficit - 110607506 thousand tenge, or 5.5 percent of the gross domestic product, according to the appendix. The Government of the Republic of Kazakhstan should implement targeted allocation of republican budget expenditures in accordance with the budget classification according to the departmental structure and ensure that the republican budget deficit is covered by borrowing on foreign and domestic capital markets, taking into account repayment of the principal amount of the national debt.
Article 2. To establish that the revenues of the republican budget for 1998 are generated from the following sources, except for amounts credited to financial funds (budgets) of special economic zones: corporate income tax and personal income tax withheld at the source of payment, except for amounts credited to local budgets; fee for registration of securities issue securities; value added tax; excise taxes on crude oil, gasoline; bonuses; royalties; excess profit tax; customs duties; income from dividends on state-owned blocks of shares; remuneration (interests) received for granting loans from budget funds; remuneration (interests) received from deposits of the Government of the Republic of Kazakhstan; rent for the use of the Baikonur complex; other non-tax revenues, except for amounts credited to local budgets; proceeds from privatization State ownership;
proceeds from the sale of goods from state material reserves, as well as proceeds from the sale of grain from state reserves. Article 3. To establish that subsurface users who previously made payments to the Republican Fund for the Protection of the Subsoil and Reproduction of the Mineral Resource Base, as well as organizations that made fixed (rental) payments before concluding contracts for subsurface use, make the above-mentioned deductions to the income of the republican budget in the amounts and on the terms determined by the Government of the Republic of Kazakhstan. In the case of obtaining for use or possession of deposits from which fixed (rental) payments of subsurface users were previously paid, legal entities and individuals, prior to the conclusion of a subsurface use contract, continue to pay them in accordance with the procedure established in part one of this article.
Article 4. To provide for the receipt of dividends on state-owned blocks of shares in the amount of 3,500,000 thousand tenge.
Article 5. Include in the republican budget revenues the Republican Environmental Protection Fund, formed from payments for environmental pollution, penalties for violations of environmental protection legislation, funds from the sale of their confiscated hunting and fishing gear, illegally obtained products, as well as other income that does not contradict the legislation of the Republic of Kazakhstan, in the amount of 30 percent of their income, to finance national and interregional environmental protection measures. The Government of the Republic of Kazakhstan will finance the costs of implementing the functions of the Republican Environmental Protection Fund in the amount of 60 percent of their actual revenues for nature protection measures, 40 percent for the construction and reconstruction of environmental facilities.
Article 6. Provide for the receipt of funds from the privatization of state property in the amount of 4,500,000 thousand tenge.
Article 7. To take into account in the republican budget the receipt of funds from the sale of grain from state reserves in the amount of 2437,000 thousand tenge, including the debt on their repayment in 1996 in the amount of 437,000 thousand tenge.
Article 8. To provide for the receipt in the republican budget for 1998 of the arrears of taxpayers on contributions to compulsory social insurance to the Pension Fund of the Republic of Kazakhstan for previous periods.
Article 9. To establish for 1998 the distribution of the total amount of revenue from national taxes to the budgets of the regions and the city of Almaty in the following amounts: a) income tax from legal entities: Akmola region - 62 percent, Aktobe - 58, Atyrau and Mangystau - 10 each, Pavlodar - 40, Almaty, East Kazakhstan, Zhambyl, West-Kazakhstan, Karaganda, Kyzylorda, Kostanay, North Kazakhstan, South Kazakhstan - 100 percent each, Almaty city - fully to the republican budget; b) personal income tax withheld at the source of payment: Atyrau region - 20 percent, Mangystau region - 71, Almaty city - 58, other regions - 100 percent each.
Article 10. To establish that local budget revenues receive: local taxes and fees; income tax from legal entities, except for amounts credited to the republican budget; income tax from individuals engaged in entrepreneurial activities and withheld at the source of payment, except for amounts credited to the republican budget; value-added tax, except for with the exception of amounts credited to the republican budget; excise taxes, with the exception of amounts credited to the republican budget; payment for forest use; payment for water; income from the rental of communal property; income from administrative fines and sanctions; state duties; income from the sale of land ownership and land use rights, including the lease of land; receipts to local environmental protection funds in the amount of 70 percent of payments for environmental pollution, penalties for violations of environmental protection legislation, funds from the sale of confiscated hunting and fishing gear, illegally obtained products, as well as other receipts that do not
contrary to the legislation of the Republic of Kazakhstan; other non-tax revenues, with the exception of amounts credited to the republican budget.
Article 11. In 1998, to allocate official transfers to regional budgets in the amount of 40184263 thousand tenge, including: Almaty - 10913917; East Kazakhstan - 4796816; Zhambyl - 4321902; West Kazakhstan - 472518; Kyzylorda - 3796247; North Kazakhstan - 6363521; South Kazakhstan - 9519342.
In 1998, provide for transfers to support the social infrastructure of the city of Priozersk, Karaganda region, in the amount of 140,000 thousand tenge.
Article 12. To establish that since January 1, 1998, the State Employment Assistance Fund has been formed at the expense of mandatory insurance contributions from employers (including legal entities with foreign participation, representative offices and branches of foreign legal entities in terms of the salary fund of citizens of the Republic of Kazakhstan) in the amount of 2 percent of the salary fund; for organizations maintained at the expense of the state budget of the Republican Association of Enterprises of pensioners "Veteran", as well as production, educational and production organizations owned by this association and created at its expense, in which only pensioners work, the Republican Association of Enterprises of the Kazakh Republican Organization of Veterans of the War in Afghanistan (without production organizations), Voluntary Society war invalids in Afghanistan (without production organizations), SOS Children's Charity Foundation - Children's Villages of Kazakhstan", the Red Crescent and Red Cross Societies - in the amount of 1 percent of the wage fund. Exempt from insurance contributions to the State Employment Assistance Fund organizations of the Voluntary Society of the Disabled of the Republic of Kazakhstan, the Kazakh Society of the Deaf, the Kazakh Society of the Blind, as well as production, educational and production organizations owned by these societies and created at their expense, in which disabled people make up at least 50 percent of the total number of employees, the Republican Society of Women-disabled people with dependent children, "Bibi-Ana", the public association League "Ak-Bota" for the guardianship of the disabled and children with disabilities in psychophysical development.
Article 13. From January 1, 1998, to establish for legal entities (including legal entities with foreign participation) representative offices and branches of foreign legal entities the rate of mandatory pension contributions to the State Pension Payment Center in the amount of 15 percent of the wage fund. For legal entities with foreign participation, representative offices and branches of foreign legal entities, the amount of these contributions is determined from the salary fund of citizens of the Republic of Kazakhstan. Individuals engaged in entrepreneurial and other activities without forming a legal entity pay monthly mandatory pension contributions to the State Pension Payment Center in the amount of 5 percent of their monthly income. To establish the rate of mandatory pension contributions to the State Pension Payment Center in the amount of 3 percent of the wage fund for the Voluntary Society of the Disabled of the Republic of Kazakhstan, the Kazakh Society of the Deaf, the Kazakh Society of the Blind, as well as industrial, educational and production organizations owned by these societies and created at their expense, in which the disabled are at least 50 percent of the total number of employees; The Republican Association of enterprises of pensioners "Veteran", as well as industrial, educational and production organizations owned by this association and created at its expense, in which only pensioners work, the Republican Association of enterprises of the Kazakh Republican organizations of veterans of the war in Afghanistan (without production organizations), the Voluntary Society of War Invalids in Afghanistan (without production organizations), the Children's Charity Foundation "S0S - Children's Villages of Kazakhstan", the Society of the Red Crescent and the Red Cross, the Republican Society of Disabled Women with Dependent Children, Bibi-Ana, the League of Ak-Bota public association for the guardianship of disabled people and children with disabilities.
Article 14. In 1998, to allocate transfers from the republican budget in the amount of 52,500 thousand tenge for the payment of pensions.
Article 15. To establish, starting from January 1, 1998, mandatory insurance contributions to the Compulsory Medical Insurance Fund under the Government of the Republic of Kazakhstan in the amount of 3 percent and to the State Social Insurance Fund - 1.5 percent of the wage fund for legal entities (including legal entities with foreign participation), representative offices and branches, and foreign legal entities. For legal entities with foreign participation, representative offices and branches of foreign legal entities, mandatory insurance premiums specified in the first part of this article are established for the salary fund of citizens of the Republic of Kazakhstan. Individuals engaged in entrepreneurial and other activities without forming a legal entity pay monthly mandatory insurance contributions to the Compulsory Medical Insurance Fund under the Government of the Republic of Kazakhstan in the amount of 33 percent and to the State Social Insurance Fund - 16 percent of the monthly calculation index for each employee. To establish that the budgets of the regions and the city of Almaty include allocations for their transfer by insurance payments for the unemployed part of the population to the regional and Almaty city offices of the Compulsory Medical Insurance Fund under the Government of the Republic of Kazakhstan.
Article 16. Establish minimum monthly wages and pensions: from January 1, 1998 - 2360 tenge; from April 1, 1998 - 2380 tenge; from July 1, 1998 - 2400 tenge; from October 1, 1998 - 2440 tenge.
Article 17. To establish a monthly calculation index for calculating pensions, allowances and other social benefits, as well as for the application of penalties, tax and other payments in accordance with current legislation in the following amounts: from January 1, 1998 - 630 tenge; from April 1, 1998 - 640 tenge; from July 1, 1998 - 650 tenge; since October 1, 1998 - 660 tenge.
Article 18. Starting from January 1, 1998, set the monthly stipend for postgraduate students studying on an on-the-job basis on the basis of a government order at the level of the official salary of a junior researcher without an academic degree.
Article 19. Establish scholarships for students studying in higher education institutions on the basis of a state order in the following amounts: from January 1, 1998 - 1,370 tenge; from April 1, 1998 - 1,380 tenge; from September 1, 1998 - 1,420 tenge. Establish scholarships for students of secondary specialized educational institutions studying on the basis of a state order in the amount of 80 percent of the scholarship amount for students of state higher educational institutions.
Article 20. From January 1, 1998, to establish the amount of monthly state benefits to families with children as a percentage of the monthly calculation index, while maintaining the current procedure for their appointment and payment.: uniform allowances for children aged: up to 3 years - 125 percent, from 3 to 18 years - 130 percent; benefits for children of conscripts - 130 percent; benefits for children infected with the acquired human immunodeficiency virus or AIDS patients - 130 percent; benefits for unemployed mothers with many children with four or more children under the age of 7 are 100 percent. Take into account that the payment of allowances for disabled children who are raised and home-schooled is made quarterly: in the amount of 4520 tenge in the first, 4590 tenge in the second, 4660 tenge in the third and 4730 tenge in the fourth quarters. The payment of a one-time allowance for the birth of a child in the amount of four times the monthly calculation index is made at the expense of the State Social Insurance Fund.
Article 21. To establish that the funeral allowance is paid to family members or persons organizing the burial of working citizens - in the amount of fifteen times the monthly calculation index at the expense of the State Social Insurance Fund; pensioners - in the amount of fifteen times the monthly calculation index at the expense of the State Pension Payment Center; persons officially recognized as unemployed - in the amount of ten times The monthly calculation index is funded by the State Employment Assistance Fund. The burial allowance for participants and invalids of the Great Patriotic War is paid in the amount of thirty-five times the monthly calculation index, of which: employees - in the amount of fifteen times the monthly calculation index - at the expense of the State Social Insurance Fund and twenty times the monthly calculation index - at the expense of local budgets; pensioners - in the amount of fifteen times the monthly calculation index - at the expense of The State Pension Payment Center and the twenty-fold monthly calculation index are funded by local budgets.
Article 22. Provide for the costs of paying a one-time monetary compensation: pensioners - for damage caused by nuclear tests, in accordance with paragraphs one, two, three, four, five and six of the first part of Article 12, and living in the zones specified in Articles 5, 6, 7, 8 and 9 of the Law of the Republic of Kazakhstan dated December 18, 1992 z923600_ "On Social protection of citizens victims of nuclear tests at the Semipalatinsk Nuclear test site" (Bulletin of the Supreme Council of the Republic of Kazakhstan, 1992, No. 23, Article 560; 1994, No. 8, Ar Article 22. Article 23. Take into account that in 1998, local budget expenditures included allocations for disability, survivor's benefits and age in accordance with the Law of the Republic of Kazakhstan dated June 16, 1997 Z970126_ "On State social benefits for disability, Survivor's loss and age in the Republic of Kazakhstan", as well as benefits for the burial of recipients of state social benefits in the amount of fifteen times the monthly calculation index.
Article 24. Take into account that since January 1, 1998, local budgets have provided allocations for the payment of annual one-time allowances, financial assistance and vouchers for sanatorium treatment in accordance with the Decree of the President of the Republic of Kazakhstan, which has the force of law, U952247_ "On benefits and social protection of participants, invalids of the Great Patriotic War and persons equated to them" No. 2247 dated April 28, 1995 (Bulletin of the Supreme Council of the Republic of Kazakhstan, 1995, No. 6, Article 45; No. 14, Article 98; Bulletin of the Parliament of the Republic of Kazakhstan, 1997, No. 7, Article 79; No. 12, Article 184).
Article 25. To provide for allocations in the amount of KZT 215,000 thousand to finance transportation costs for the resettlement of indigenous people from foreign countries to Kazakhstan, with the exception of CIS member countries, in accordance with the annually approved immigration quota. It should be noted that local budget expenditures include allocations in the amount of 863200 thousand tenge for activities related to resettlement, housing, and payment of cash benefits to repatriates (oralmans) immigrating to Kazakhstan in accordance with an annually approved quota.
Article 26. To establish that since January 1, 1998, the maintenance of administrative police units, temporary detention facilities, support services and technical staff of regional, city and district internal affairs bodies transferred from the State Investigative Committee of the Republic of Kazakhstan to the Ministry of Internal Affairs of the Republic of Kazakhstan, as well as preschool institutions of the State Border Protection Committee of the Ministry of Defense of the Republic of Kazakhstan It is carried out at the expense of local budgets.
Article 27. To establish that the funds received from the lease or sale of military property, minus the costs of providing rental services and selling property, are used for the needs of the Armed Forces in accordance with the procedure established by the Government of the Republic of Kazakhstan.
Article 28. To provide allocations for scientific research in the amount of 3806690 thousand tenge.
Article 29. To take into account in the republican budget the expenses related to the fulfillment by the Republic of Kazakhstan of its obligations to participate in financing the activities of the International Fund for Saving the Aral Sea in the amount of 574875 thousand tenge.
Article 30. To provide for irrevocable allocations: for financing priority facilities - in the amount of 2,500,000 thousand tenge; for financing measures to eliminate mines in the Karaganda coal basin - in the amount of 1,150000 thousand tenge; for the implementation of the Defense Industry Development and Conversion Program - in the amount of 600,000 thousand tenge; for the State Fund for Financial Support of Agriculture - in the amount of 2,500,000 thousand tenge. tenge.
Article 31. To finance the state geological survey and protection of the subsurface in the amount of 900,000 thousand tenge and exploration and evaluation work on special Government decisions, compensated by subsurface users, 150,000 thousand tenge on a refundable basis.
Article 32. To provide funds for the costs of grain storage of state insurance and mobilization reserves in the amount of 500,000 thousand tenge.
Article 33. To approve the reserve fund of the Government of the Republic of Kazakhstan in the amount of 3238,000 thousand tenge, including for financing emergency situations and measures, including the elimination of natural and man-made emergencies, in the amount of 1893398 thousand tenge.
Article 34. To provide appropriations for servicing the national debt in the total amount of 26464292 thousand tenge. Article 35. To provide allocations in the amount of 409,500 thousand tenge for reimbursement to second-tier banks of expenses related to lending on preferential terms to the development of small and medium-sized businesses, including those related to agricultural production - in the amount of 200,000 thousand tenge.
Article 36. Provide funds: in the amount of 2,500,000 thousand tenge - for long-term preferential loans to agricultural producers on a refundable basis through authorized second-tier banks. The provision of these funds to second-tier banks should be carried out on a competitive basis; in the amount of 1,000,000 thousand tenge on repayment terms - to provide agricultural machinery on a leasing basis to rural producers; for the implementation of a program for the development of renewable energy sources - in the amount of 200,000 thousand tenge. tenge allocated on a refundable basis in accordance with the procedure determined by the Government of the Republic of Kazakhstan.
Article 37. To provide allocations for the implementation of the state housing policy for the refinancing of mortgage loans from second-tier banks provided for housing construction or the purchase of housing by individuals in the amount of 3,300,000 thousand tenge.
Article 38. To establish as of December 31, 1998 the limit of the state debt formed as a result of borrowing by the Government of the Republic of Kazakhstan in the amount of 344700000 thousand tenge.
Article 39. To provide 10221305 thousand tenge for repayment and servicing of external loans previously received under state guarantees of the Republic of Kazakhstan.
Article 40. To provide in the republican budget for the receipt of funds on loans previously issued from the budget: for leasing operations to provide rural producers with agricultural machinery - in the amount of 615,000 thousand tenge; Rehabilitation Bank of the Republic of Kazakhstan - in the amount of 2,100,000 thousand tenge.
Article 41. To set a limit on the provision of state guarantees of the Republic of Kazakhstan in 1998 in the amount of 17020000 thousand tenge.
Article 42. To establish that they are not subject to sequestration in the process of executing the republican budget for 1998: expenses related to servicing public debt and government-guaranteed debt; expenses and transfers for the payment of pensions; expenses for the payment of salaries; expenses related to the payment of mandatory contributions to the State Social Insurance Fund. The Compulsory Medical Insurance Fund under the Government of the Republic of Kazakhstan, the State Employment Assistance Fund of the Republic of Kazakhstan, the State Pension Payment Center; expenses for the purchase of food in educational institutions, healthcare, social protection and military institutions, as well as for the purchase of medicines.
Article 43. This Law shall enter into force on January 1, 1998.
