The requirement to terminate the contract and refund the money paid for the goods
On August 18, 2021, I purchased a product from IP K.A.F. – an Iphone 11 128 Gb black smartphone for 308,000 (three hundred and eight thousand) tenge. The product's warranty period was 12 months. After a short time, the specified smartphone revealed hidden factory defects, namely a malfunction of the touchscreen, which caused the screen to randomly open applications and perform various actions. As a result, I handed over my smartphone for warranty repairs on November 1, 2021. When I repeatedly ask when my smartphone will be returned to me, I only hear excuses that the smartphone has been repaired and it is on its way. And it's been going on for over 2 months now. I couldn't use my smartphone for more than 3 months and was inconvenienced by this, since I couldn't use all the services of the Apple smartphone manufacturer.
The requirement to terminate the contract and refund the money paid for the goods
According to the Law of the Republic of Kazakhstan "On Consumer Rights Protection", clause 6), Part 1, Article 15: A consumer to whom goods of inadequate quality have been sold, if their defects have not been specified by the seller, has the right, at his discretion, to demand termination of the contract and refund of the amount of money paid for the goods. Currently, the purchased product has lost its relevance for me, and therefore, in accordance with the Law "On Consumer Rights Protection", I demand a refund of the purchase price I paid for the smartphone, namely 308,000 tenge within 10 days, or provide a written response. Please contact me at the phone number I provided for a refund. If the funds are not returned to me within 10 days or a written response is not provided, this will be considered by me as a waiver of my request. In case of non-fulfillment of my claim, I will be forced to apply to the court for protection of my rights and recovery of all court costs incurred in the case.
