Statement

           On 02/03/2018, a civil law agreement was concluded between gr. E.T.S. (hereinafter referred to as the Lessor) and gr. N.A. (hereinafter referred to as the Lessee) in accordance with Articles 716 (Form of loan agreement), 150-152 (Form and terms of a written transaction) of the Civil Code of the Republic of Kazakhstan, pursuant to which, at the insistence of the Lessor himself The landlord rented out a room in an apartment located at 195 Zh., sq. 35, Almaty. After renting the room, the Tenant repeatedly asked the Landlord to conclude a written agreement and make a temporary residence permit, but the Landlord did not conclude an agreement on renting the room and did not register it. On 08/11/2018, her daughter, taking advantage of the Landlord's absence, as a daughter, evicted the Tenant unreasonably, calling police officers (as evidenced by the IP case file) from the apartment, without prior warning, without reimbursing the amount paid in advance for the rent of the room, insulting the honor and dignity, the business reputation of the Tenant in front of neighbors in the entrance, their relatives, employees inspections have spread false information that there is slander that belittles and defames the honor and dignity of a person. After which the Tenant, having moved out of the apartment, hardly found an apartment to live in, and before that she practically lived on the street after which she felt moral and physical suffering (humiliation, irritation, depression, anger, shame, despair, physical pain, inferiority, discomfort, experienced (endured, experienced)) By the Tenant as a result of an offense committed against the Tenant. Whereas, in accordance with paragraph 1 of Article 17 of the Constitution of the Republic of Kazakhstan, human dignity is inviolable, and in part 1 of Article 34 of the Constitution, it is stipulated that everyone is obliged to comply with the Constitution and legislation of the Republic of Kazakhstan, to respect the rights, freedoms, honor and dignity of others.

The act provided for in part five of this article, committed repeatedly within a year after the imposition of an administrative penalty, entails a fine for individuals in the amount of twenty, for small businesses or non-profit organizations in the amount of thirty, for medium-sized businesses in the amount of fifty, for large businesses in the amount of one hundred monthly calculation indices.. Based on the above,

I ask you to:

To check at the above address for the rental of a room in violation of the requirements of the above article;

To bring to justice the guilty persons who rent rooms at the above address without registration of the Landlord for registration and/or temporary registration;

At the address of Almaty, Zh., 195, 35. rana received an application to the IPU for the eviction of the Tenant, which they intend to review and make copies of;

To respond to the application within the prescribed time limits.

In your proceedings, there is a civil case registered No. 7575-22-00-2/2173 dated 07/11/2022 on the claim of the KCC (Hereinafter the Plaintiff) against AAA, B.J.S. (Hereinafter the Defendant) and the private notary of Almaty SDS (Hereinafter the Notary) on the recognition of Apartment Purchase Contracts register No. 4567 dated 12/18/2021 invalid.
