Earlier, we submitted an appeal to the Ministry of Internal Affairs of the Republic of Kazakhstan about disagreement with the investigation of criminal case No. 191942031001535 registered on 11/30/2019. according to art. 317 part 3 of the Criminal Code of the Republic of Kazakhstan (improper performance of professional duties by medical or pharmaceutical workers). Subsequently, on November 11, 2020, we received a response from the Deputy Head of the Investigative Department, K. N. It was established that our arguments about the improper investigation of the criminal case were confirmed. In this regard, the Police Department of the Almaty region conducted an internal investigation, as a result of which the guilty officials were brought to disciplinary responsibility. At the same time, on the instructions of the Investigative Department, on 11/10/2020, the investigation period was resumed.

The Police Department of the Almaty region has been given written instructions to conduct additional investigative measures aimed at a full and comprehensive investigation of all the circumstances of the case, including taking into account our arguments. To date, we need to get acquainted with the adopted procedural decisions of the investigator in the above case. According to art . 99 of the Code of Criminal Procedure of the Republic of Kazakhstan, which stipulates that participants in criminal proceedings have the right to apply to the person conducting the pre-trial investigation, the prosecutor, the judge (to the court) with petitions for procedural actions or procedural decisions to establish the circumstances relevant during the criminal process, to ensure the rights and legitimate interests of the person who filed the petition, or the person they represent. Petitions can be submitted at any stage of the process. The person who submitted the petition must indicate in order to establish the circumstances in which he requests an action or a decision. Written petitions are attached to the materials of the criminal case, oral petitions are recorded in the protocol of the investigative action or court session.
