Law of the Republic of Kazakhstan dated December 8, 2006 No. 194

Article 1. To approve the republican budget for 2007 in accordance with Appendix 1 in the following amounts: 1) revenues - 2 220 421 435 thousands of tenge, including for: tax receipts - 1 621 664 278 thousand tenge; non-tax receipts - 131,841,042 thousand tenge; proceeds from the sale of fixed assets - 8,418,025 thousands of tenge; transfer receipts - 458 498 090 thousand tenge; 2) expenses - 2 094 459 384 thousands of tenge; 3) operating balance - 125,962,051 thousand tenge; 4) net budget lending - 11,508,784 thousand tenge, including: budget loans - 39 373 479 thousand tenge; repayment of budget loans - 50 882 263 thousand tenge; 5) balance of operations with financial assets - 367 102 068 thousand tenge, including: acquisition of financial assets - 369 102,068 thousand tenge; proceeds from the sale of financial assets of the state - 2,000,000 thousand tenge; 6) deficit - 229 631 233 thousand tenge, or 1.7 percent of the gross domestic product of the country; 7) financing of the budget deficit - 229 631 233 thousand tenge.

Article 2. To provide for receipts in the republican budget for 2007: rent for the use of the Baikonur complex by the Russian Federation in the amount of KZT 14,099,000 thousand; rent for the use of military ranges by the Russian Federation, reflected in the revenues of the republican budget, in the amount of KZT 3,038,764 thousand.  The footnote. Article 3. To approve the volume of budget revenues for 2007, allocated to the National Fund of the Republic of Kazakhstan, according to Appendix 2.

Article 4.  The footnote. Article 4 was deleted by the Law of the Republic of Kazakhstan dated July 5, 2007 No. 273 (effective January 1, 2007).

Article 5. To establish that the income of the relevant budget includes: according to the "Royalty" code of the revenue classification of the unified budget classification, the debt of subsurface users to the Republican Fund for the Protection of the Subsoil and Reproduction of the Mineral Resource Base, as well as the amount of historical costs incurred by the state for the geological study of contract territories, which are reimbursed by subsurface users operating these deposits on the basis of subsurface use contracts.; according to the code "Social Tax" of the income classification of the unified budget classification - arrears on contributions previously transferred to the Pension Fund, the State Pension Payment Center, the Compulsory Medical Insurance Fund, the State Social Insurance Fund, the Employment Assistance Fund, as well as contributions from highway users previously received by the Road Fund; according to the code "Gasoline (with the exception of aviation) of its own production, sold by manufacturers in bulk" - arrears in the collection of gasoline previously received by the Road Fund; according to the code "Diesel fuel of own production, sold by manufacturers in bulk" - the debt on collection from diesel fuel, previously received by the Road Fund.

Article 6. The negative balance formed as of December 31, 1998 as a result of the excess of the amounts of benefits accrued by employers for temporary disability, pregnancy and childbirth, at the birth of a child, and burial, paid from the State Social Insurance Fund, over the accrued amount of deductions to the specified fund, is counted monthly against the payment of social tax within the limits of 3 percent of the salary fund.

Article 7. To provide in the republican budget for 2007 the volume of budget withdrawals from regional budgets, budgets of Astana and Almaty to the republican budget in the amount of 151,498,867 thousand tenge, including: Aktobe region - 1,079,129 thousand tenge; Atyrau region - 43,061,767 thousand tenge; Mangystau region - 24,436,744 thousand tenge; Almaty city - 72,310,353 thousand tenge; Astana city - 10,610,874 thousand tenge.

Article 8. To provide in the republican budget for 2007 the amount of guaranteed transfer from the National Fund of the Republic of Kazakhstan in the amount of 301,715,681 thousand tenge.

Article 9. To establish from January 1, 2007: 1) the minimum wage is 9 752 tenge; 2) the amount of the state basic pension payment is 3,000 tenge; 3) the minimum pension amount is 7,236 tenge; 4) the monthly calculation index for calculating benefits and other social benefits, as well as for the application of penalties, taxes and other payments in accordance with the legislation of the Republic of Kazakhstan - 1,092 tenge; 5) the amount of the subsistence minimum for calculating the amount of basic social benefits - 8,861 tenge.

Article 10. Starting from January 1, 2007, establish a monthly amount of monetary compensation for military personnel (except for conscripts), employees of internal affairs bodies, as well as employees of operational search, investigative and combat units of fire service bodies, bodies and institutions of the penitentiary system of the Ministry of Justice of the Republic of Kazakhstan, financial police bodies to pay for housing maintenance and utilities in the amount of 3,430 tenge.

Article 11. It should be noted that the republican budget for 2007 provides funds for the payment of bonus payments to military personnel for 1997-1998 in the amount of 29,972 thousand tenge, including: To the Ministry of Internal Affairs of the Republic of Kazakhstan - 16,193 thousand tenge; to the Ministry of Defense of the Republic of Kazakhstan - 10,030 thousand tenge; to the Prosecutor General's Office of the Republic of Kazakhstan - 3,114 thousand tenge; to the Republican Guard of the Republic of Kazakhstan - 635 thousand tenge. To establish that payments of bonus payments to military personnel are made at their place of military service during the specified period in accordance with the procedure determined by the Government of the Republic of Kazakhstan.  The footnote. Article 12. To provide in the republican budget for 2007 targeted current transfers in the amount of 100,000 thousand tenge for the maintenance of the infrastructure of the city of Priozersk, Karaganda region, in accordance with the Agreement between the Republic of Kazakhstan and the Russian Federation on the terms of use and lease of the Sary-Shagan test site and ensuring the vital activity of the city of Priozersk dated January 20, 1995.

Article 13. To provide in the republican budget for 2007 the amount of subventions transferred from the republican budget to regional budgets in the amount of 192,790,980 thousand tenge, including: Akmola region - 19,616,640 thousand tenge; Almaty region - 22,186,299 thousand tenge; East Kazakhstan region - 22,189,261 thousand tenge; Zhambyl region - 21,326,306 thousand tenge; West Kazakhstan region - 11,173,159 thousand tenge; Karaganda region - 7,677,669 thousand tenge; Kostanay region - 13,414,504 thousand tenge; Kyzylorda region - 14,811,753 thousand tenge; Pavlodar region - 3,810,519 thousand tenge; North Kazakhstan - 16,545,651 thousand tenge; South Kazakhstan - 40,039,219 thousand tenge.

Article 14. It should be noted that the republican budget for 2007 provides targeted current transfers to regional budgets, the budgets of Astana and Almaty in the following amounts: 1,644,982 thousand tenge - for the payment of scholarships to students studying at secondary vocational schools on the basis of a state order from local executive bodies; 253,586 thousand tenge - for the payment of travel compensation for students in secondary vocational educational institutions on the basis of a state order from local executive bodies; 713,722 thousand tenge - for the maintenance of newly commissioned healthcare facilities; 7,491,011 thousand tenge - for the purchase of medicines, vaccines and other immunobiological preparations; 250,600 thousand tenge - for the implementation of measures to prevent and combat AIDS in the Republic of Kazakhstan; 3,816,000 thousand tenge - for the payment of state benefits for children under 18 years old from low-income families according to Appendix 4 ; 600,852 thousand tenge - to provide disabled people in need with mandatory hygiene products and the provision of services by sign language specialists, individual assistants in accordance with an individual rehabilitation program for a disabled person; 29,673 thousand tenge - to compensate for the increase in telephone subscription fees to socially protected citizens who are subscribers of urban telecommunications networks; 1,122,233 thousand tenge - to subsidize the cost of services for the supply of drinking water from particularly important group water supply systems that are alternative sources of drinking water supply; 277,506 thousand tenge - for the maintenance of additional staff of the migration police, allocated in 2006; 1,024,543 thousand tenge - for the introduction of an interactive learning system in the state system of secondary education general education. Take into account that in local budgets, at the expense of funds provided for the payment of state targeted social assistance, expenses for the payment of state benefits for children under 18 from low-income families in the amount of at least 2,916,400 thousand tenge should be provided according to appendix 4. The distribution of these amounts to the regional budgets, the budgets of Astana and Almaty cities and the procedure for their use are determined on the basis of a decision of the Government of the Republic of Kazakhstan.  The footnote. Article 15. To provide funds in the republican budget for 2007 for the payment of one-time state monetary compensation to pensioners and recipients of state social benefits, as well as to the working and non-working population living and living in radiation risk zones and in areas with preferential socio-economic status from 1949 to 1990, affected by nuclear tests at the Semipalatinsk Test site nuclear test site, in the amount of 4,682,512 thousand tenge. To establish that these funds are allocated in accordance with the procedure determined by the Government of the Republic of Kazakhstan.  The footnote. Article 16. To take into account that the republican budget for 2007 provides targeted current transfers to regional budgets, budgets of Astana and Almaty for subsidies aimed at agricultural development in the amount of KZT 19,988,355 thousand, including: 996,253 thousand tenge - to support the development of seed production; 2,004,648 thousand tenge - for the development of breeding livestock; KZT 12,805,000 thousand - to increase the yield and quality of crop production, reduce the cost of fuels and lubricants and other inventory items necessary for spring field and harvesting operations for priority crops determined by the Government of the Republic of Kazakhstan; KZT 731,166 thousand - to subsidize the cost of water delivery services to agricultural producers; 800,002 thousand tenge - to ensure the laying and cultivation of perennial plantations of fruit crops and grapes; 2,539,656 thousand tenge - for subsidizing the increase in productivity and quality of livestock products; 111,630 thousand tenge - for the quality examination of Kazakhstani cotton fiber. The distribution of these amounts to the regional budgets, the budgets of Astana and Almaty cities and the procedure for their use are determined on the basis of a decision of the Government of the Republic of Kazakhstan.  The footnote. Article 17. To provide in the republican budget for 2007 targeted current transfers to regional budgets, budgets of Astana and Almaty for the payment of salaries to civil servants, employees of government institutions who are not civil servants, and employees of state-owned enterprises in the amount of 89 469 724 thousand tenge, including: Akmola region - 4,553,881 thousand tenge; Aktobe region - 4,490,992 thousand tenge; Almaty region - 6,215,893 thousand tenge; Atyrau region - 3,420,551 thousand tenge; East Kazakhstan Region - 7,338,533 thousand tenge; Zhambyl region - 5,735,978 thousand tenge; West Kazakhstan region - 4,178,255 thousand tenge; Karaganda region - 7,975,494 thousand tenge; Kostanay region - 5,204,640 thousand tenge; Kyzylorda region - KZT 6,922,919 thousand; Mangystau region - KZT 2,831,552 thousand; Pavlodar region - 4,476,595 thousand tenge; North Kazakhstan - 4,363,444 thousand tenge; South Kazakhstan - 13,090,070 thousand tenge; Almaty city - 5,566,789 thousand tenge; Astana city - 3,104,138 thousand tenge.

Article 18. To provide in the republican budget for 2007 targeted current transfers to regional budgets, the budgets of Astana and Almaty to compensate for the loss of budget revenues in the amount of 29,666,165 thousand tenge in connection with the introduction of a fixed individual income tax rate of 10 percent for all individuals from January 1, 2007, with the exception of income when the taxation of the minimum wage instead of the monthly calculation index and the abolition of the excise tax on gambling, which goes to the local budget. The distribution of the specified amount to the regional budgets, the budgets of the cities of Astana and Almaty is determined on the basis of a decision of the Government of the Republic of Kazakhstan.  The footnote. Article 19. To take into account that the republican budget for 2007 provides targeted current transfers to regional budgets, the budgets of Astana and Almaty for the implementation of the State Program for the Development of Education of the Republic of Kazakhstan for 2005-2010 in the amount of 21 988 470 thousand tenge, including: 2,457,650 thousand tenge - for equipping classrooms of physics, chemistry, biology in state institutions of secondary general education with educational equipment; 124,031 thousand tenge - for the provision of special (correctional) educational institutions with special technical and compensatory means; 9,870,715 thousand tenge - for the maintenance of standard staff of state institutions of general secondary education; 5,209,021 thousand tenge - for the maintenance of newly commissioned educational facilities; 108,228 thousand tenge - for catering, accommodation and transportation of children to testing points; 500,012 thousand tenge - for Internet connection and payment for traffic of state institutions of secondary general education; KZT 895,513 thousand - for the purchase and delivery of textbooks and teaching materials for updating library collections of state institutions of secondary general education; KZT 1,958,760 thousand - for the creation of language and multimedia classrooms in state institutions of secondary general education; KZT 286,100 thousand - for strengthening the material and technical base of state institutions of primary vocational education; 503,440 thousand tenge - for retraining and advanced training of teaching staff in regional (city) institutes of advanced training of teaching staff; 75,000 thousand tenge - for strengthening the material and technical base of regional (city) institutes of advanced training of teaching staff. The distribution and the procedure for the use of these targeted current transfers are determined by the Government of the Republic of Kazakhstan.

Article 20. To take into account that the republican budget for 2007 provides targeted current transfers to regional budgets, the budgets of Astana and Almaty for the implementation of the State Program for the reform and development of healthcare in the Republic of Kazakhstan for 2005-2010 in the amount of 31,449,132 thousand tenge, including: 114,369 thousand tenge - for reimbursement of expenses for increasing the cost of training and additional admission to secondary vocational education organizations within the framework of a state order; 247,114 thousand tenge - for advanced training and retraining of medical personnel, as well as managers in the field of healthcare; 1,020,274 thousand tenge - for providing medicines to children and adolescents registered for outpatient treatment of chronic diseases; 1,580,657 thousand tenge - for providing medicines on preferential terms to certain categories of citizens at the outpatient treatment level; 1,805,710 thousand tenge - to strengthen the material and technical base of regional centers of sanitary and epidemiological expertise; 4,997,571 thousand tenge - for staffing medical organizations of primary health care with medical personnel in accordance with staff standards and the development of the system of general practitioners; 41,447 thousand tenge - to ensure the activities of information and analytical centers being created; 11,489 thousand tenge - for the purchase of test systems for conducting sentinel epidemiological surveillance; 596 614 thousand tenge - for the provision of medicines for children under 5 years of age at the outpatient treatment level; 665,733 thousand tenge - to provide pregnant women with iron- and iodine-containing drugs; 3,848,767 thousand tenge - for preventive medical examinations of certain categories of citizens; 16,519,387 thousand tenge - for the logistical equipment of medical healthcare organizations at the local level. The distribution and the procedure for the use of these targeted current transfers are determined by the Government of the Republic of Kazakhstan.  The footnote. Article 21. To provide in the republican budget for 2007 targeted current transfers to regional budgets, budgets of Astana and Almaty in the amount of 749,225 thousand tenge, taking into account the transfer to the jurisdiction of local executive bodies in accordance with the Law of the Republic of Kazakhstan "On amendments and additions to certain legislative acts of the Republic of Kazakhstan on the division of powers between levels of government" individual functions and powers in the field of state regulation of architectural and urban planning activities, agriculture and land management, including: Ministry of Agriculture of the Republic of Kazakhstan in the amount of KZT 195,808 thousand; Ministry of Industry and Trade of the Republic of Kazakhstan in the amount of KZT 108,101 thousand; The Land Resources Management Agency of the Republic of Kazakhstan in the amount of KZT 445,316 thousand. The distribution of these amounts to regional budgets, budgets of Astana and Almaty cities is determined based on a decision of the Government of the Republic of Kazakhstan.

Article 22. To take into account that the republican budget for 2007 provides for expenditures in the amount of KZT 6,945,108 thousand to compensate for the cost of supplying fuel to an energy-producing organization in order to ensure stable electricity supply to consumers in the southern regions of Kazakhstan in the period 2006-2007, carried out in accordance with the procedure determined by the Government of the Republic of Kazakhstan.  The footnote. Article 23. To provide in the republican budget for 2007 targeted development transfers to the regional budget of the Almaty region and the budget of the city of Almaty in the amount of 1,914,733 thousand tenge for seismic reinforcement of educational and healthcare facilities. The list of educational and healthcare facilities in the Almaty region and the city of Almaty that are subject to seismic reinforcement at the expense of the national budget in 2007 is determined by the Government of the Republic of Kazakhstan.  The footnote. Article 24. To provide in the republican budget for 2007 funds in the amount of 300,000 thousand tenge for the provision of state support for the functioning of infrastructural water supply networks owned by the Republic, in accordance with the procedure determined by the Government of the Republic of Kazakhstan.

Article 25. To provide in the republican budget for 2007 for the development and strengthening of the social infrastructure of the village as part of the implementation of The State program of rural development of the Republic of Kazakhstan for 2004-2010 costs in the amount of 39,213,434 thousand tenge, including: for the development of mobile and telemedicine in healthcare in rural areas - 518,050 thousand tenge; targeted transfers for development: construction and reconstruction of drinking water supply facilities in aul (rural) settlements - 10,340,810 thousand tenge; construction and reconstruction of educational facilities in rural areas - KZT 16,919,199 thousand; construction and reconstruction of healthcare facilities in rural areas - KZT 11,435,375 thousand. The list of educational, healthcare and drinking water supply facilities in rural areas to be built and reconstructed in 2007 at the expense of these targeted development transfers is determined by the Government of the Republic of Kazakhstan.  The footnote. Article 26. To provide in the republican budget for 2007 targeted development transfers to regional budgets and the budget of Almaty city in the amount of KZT 19,556,939 thousand for the construction of particularly important educational and healthcare facilities in cities. The list of particularly important educational and healthcare facilities in cities to be built and reconstructed at the expense of the national budget in 2007 is determined by the Government of the Republic of Kazakhstan.  The footnote.  Article 26-1. To provide in the republican budget for 2007 funds in the amount of KZT 12,467,398 thousand for the payment of an advance payment for the construction of educational facilities on the basis of public-private partnership. The list and distribution of amounts for educational facilities built on the basis of public-private partnership are determined by the Government of the Republic of Kazakhstan. The footnote. Article 27. To provide for 1,569,080 thousand tenge as part of the expenses of the Ministry of Agriculture of the Republic of Kazakhstan for state support of the development of the agro-industrial complex, including for financing, in accordance with the procedure determined by the decisions of the Government of the Republic of Kazakhstan, activities related to: reimbursement of the remuneration rate (interest) on financial leasing of agricultural machinery - 158,194 thousand tenge; reimbursement of the interest rate on financial leasing of equipment for agricultural processing enterprises, - 10,886 thousand tenge; insurance support in crop production, - 300,000 thousand tenge; subsidizing the interest rate on loans issued by second-tier banks to agricultural processing enterprises to replenish their working capital, - 1 KZT 1,000,000 thousand; subsidizing the development of agricultural production management systems, - KZT 100,000 thousand.

Article 28. To provide in the republican budget for 2007 targeted development transfers to the regional budget of the East Kazakhstan region in the amount of 752 201 thousand tenge for reimbursement of value-added tax on the project "Construction of a bridge across the Irtysh River in the city of Semipalatinsk, East Kazakhstan region." The refund of the value added tax is made upon presentation of the supporting documents on the payment of the value added tax.

Article 29. To approve the reserve of the Government of the Republic of Kazakhstan for 2007 in the amount of 20,237,035 thousand tenge.  The footnote. Article 30. To provide in the republican budget for 2007 for the implementation of The State program for the development of housing construction in the Republic of Kazakhstan for 2005-2007 provides targeted development transfers to regional budgets, the budgets of Astana and Almaty for the development and improvement of engineering and communication infrastructure in the amount of 30 500 000 thousand tenge. The distribution and use of these targeted development transfers are determined by the Government of the Republic of Kazakhstan.  The footnote. Article 31. To provide in the republican budget for 2007 23,800,000 thousand tenge for crediting regional budgets, budgets of Astana and Almaty cities for housing construction at a zero interest rate as part of the implementation of the State Program for the development of housing construction in the Republic of Kazakhstan for 2005-2007 in accordance with the procedure determined by the Government of the Republic of Kazakhstan.  The footnote. Article 32. To provide in the republican budget for 2007 funds in the amount of 346 700 thousand tenge for the payment of state premiums on deposits in housing construction savings.

Article 33. To provide in the republican budget for 2007 54,933 thousand tenge for the payment of the exchange rate difference on 2006 payments of borrowers of preferential housing loans received through the closed joint-stock company Zhilstroybank.  The footnote. Article 34. It should be noted that the expenses of the Ministry of Emergency Situations of the Republic of Kazakhstan for the formation and storage of the state material reserve include funds in the amount of 1,858,872 thousand tenge for the refreshment of material assets of the state material reserve, reflecting the amount from the sale of material assets issued in the order of refreshment in the revenues of the republican budget.

Article 35. To provide funds in the republican budget for 2007 in the amount of: 50,699 thousand tenge - for the examination of proposals for facilities that may be transferred to the concession; 472,597 thousand tenge - for the evaluation and examination of concession projects. The distribution and procedure for the use of these amounts are determined on the basis of a decision of the Government of the Republic of Kazakhstan.  The footnote. Article 36. To establish that from January 1, 2007, the requirements of the Government of the Republic of Kazakhstan to legal entities liquidated as of January 1, 2007 in accordance with the legislation of the Republic of Kazakhstan, for loans and funds allocated to fulfill obligations under state guarantees, according to the list of legal entities and the amount of debt determined by the Government of the Republic of Kazakhstan, cease..

Article 36-1. To provide funds in the expenses of the Ministry of Energy and Mineral Resources of the Republic of Kazakhstan for carrying out measures to pay debts of legal entities of the Republic of Kazakhstan to economic entities of Turkmenistan in the amount of 1,849,826 thousand tenge.  The footnote. Article 37. To provide in the republican budget for 2007 3,551,406 thousand tenge for repayment and servicing of loans guaranteed by the state.

Article 38. To establish a limit on the provision of state guarantees of the Republic of Kazakhstan in 2007 in the amount of 11,700,000 thousand tenge.

Article 39. To set the government debt limit as of December 31, 2007 in the amount of 782,000,000 thousand tenge.

Article 40. To set a limit on the provision of state guarantees in 2007 in the amount of 35,100,000 thousand tenge.

Article 41. To approve the list of budget programs for the development of the republican budget for 2007, divided into budget programs aimed at the implementation of budget investment projects (programs) and the formation or increase of the authorized capital of legal entities, according to Appendix 5.

Article 42. To approve the list of republican budget programs that are not subject to sequestration in the process of executing the republican budget for 2007, according to Appendix 6. To establish that in the process of executing local budgets for 2007, local budget programs are not subject to sequestration in accordance with Appendix 7.

Article 43. This Law shall enter into force on January 1, 2007.
