Bank CenterCredit JSC, represented by a representative ______________, acting on the basis of Power of attorney no. _____ of ________ year (hereinafter referred to as Party 1), on the one hand, and .............. 06.01.19... year of birth, IIN on whose behalf, by proxy No. 416 dated April 30, 2019, Law and Law Law Company LLP, BIN 190240029071, is acting, represented by the General Director................(hereinafter referred to as Party 2), on the other hand, collectively referred to as the "Parties", taking into account: - that a bank loan agreement has been concluded between Party 1 and Party 2 №..................... dated July 05, 20.... year (hereinafter referred to as the Loan Agreement); - that the court of the Al-Farabi District Court of Shymkent is considering a civil case on the claim of Bank Center Credit JSC against ............... on debt collection for loan obligations in the amount of 8,937,486 (eight million nine hundred thirty-seven thousand four hundred eighty six) tenge and recovery of expenses for the payment of state duty in the amount of 268 124 (two hundred sixty eight thousand one hundred twenty four) tenge; on a voluntary basis and without any coercion from the outside, guided by art. 174, 179, 180 of the CPC of the Republic of Kazakhstan, concluded an agreement among themselves on the settlement of a dispute (conflict) by way of mediation (hereinafter referred to as the Agreement) in a civil case on the claim of Bank CenterCredit JSC to ...................... Oh collection of debt on credit obligations in the amount of 8,937,486 (eight million nine hundred thirty-seven thousand four hundred eighty-six) tenge and collection of expenses for payment of state duty in the amount of 268,124 (two hundred sixty-eight thousand one hundred twenty-four) tenge on the following conditions:
Agreement on dispute settlement through judicial mediation
This Agreement is subject to execution based on the principles of voluntariness and good faith of the Parties.
This Agreement is confidential and is not subject to disclosure except in cases stipulated by the legislation of the Republic of Kazakhstan.
Party 2 undertakes to repay the overdue principal debt by June 20, 2019, and the overdue remuneration by August 20, 2019.
Party 2 undertakes not to violate the terms of the Bank Loan Agreement in the future. №....................... dated July 05, 20..... of the year.
In case of full fulfillment by Party 2 of paragraph 3 of this Agreement, Party 1 undertakes to restore Party 2 to the payment schedule in accordance with Appendix No. 1 to the Bank Loan Agreement. №................. dated July 05, 20..... of the year.
In case of full fulfillment by Party 2 of paragraph 3 of this Agreement, Party 1 undertakes to waive in full the collection of penalties in the amount of 133,048.33 tenge.
Court costs in the form of the paid state fee are returned to Party 1 in accordance with clause 4, Part 5, Article 177 of the CPC RK.
In case of non-fulfillment of obligations under this mediation agreement, the Parties reserve the right to apply to the court in accordance with clause 4 of Article 27 of the Law of the Republic of Kazakhstan "On Mediation" and Articles 145-147 of the CPC RK.
The legal consequences of concluding this Agreement have been explained to the parties.
Agreement on dispute settlement through judicial mediation
This Agreement comes into force from the moment of its signing by all the Parties.
The term of this Agreement shall expire after the Parties have fulfilled all their obligations, after which the Parties will have no claims against each other.
This agreement is drawn up in three copies having equal legal force, one copy each for the Parties to the agreement, one copy is submitted to the Court for attachment to the case file. Signatures of the parties:
