AGREEMENT ON THE PAYMENT OF ALIMONY FOR A MINOR CHILD                                                                                  

On December 13, 2022, we, the undersigned, U..E.K. IIN., hereinafter referred to as the "Alimony Recipient", on the one hand, and S.M.K. IIN...., hereinafter referred to as the "Alimony Payer", on the other hand, being the parents of a common minor child K.T.M. born on 03/02/2005, in connection with the filing of a claim for the recovery of alimony for payment in the post-secondary education system in accordance with Article 141 of the Code of the Republic of Kazakhstan "On Marriage (Matrimony) and Family", we have concluded this agreement on the following:1. SUBJECT OF THE AGREEMENT1.1. The subject of this Agreement is the payment of alimony intended to pay for the education of a common minor child of the parties, born on 03/02/2005, until the age of twenty-one, in the system of post-secondary and higher education.2. Rights AND OBLIGATIONS OF THE PARTIES 2.1. The payer agrees that he is obliged to ensure that the child receives compulsory post-secondary and higher education.2.2. The alimony payer undertakes to pay alimony for payment in the system of post-secondary and higher education in the amount, manner and within the time limits provided for in this Agreement.2.3. The payer has the right to conclude an agreement with the educational institution on payment for the child's education and pay according to the schedule provided to the Payer.2.4. The alimony payer has the right to pay the child's expenses necessary for the purchase of clothes, food, rental expenses, etc.2.5. If the child enters a Higher educational institution for higher education, the Payer undertakes to pay alimony for payment in the higher education system in the amount, method and within the time limits agreed upon during the conclusion of an additional agreement with the child. An additional agreement is made in notarized form. 2.6. The parties, taking into account the opinion of the child, have the right to choose the organization of education and the form of education of the child, where the child will study in the higher education system.2.7. The payer has the right to pay for the child's education in the system of post-secondary and higher education in full, ahead of schedule.2.8. In case of non-fulfillment, as well as improper fulfillment by the Payer of payment obligations, as well as delay in any of the payments, the Recipient has the right, and the Payer agrees to this, to issue and submit for execution an executive document for 25 monthly calculation indices.

3. The AMOUNT AND PROCEDURE OF ALIMONY payment3.1. The annual amount of payment in the system of post-secondary education (college) is 420 000 tenge.3.2. The annual amount of alimony in the system of post-secondary education (college) is 138 monthly calculation indices established by the current legislation at the time of payment.3.3. The Parties confirm that the amount of alimony established under this Agreement is not lower than the amount of alimony that the child actually needs to pay for tuition in the system of post-secondary and higher education.3.4. Alimony payments in the post-secondary education (college) system for the period from January 2023 to May 2023 are made by the Alimony Payer according to the schedule provided by the educational institution.1. In January 2023, the amount of 64,000 tenge; 2. In February 2023, the amount of 64,000 tenge; 3. In March 2023, the amount of 64,000 tenge; 4. In April 2023, the amount of 64,000 tenge;5. In May 2023, the amount of 64,000 tenge.3.5. Alimony payments in the post-secondary education (college) system for the period from September 2023 to May 2024 are made by the Alimony Payer according to the schedule provided by the educational institution. The payer confirms that the annual amount of payment for post-secondary education (college) is 420 000 tenge and undertakes to pay for the third (3) course of education of the child.3.6. Alimony payments are made in cash at the accounting department of the educational institution, or by transfer to a bank account belonging to the child's educational institution, and are issued with payment receipts.4. The TERM OF ALIMONY payment4.1. The date of approval of this Agreement by the court is the beginning of the payment of alimony.4.2. The end of the alimony payment is the day of the child's graduation from post-secondary and higher education.5. Responsibility OF THE PARTIES 5.1. In case of non-payment or late payment of alimony due to his fault, the Alimony Payer pays the Alimony Recipient a penalty in the amount of 0.5 percent of the amount of unpaid alimony for each day of delay.5.2. The payer is exempt from paying the penalty if he proves that the debt was not caused by his fault.6. FINAL POSITIONS6.1. This Agreement is drawn up in three copies, one of which is kept in the framework of the civil case. № ____________________, and one for each side.6.2. This Agreement may be amended or terminated at any time by mutual agreement of the parties. The amendment or termination of the Agreement is made in a notarized form.6.3. Unilateral refusal to execute this Agreement or unilateral modification of its terms is not allowed.6.4. The parties declare that they understand the consequences of concluding and approving a settlement agreement, and at the time of signing the agreement they are not under the influence of deception or threat, malicious agreement, or a combination of difficult circumstances. The entities that have signed the agreement are eligible.6.5. This agreement is subject to execution based on the principles of voluntariness and good faith of the parties.
