APPLICATION FOR RESOLUTION OF A DISPUTE CONCERNING COMMUNICATION WITH A CHILD BY A PARENT LIVING SEPARATELY FROM THE CHILD
I, A. A. A., am the father of the child, A. A. A.
Pursuant to Article 60 of the Code of the Republic of Kazakhstan “On Marriage (Matrimony) and Family” (hereinafter referred to as the “Code”), every child has the right to live and be brought up in a family, to know his or her parents, to receive their care, and to live together with them, except where this is contrary to the child’s interests.
A child has the right to be brought up by his or her parents, to have his or her interests ensured, to comprehensive development, and to respect for his or her human dignity.
Pursuant to Article 61 of the Code, a child has the right to communicate with both parents, grandparents, brothers, sisters, and other relatives. Divorce (dissolution of marriage) of the parents, invalidation of their marriage, or separate residence of the parents shall not affect the rights of the child.
Where the parents live separately, the child has the right to communicate with each of them. A child also has the right to communicate with his or her parents where they reside in different states.
Pursuant to Article 73 of the Code, a parent living separately from the child has the right to communicate with the child, participate in the child’s upbringing, and participate in resolving issues concerning the child’s education and other matters of importance to the child.
The parent with whom the child resides shall not prevent the child from communicating with the other parent, provided that such communication does not cause harm to the child’s physical or mental health or moral development.
I hereby request that the dispute concerning communication with the child be considered, as the child’s mother has categorically prevented me from communicating with the child since 9 May 2026, without providing any explanation or reasons.
Accordingly, I request that the following schedule for my communication with the child be established:
a) every Friday from 9:00 p.m. until 9:00 p.m. on Sunday;
b) on public holidays, by mutual agreement between the parents, from 9:00 a.m. until 9:00 a.m. of the following day;
c) on my birthday, 14 April, every year, from 9:00 a.m. on 14 April until 9:00 a.m. on 15 April;
d) on my mother’s birthday (the child’s grandmother), 5 July, every year, from 9:00 a.m. on 5 July until 9:00 a.m. on 6 July;
e) on 7 May (Defender of the Fatherland Day), every year, from 9:00 a.m. on 7 May until 9:00 a.m. on 8 May;
f) during the autumn, winter, and spring school holidays — during the second half of each holiday period; during the summer holidays — from 15 July to 31 August each year.
