Statement
Nami rana sent Applications through the e-Government web portal to the Office of the Migration Service of the DP of Almaty. Where their demands were motivated as follows: In the proceedings of the Private Bailiff of the Executive district of the Almaty region, B.R.O., there is an Enforcement document issued by the Auyezovsky District Court of Almaty, on which enforcement proceedings were initiated for No.6851/18-19-1090 dated 03.09.2018, on recovery from the Debtor A.A. D. the amount of debt in the amount of 1,333,174 tenge in for the benefit of the Claimant N.A.B.. On 12.02.2019, the Bailiff applied to the Karasai District Court of the Almaty region with a request to declare a wanted list for the debtor A.A. D., born on 03/21/1969, IIN .., through the internal affairs bodies. On 13.02.2019, the Karasai district Court of the Almaty region, composed of the presiding judge K.T. Uteubaev, having considered in open court the submission of the private bailiff B.R.O., on the announcement of the search for the debtor A.A.D.., IIN 690321300512, DETERMINED: the submission of the private bailiff B.R.O., on the announcement of the search for the debtor A.A.D.., IIN 690321300512, - to satisfy; to declare a search for the debtor A.A.D.., IIN., who previously lived at the address: Almaty region, village B.; to entrust the execution of the definition and the conduct of search measures to the Internal Affairs Bodies.

Also in the Application, we additionally informed the police officers that the Debtor, A.A.D., is currently under probation control at the Department of Internal Affairs. Based on the above, they asked:
Provide information about the search activities carried out and ongoing in relation to A.A.D.., IIN .;
Provide information on the progress of the execution of the ruling of the Karasayky District Court of the Almaty region dated 02/13/2019.;
Provide information in which Police Department of the Department of Internal Affairs the Debtor A.A.D. is under probation control.
However, we received a negative response from the Office of the Migration Service of the Almaty City Police Department that, according to the internal instructions, the debtor is searched at the place of registration of the claimant (Plaintiff) and that gr. N.A. must register at the place of residence and only then will it be possible to put the Debtor on the wanted list. Of course, we do not agree with the conclusions of the police officers, since N.A., thanks to the actions of the debtor, was left homeless and today she has nowhere to register and also does not have a permanent place of residence. As the current situation has developed, as the tenant raises the issue of registration, they refuse to rent out their apartments. It turns out that if a citizen of the Republic of Kazakhstan does not have registration and permanent residence, then our Police cannot help us! We consider the actions of police officers to be unconstitutional, where stipulated, the Republic of Kazakhstan asserts itself as a democratic, secular, legal and social state, the highest values of which are man, his life, rights and freedoms. On the grounds of the above and in accordance with the Constitution of the Republic of Kazakhstan, I ask you:
Initiate a search case and declare a search against the debtor A.A.D.., IIN ..;
Provide information in which Police Department of the Department of Internal Affairs the Debtor A.A.D. is under probation control.;
To respond to our Application within the prescribed time limits.
