Article 1. Basic concepts used in this Law The Law of the Republic of Kazakhstan On Soil Protection
The following basic concepts are used in this Law:
1) agrochemical survey – a survey of soils conducted to determine the content of mineral nutrition elements for plants, soil environment reaction, organic substances, microelements, and chemistries of secondary salinisation;
2) meliorative survey – a survey of soils conducted to identify and refine the boundaries of soil contours with signs of secondary salinisation, alkalinity, waterlogging, and soil erosion;
3) soil – an independent natural-historical organomineral natural body that has arisen on the surface of the earth as a result of the prolonged impact of biotic, abiotic, and anthropogenic factors, consisting of solid mineral particles and organic substances, water, and air, and possessing specific genetic-morphological features and properties that create appropriate conditions for the growth and development of plants;
4) soil quality – the totality of soil properties that determine the nature and effectiveness of the soil’s participation in ensuring a favourable environment for the life activity of humans, plants, and animals;
5) soil health – the ability of soil to support productivity and biodiversity to ensure the life activity of humans, plants, and animals;
6) soil bonitation – a comparative assessment of the quality of soils and the natural productive capacity of agricultural land;
7) soil survey – a survey of soils conducted for the purpose of studying and establishing the properties, condition, and spatial distribution of soils in a defined territory;
8) soil restoration – a measure aimed at restoring the quality, fertility, health, and structure of soil;
9) soil protection – a complex of legal, organizational, economic, and other measures aimed at the rational use and conservation of soils, the prevention of their degradation, and protection from impacts of a natural, anthropogenic, and technogenic nature;
10) requirements in the field of soil protection – mandatory conditions and (or) restrictions imposed on economic and other activities, provided for by the laws of the Republic of Kazakhstan;
11) authorized body in the field of soil protection (hereinafter – the authorized body) – the central state body exercising regulation in the field of land relations;
12) soil monitoring – systematic observations of the condition of soils;
13) soil disturbance – a negative change in the structure of the soil and its underlying layers, leading to a decrease in soil fertility and degradation;
14) soil condition – the totality of indicators characterising the composition, structure, and properties of soil;
15) fertile soil layer – the upper humified part of the soil profile, possessing chemical, physical, and biological properties favourable for the growth and development of plants;
16) soil fertility – the ability of soil to provide plants with the necessary nutritional elements and favourable conditions for their growth and development;
17) soil depletion – the process of decreasing soil fertility, reducing biodiversity, and decreasing the content of organic and nutrient substances;
18) soil pollution – the presence in soil of polluting substances in concentrations exceeding those established by environmental quality standards for soil;
19) soil degradation – a process characterised by the deterioration of quality, decrease in fertility, biodiversity, and destruction of soil structure from impacts of a natural, anthropogenic, and technogenic nature;
20) rational use of soil – the optimal use of soil taking into account its potential capabilities and limitations, which includes measures for the prevention of soil degradation, conservation, and improvement of its fertility;
21) soil erosion – the process of destruction of the upper layer of soil as a result of washout and blowing away from impacts of a natural and anthropogenic nature, leading to a decrease in soil fertility;
22) scientifically grounded fertiliser application system – a complex of agrochemical and agrotechnical measures aimed at the rational use of organic and mineral fertilisers.
On soil protection, the Law of the Republic of Kazakhstan dated July 8, 2026 No. 341-VIII SAM
This Law regulates public relations in the field of soil protection and defines their legal, economic and organizational bases.
