Article 1. Legislation defining the procedure of criminal proceedings CPC RK Code of Criminal Procedure
1. The procedure of criminal proceedings in the territory of the Republic of Kazakhstan is determined by the Constitution of the Republic of Kazakhstan, constitutional laws, the Code of Criminal Procedure of the Republic of Kazakhstan, based on the Constitution of the Republic of Kazakhstan and generally recognized principles and norms of international law. The provisions of other laws regulating the procedure of criminal proceedings are subject to inclusion in this Code.
2. International contractual and other obligations of the Republic of Kazakhstan, as well as normative resolutions of the Constitutional Court and the Supreme Court of the Republic of Kazakhstan regulating the procedure of criminal proceedings, are an integral part of criminal procedure law.
3. If, in the course of criminal proceedings, it becomes necessary to consider an issue that must be resolved in accordance with civil or administrative law, it shall be resolved through civil or administrative proceedings.
4. Amendments and (or) additions to this Code are carried out by a law that does not provide for amendments and (or) additions to other legislative acts of the Republic of Kazakhstan, with the exception of draft laws:
1) related to amendments and (or) additions to the Criminal Code of the Republic of Kazakhstan, the Penal Enforcement Code of the Republic of Kazakhstan and the Code of Administrative Offences of the Republic of Kazakhstan;
2) developed in accordance with the legislative initiative of the President of the Republic of Kazakhstan.
