Article 1. Legislation of the Republic of Kazakhstan in the field of entrepreneurship of the Entrepreneurial Code of the Republic of Kazakhstan
1. The legislation of the Republic of Kazakhstan in the field of entrepreneurship is based on the Constitution of the Republic of Kazakhstan and consists of this Code and other regulatory legal acts of the Republic of Kazakhstan.
2. Commodity-monetary and other property relations based on equality of participants, as well as personal non-property relations related to property, are regulated by the civil legislation of the Republic of Kazakhstan.
2-1. The provisions of this Code do not apply to relations related to the return of illegally acquired assets, including the establishment and operation of a management company, in accordance with the legislation of the Republic of Kazakhstan on the return of illegally acquired assets to the state.
3. If an international treaty ratified by the Republic of Kazakhstan establishes rules other than those provided for in this Code, the rules of the international treaty shall apply.
4. In case of identification of gaps or contradictions of the norms of the legislation of the Republic of Kazakhstan in the field of entrepreneurship contained in the normative legal acts of the Republic of Kazakhstan, the provisions of this Code shall apply to the provisions of this Code.
5. The specifics of the implementation of certain types of entrepreneurship are established by the laws of the Republic of Kazakhstan.
