Article 10. Requirements for candidates for jurors of the Law on Jurors
1. The lists of candidates for jurors do not include persons:
1) those who have not reached the age of twenty-five at the time of drawing up the lists of jurors;
2) having an outstanding or outstanding criminal record;
3) recognized by the court as legally incompetent or with limited legal capacity;
4) judges, prosecutors, investigators, lawyers, civil servants and military personnel, as well as employees of law enforcement agencies;
5) registered with healthcare organizations for mental and behavioral disorders (diseases), including those related to the use of psychoactive substances.
2. Any restrictions on the inclusion of citizens in the lists of candidates for jurors based on origin, social, official and property status, gender, race, nationality, language, attitude to religion, beliefs, place of residence or any other circumstances are not allowed.
3. Candidates for jurors are excluded from the lists upon their written application.:
1) persons who do not speak the language in which the criminal proceedings are conducted;
2) persons who are unable to perform the duties of jurors due to their physical or mental disabilities;
3) persons over sixty-five years of age;
4) the clergy.
The Law of the Republic of Kazakhstan dated January 16, 2006 No. 121.
This Law regulates public relations related to the participation of jurors in criminal proceedings, defines the legal status, guarantees of independence, legal, economic and organizational bases for ensuring the activities of jurors.
