1. Architectural project – an independent project to create a structure (monument), as well as as part of the design and estimate documentation for construction, which contains architectural design, architectural and artistic, compositional and spatial planning solutions that comprehensively take into account social, economic, functional, engineering, technical, fire, explosion, sanitary, hygienic, environmental requirements, as well as energy efficiency requirements and other requirements for the construction site in the amount of, necessary for the development of a construction project or other documentation for construction.

2. The architectural project is being developed:

1) based on the design assignment approved by the customer and materials for the selection of the site (route), the results of engineering surveys, technical conditions for engineering support of the construction site;

2) in accordance with approved urban planning projects;

3) in accordance with the architectural and planning assignment of local executive bodies of cities of republican significance, the capital, districts (cities of regional significance).

3. Compliance with the decisions of the architectural project is mandatory when developing a construction project.

Changes to architectural designs may be made with the consent of the author(s) or with his (their) participation. If there are deviations from the requirements of the architectural and planning assignment, then coordination with the local executive authorities of cities of republican significance, the capital, districts (cities of regional significance) that issued it is required.

4. If it is necessary to simplify the development of the construction project of the construction facilities specified in paragraph 4 of Article 98 of this Code, the architectural project in accordance with the architectural and planning assignment may be executed in the form of a sketch (draft design).

This Code regulates public relations related to the implementation of architectural, urban planning and construction activities in the Republic of Kazakhstan, the formation of a full-fledged habitat and human activity, planning and development of settlements, interuniverse territories, ensuring the safety of construction sites at all stages of their life cycle.
